EXECUTIVE SUMMARY
Request that the Collier County Redevelopment Agency approve the application and
recipient agreement for the Immokalee Community Redevelopment Agency (CRA)
Commercial Fa~ade Improvement Grant Program for reimbursement of $12,222 for B&B
Cash Grocery Stores, Inc. for improvements to the Handy Food Store #77 located at 1812
lake Trafford Road in Immokalee, Florida.
OBJECTIVE: To approve the Commercial Fac;ade Grant Application and Agreement between
the Collier County CRA and B & B Cash Grocery Stores, Inc. in the amount of $18,273 for
improvements to the Handy Food Store #77 located at 1812 Lake Trafford Road in Immokalee,
Florida.
CONSIDERATIONS: On July 22, 2008, Agenda Item 8G, at Public Hearing, the Board of
County Commissioners approved Ordinance No. 08-40 amending Ordinance No. 2002-38 in
order to create a Commercial Fac;ade Improvement Grant Program within the geographical
limits of the Immokalee Community Redevelopment Agency.
The purpose of the Fac;ade Improvement Grant Program is to increase commercial occupancy
rates and property values within the CRA while revitalizing the overall appearance of the
Immokalee Urban Designated Area.
Eligible applicants can receive grant funding up to $20,000 as reimbursement, using a one-half
(%)-to-1 match with equal applicant funding for fac;ade improvements to commercial structures.
B & B Cash Grocery Stores, Inc. has met all the criteria for reimbursement as required by the
application process approved by the CRA and the BCC for fac;ade improvements to Handy
Store #77 located at 1812 Lake Trafford Road in Immokalee, Florida. The Recipient Agreement
includes Exhibit A, which is the Policies and Procedures for the Fac;ade Grant Program, and
Exhibit B, which is the Application submitted for approval. Back up documentation attached to
this Executive Summary includes: Applicant Commitment of Resources Form (Exhibit C), Proof
of Ownership (Exhibit D), Property Tax Payment Verification (Exhibit E), Occupational License
(Exhibit F), Proof of Property Insurance (Exhibit G), Contractor Bids (Exhibit H), Conceptual
Rendering (Exhibit I), and Existing Condition Photos (Exhibit J).
FISCAL IMPACT: Sufficient budget exists within the FY09 Immokalee CRA Trust Fund (186) to
satisfy this new grant application. This fac;ade grant project total is $18,332 and the grant
request is $12,222.

CONSISTENCY WITH GROWTH MANAGEMENT PLAN: The Immokalee Commercial Fac;ade
Grant Program furthers the programs and projects within the budgetary and policy guidance and
directives of the Community Redevelopment Agency and the Board of County Commissioners in
furtherance of Policy 4.2 of the Future Land Use Element of the Growth Management Plan
which reads as follows:
"****The Immokalee Area Master Plan addresses conservation, future land use, population,
recreation, transportation, housing, and the local economy. Major purposes of the Master Plan

are coordination of land uses and transportation planning, redevelopment or renewal of blighted
areas, and the promotion of economic development."
LEGAL CONSIDERATIONS: This Executive Summary has been reviewed for legal sufficiency
and is legally sufficient for Board action. This item is not quasi-judicial, and as such, ex parte
disclosure is not required. This item requires a majority vote only. (STW)
ADVISORY BOARD RECOMMENDATION: During the regular May 19, 2009 meeting, the
Immokalee Community Redevelopment Advisory Board approved a motion to recommend to the
CRA Board approval of six Commercial Fa9ade Grant applications for B&B Cash Groceries, Inc.
for the following B&B owned properties: Handy Food Store #50, Handy Food Store #65, Handy
Food Store #77, Handy Food Store #91, Zach's Clothing Store and Hayden Coin Laundry.
RECOMMENDATION: Recommend that the Collier County Redevelopment Agency approve
the application and recipient agreement for the Immokalee Community Redevelopment Agency
(CRA) Commercial Fa9ade Improvement Grant Program for reimbursement of $12,222 for B&B

COMMERCIAL FACADE IMPROVEMENT PROGRAM RECIPIENT AGREEMENT
THIS AGREEMENT ENTERED this _ day of , 20 by and between

refell'ed to as "CRA") and B&B Cash Grocery Stores. Inc. (hereinafter refell'ed to as
"GRANTEE").
WIT N E SSE T H:
WHEREAS, in Collier County Ordinance No. 2002-38, as amended July 22, 2008, by
Ordinance 2008-40, the Board of County Commissioners delegated authority to the CRA to
award and administer CRA programs and awards including contracts with business GRANTEES
within the boundaries of the Immokalee CRA for CRA grants; ancl
WHEREAS, the CRA Commercial Facade Improvement Program (hereinafter refell'ed to
as the Fayade Program) allows for the use of CRA funds, in conjunction with private
investments, for certain improvements to commercial structures located within the boundaries of
the Immokalee CRA; and
WHEREAS, the intent of the Facade Program is to increase commercial occupancy rates
and property values within the CRA while revitalizing the overall appearance of the lmll10kalee
Area; and
WHEREAS, GRANTEE has applied for a fayade grant in the amount of 1)'1 /;J.. .1.

WHEREAS, the CRA has determined that GRANTEE meets the eligibility requirements

NOW, THEREFORE, in consideration of the mutual covenants contained herein and
other valuable consideration, the parties agree as follows:
1. GRANTEE acknowledges to the CRA that GRANTEE has received a copy of the
Fayade Prof.,'ram, that GRANTEE has read the Fayade Program Policies and Procedures
document, and that GRANTEE has had ample opportunity to discuss the Fayade Program with
GRANTEE'S counselor advisor. GRANTEE hnther acknowledges to the CRA that GRANTEE
understands ancl agrees to abide by all of the tenl1S and conditions of the Fa<;ade Program.

3. GRANTEE has agreed to make celtain improvements to the property pursuant to
the Fayade Program application submitted to the CRA dated t;;j;s/o7 attached hereto as Exhibit
B and incorporated herein by reference.
4. CRA has approved an award to GRANTEE in the amount off; /~ .2,.:{d- to be

5. Unless prior disclosure is included in the grant application, no GRANTEE, or any
immediate relative of GRANTEE, shall serve as a contractor or subcontractor for the
construction of the improvements and no GRANTEE or any immediate relative of GRANTEE,
shall receive compensation for labor for the construction of the improvements. An immediate
relative of GRANTEE shall include mother, father, brother, sister, aunt, uncle and cousin or
family member by malTiage to include mother-in-law, father-in-law, brother-in-law and sister-in-
law. GRANTEE has verified that all contractors who have provided bids for the approved work
are actively licensed by Collier County and GRANTEE agrees that all labor will be perfOlmed
only by the lowest biclcling contractor.
6. GRANTEE agrees to obtain all necessary permits and submit any required plans
to the Collier County Community Development and Environmental Services Division. Upon
completion of the work, GRANTEE shall submit a closeout package to the CRA which will
include all applicable (electrical, shuctural, fire, plumbing, etc.) final inspection verification
from Collier County Building Inspection Division. The CRA, through its staff, shall confirm that
the improvements were constructed pursuant to the terms of this agreement approved by the
CRA and shall crcate a final repOlt to include digital color photographs of the project before and
after completion.
7. Within forty-five (45) days after confirmation that the improvements were
constructed pursuant to the terms of the approved application, GRANTEE shall be issued a
check in the amount of the award. However, if GRANTEE fails to make the improvements
pursuant to the terms of this 3!,Treement, including construction start within 90 days of execution
of the grant agreement and completion within 12 months of the execution of the grant agreement,
the award shall be deemed revoked and GRANTEE shall be entitled to no funding.

Section 1 - Program Purpose and Benefits
The Immokalee Community Redevelopment Agency's Commercial Facade Improvement
Program allows for the use of Community Redevelopment Agency (CRA) grant funds, in
conjunction with private investments, for general improvements to the exterior of commercial
structures located within the boundaries of the Immokalee Urban Designated Area.
The intent of tbe Commercial Facade Improvement Program is to increase commercial
occupancy rates and property values within the CRA while revitalizing the overall appearance of
the Immokalee Urban Designated Area. To accomplish this objective, the Program assists
conmlercial property o\-vners and tenants to restore or renovate the exteriors of their structures,
thereby improving the area's physical characteristics and enhancing the visual quality and
attractiveness of the environment, which will lead to increased investment, occupancy and
property values.
Eligible applicants can receive grant funding up to $20,000 using a one-half (Y2)-to-one match
with equal applicant funding for facade improvements to commercial structures. To illustrate, if
a grant amount of $20,000 is requested, the applicant must provide funding in an amount of at
least $10,000 toward redevelopment of the project as well.
All facade improvements must be consistent with the lmmokalee Community Redevelopment
Plan, Immokalee .Area Master Plan, and the Land Development Code.
CRA staff will review applications for completeness and determine if funding is to be
recommended. Grant funds will be distributed only upon completion of improvements and
submittal of all receipts, invoiccs and required documentation to CRA statf. A pplicHnts must bc
willing to maintain the renovations and improvements for at leClst five years. The Grantce shall
not be liable to the CRA for repayment of the grant funds provided the Grantce complies with all
conditions set forth in the Grant Agreement. Should the Grantee transfer, sell, divest itself of its
interest in the subjcct property, or fail to maintain the renovations and improvemei1ts during the
five-year period following rcccipt of the grant funds, the CRA shall be entitled to reimbursement
of the grant funds as follo\vs:

Section 3 - EIi2iblc Expenses
1. Facade improvements, such as storefronts, display windows, painting (in conjunction
with other improvements), and exterior architectural or security lighting.
2. Removal of elements that cover original architectural design and details.
3. Signage.
4. Addition and/or replacement of awnings/doors/windows.
5. Overall replacement of architectural elements that have structural deficiencies.
6. Painting, as pmt of a more comprehensive improvement project.
7. New stucco and stucco bands.
8. Electrical work direetly related to the exterior of the building or the installation of
approved signage.
9. Professional design and engineering services related to structural renovation, new
construction and signage.
10. Landscaping and irrigation (subject to approval of a Landscape Plan).

12. Vinyl soffit and fascia, as part of more extensive project improvements.
13. Roof improvements.

Section 4 - Ineligible Expenses
1. Physical or visual removal of architecturally important features.

6. Improvements constructed prior to execution of final agreement with the eRA.
7. Routine maintenance activities that are part ofnonl1al property ownership.
8. Repairs performed to correct Code violations.
9. Improvements to a property that has any judgment liens, is not current on all mortgage
and tax obligations, and has any Code violations.
10. New construction.
II. Renovations to propelties that are exclusively residential.

1. The structure to be improved must be within the boundarics of the Inul10kalee Urban
Designated Area.
2. Applicants must demonstrate that all necessary financing required to complete the project
has been secured and that the applicant is providing matching funds that are at least one-
half ('li) of the amount of the grant amount being requested.
3. Applicants must have rcceived the requisite CRA, CRA Executive Director or designee
approval prior to commencement of improvements.
4. All necessary permits and approvals must be obtained from Collier County before work
is eonmlcnced. All work is to be performed to the satisfaction of the Collier County
Building Department officials, and all site and landscaping work is to be performed in
compliance with the Land Development Code and all applicable County ordinances and
regulations.
5. A licensed contractor must perform the work; proof of licensure and insurance is
required.
6. Applicants must agree to muintain the improvements for at least five ycars. The CRA,
CRA Executive Director or designee, as applicable, must approve any changes proposed
to the improvements.
7. The propClty must be free from any judgment liens, and all mortgage and tax obligations
must be current.
8. There may be no more than one approval for project funding per fiscal year. A "project"
is defined as a single or set of enhancement/renovation activities for an eligible property.
9. The total amount of grant funds available for anyone propeliy under this Program is
$20,000. Any subsequent applications for the same property in future years ,",viII be
treated cumulatively for purposes of c1etel1l1ining funding eligibility.
Section 6 - Evaluation Criteria
Grant funds are limited and will be awarded on a first-come, first-served basis. Because one of
the primary objectives of the Commercial Facade Improvement Program is to eliminate blighted
conditions and improve the visual impact of the redevelopment area, competed applications will
be evaluated using the following criteria:
I. Consistency with the goals, objectives, policies and principles of the Immokalee
Community Redevelopment Plan and the Iml110kalee Area Master Plan.
2. Adjacency of the project to a recent or proposed redevelopment project.
3. Likelihood that the project will result in the occupancy of a presently vacant building.
4. The amount of funds that the applicant pledged to match leveraged against CRA funds.
5. The extent to which the project encourages a secure and convenient environment for
patrons and employees.
6. Receipt of pn.:vioLls iacade improvement grant awards (first-time applicants wiiI have
priority ove!' repeat applicants).

Section 7 - Application Procedures
A property owner or tenant that is interested in participating in the Conunercial Facade
Improvement Program must submit a completed and signed application, along with Supp0l1ing
documentation, to:

In addition to other supporting documents, applicants are required to submit quotes from two
licensed contractors 'with the application.
CRA staff will review applications for completeness and for compliance with Program criteria.
Applications that are incomplete may be returned for additional information. Projects that do not
comply with Program criteria will not be considered for funding.
Awards of funding will be based on the 100vest qualified bid. The applicant may elect to choose a
contractor other than the one with lowest qualified bid but shall be responsible for all costs
exceeding the lowest qualified bid. Under all circumstances, the contractor performing the work
must be licensed, insured and have worker's compensation insurance.
It is recommended that applicants retain the services of a registered architect, or similarly
qualified design professional to prepare plans, drawings, renderings and construction
specifications for their projects. Fees for services provided by a registered architect or similarly
qualified design professional may be counted towards the applicant's Program match.
The CRA will not be responsible in any manner for the selection of a contractor. An applicant
should pursue all activities necessary to determine contractor qualifications, quality of
workmanship, and reputation. The applicant will bear full responsibility for reviewing the
competence and abilities of prospective contractors and secure proof of licensing and insurance
coverage.

Pre-Application Meeting
If desired, CRA stafT will review the applicant's conceptual plans in an informal setting,
including discussion of the eligibility criteria, Program requirements, proposed project
scheduling, and consistency of the proposal with the intent of the Program. At this stage, staff
can otTer assistance with the completion of the application form and provide limited technical
and architechlral guidance on the project proposaL At the conclusion of the pre-application
meeting, staff will provide the applicant with a general detennination as to whether the proposed
project is likely to qualify to receive Program funds and whether the applicant is sufficiently
prepared to move on to the application stage.
Required Submissions
Items required for submission include:
I. A completed and signed application fon11.
2. At least four 4" by 6" color photographs of the existing building exterior, showing all
sides of the building, with emphasis on the area to be improved.
3. Renderings or conceptual drawings of the project when completed.
4. Two bids from licensed contractors detailing the following:
a. Description of the materials to be used and the construction procedure: and.
b. Itemized cost estimate of the project.
5. A legal description of the property.
6. Proof of property ownership and, if a tenant, a copy of the lease.
7. If the property is leased, the propcl1y owner must also be a pm1y to the grant application
and grant agreement.
8. Documentation from all lending institutions verifying all mortgage payments on the
property are current and that the lending institutions will provide updated information
upon request by the CRA, CRA Executive Director, or designee.
9. Documentation indicating that all property tax payments are current.
10. Proof of property insurance.
Application Approval
Projects will be forwarded to the CRA Advisory Board with a recommendation from CRA staff
for funding approval or denial. All applicants will receive written notification regarding approval
or denial of their application. If an applicant's proposal is approved by the CRA the applicant
will receive written notification of the approval, which will include a funding agreement listing
the amount of matching funds that are approved.
Documentation of Applicant's Required Match
The applicant will be required to document the type and source of the matching funds on the
application submitted to the CRA. Verification of the funding sources will be required before
final approval of the grant application.
At the discretion of the eRA Executive Director or designee, or the CRA, structural repairs
directly related to the building's facade that were completed within six months prior to the date
of the grant application MAY be used as part or all of the applicant's required match.

Construction Start
After the grant agreement has been executed, the applicant may award the construction contract
and secure all necessary construction pennits. The owner/tenant must issue a "Notice to
Proceed" to the contractor and apply for a building permit within 60 days of executing the grant
agreement. Construction must begin within 90 days of execution of the grant agreement and be
completed within 12 months of the execution of the grant agreement. Extensions may be granted
at the discretion of the CRA Executive Director or designee, contingent upon the applicant's
demonstrating just cause for such an extension.
Modifications to the approved final plans or changes to the construction documents, which
produce visible differences in the approved facade design, will require review and approval by
the CRA and/or CRA staft~ Failure to receive such approval shall invaliclate the grant agreement,
and the agreement will be deemed terminated. In the event the agreement is tenninated, and if
any grant funds have been disbursed to the applicant by the CRA as provided below, the
disbursed funds shall become immediately due and payable to the CRA.
Disbursements
Generally, approved projects will receive reimbursement funding upon completion of the project
and submission of all required receipts, invoices and documentation. For projects in excess of
$10,000 (grant and applicant match combined), \vhere the applicant cannot secure full funding
for the project, the Executive Director of tbe CRA may approve the partial payment of grant
funds once a project has reached agreed-upon milestones. In these cases, the applicant and the
CRA will reach an agreement before construction begins on the terms and conclitions of sllch a
milestone and the amount of the partial payment. However, grant funds cannot be used to
reimburse the applicant for any work done on the building prior to the date of a fully executed
Grant Agreement between the applicant and the CRA.
Funds will be disbursed by a check payable to the applicant (1) upon certification of completion
by a County Building Official, or as agreed to with the CRA Executive Director; (2) CRA staff
verification that the work \vas completed as proposed in a satisfactory and professional manner;
and (3) submission of all receipts and required documentation, including contractor invoicing,
and evidence of payment of funds for reimbursement and match, to CRA staff. Funds will not be
disbursed on projects that are not in accordance with the approved plans.
The Immokalee CRA. will make the final determination as to whether the project is complete.
Applicants must provide verification, satisfactory to the CRA, of all project costs, including
contractor invoicing, and evidence of payment of funds for reimbursement and match, before
grant funds can be disbursed.

1. Applicant submits a complete application to tbe CRA office.
2. CRA staff reviews application for completeness, accuracy and eligibility.
3. eRA staff presents recommendation to the CRA Executive Director and/or CRA, as
appropriate.

4. Upon approval, the applicant will be notified in writing of the amount of the grant
awarded and the documentation that must be provided before funds are released.
Section 8 - Disclosures
The CRA expressly reserves the right to reject any or all applications or to request additional
information from any or all applicants. The CRA retains the right to amend the program
guidelines and application procedures without notice. The CRA also retains the right to display
and advertise properties that receive grant funding.

The site is a company owned and operated convenience store with hwling facilities. It has its
original red metal tile mansard roof covering which is faded and worn. The parking lot is old, oil
spotted and rough. The sidewalks need cleaning and staining.
Outline the proposed improvements in detail (attach additional sheets if necessary).
We propose to install new Penna Tile'S' type metal roofing on the mansard roof, install new
exterior soffit lighting fixtures, stain the sidewalk and overlay and stripe the parking lot with] Yz" of

1. Pricing Eticelatlon. Due to the extreme volatility regarding steel-related, isocymlll'llte and aspmIt products, the price quoted in
this propos~ is valid only if wntn\cted or for orders placed within 30 days from the date of this quote.
2. AlA. All work to be perfonned in accordance with AlA A401.1977 Contractor.Subeonlfactor agreement or mutually agreeable
Subcontract.
3. Nature of work. Sutter Roofing Co. of Horida ( Contractor?, by and through its subsidiaries and affilJates, shall furnish the labor
and material necessuy to perform the work deseribed herein or in the referenced contract documents. Contractor does not provide
engineering. oonsulting. or architectur~ sen~ces. It is the Owner'S responsibility to retain a licensed architect or engineer to determine
proper design and code compliance. Contractor as1IWnes no responsibility foc structural integrity, compliance with building codes, or
design. If plans, specifications, or other design documents have heen furnished to Contractor, CUBtomer warmnts that they llte sufficient
and confoun to an applicable laws and building codes. Contn\ctor is not responsible for any loss, damage, or expense due to defects in
plans or specifications or building code violations unless such damage results from a deviation by Contractor from the contract
docwnents. Customer warrants aD srructures to be in sound condition capable of withstanding normal activities of roofing construction
equipment and operations. Conttactor is not responsible for location of roof drAins, adequacy of drainage, or ponding on the roof.
4. Notice. 'This propos~ is based on mutually agreed upon schedule. If the intended schedule crumges customer agrees to notify
Contactor at least three (3) weeks prior to the anticipated commencement of work.
5. Asb~t08 and ToxIc Materials. 'Ibis proposal and contract is based upon the wotk. to bt perl'onncd by Contractor not involving
asbestos-contBining or toxic materiaJg or mold and that such materials will not be encountered or disturbed during the course of
performing the roofing work. Contfllctor is not responsible for expensell, claims, or damages arising out of the presence, dislUtOOnee, or
removal of asbestos-containing or toxic material or mold. In the event t:hat such matedals ate encountered, Contmctor smill be entitled to
reasonable compensation for all additional expenses incurred.
6. Payment. Unless stated otherwise on the face of this proposal, Customer shall pay the contract price plus any additional charges
for changed or elCt!a work no later than ten (10) days after substanlial completion of the Work. If completion of the Work extends beyond
one month, Customer shall make monthly progress payments to Contractor by or before the fifth (5) day of each month for the value of
Work completed during the preceding month. Retention will be reduced to 5% after 50% completion of work. Fiml pa)'1Dent shall be
made to Conttactor within ten (10) days after substantial completion of the work. A delay by the manufacturer in the processing and
fonnal resuance of manufacturer 0 warranty document sllalI not be cause to delay the Customer 'S payment to Contractor.
7. Non-Payment. All swns not paid infuU whr:n due shall eaminterest at the [lite of1% I'l'r month until paid. If Customer does not
rmke payment, Contn\ctor shall be entitled to recovCt from CUBtomer ~I costs of collection in=ed by Contractor, including attomey 0
fees and litigation expenses. Collection matters may be proce$$ed through litigation or lltbi~tion at the discretion of the Contractor.
8. Insuxance. Conlrllctor sh211 cart}' workC!1i' cODll'l'nsatioll, automobile liability, commercial gene:ralliability, and such other
insurance as required by law. Contractor will furnish Certificates of InsUt'dtlce, cvidencing the lTI'es and amounts of its coverages, upon
request. Customer shall purchase and maintain builder '8 risk and property insurance for the fun value of the project, including tile labor,
material, and equipment furnished by Contractor, covering fire, extended covertlge, malicious mischief, vandalism, and theft on the
premises to protect llgIlinst loss or damage to material and equipment and pa.rtially completed work until the job is completed and
accepted and Contractor '8 equipment is removed ftOm the premises.
9. Additional InsUJ'cd. If Customer requires and Contractor agrees to name Customer or others as an additioml inSlllcd on
Contractor'S liability insunmce policy, Customer and Conlfactor agree that the naming of Customer or other parties as an addition~
insured is intended to apply to claims made against the additional insured to the extent the claim is due to the negligence of Contractor
and is not intended to make the Contractor 'S insurer liable for claims that are due to the fault of the additional insured.
10. Changes in the Work and Extra Work. Customer shall be entitled to order changes in the Work and the tow contr.lct price
adjusted accordingly. Contractor shall not be required to perform any changed or additional work without a written request. Any

11. Availability of Site. Contractor shall be provided with direct access to the work site for the pauage of trucks and materials and
direct access to the roof. Customer will SBsure that the material can be truck deli\'ered to a point 25 . from the roof and that Contractor'S
boom truck has access, when the material arrives. to lift the material onto the roof deck level at which is to be installed and be stockpiled
at that level. Contractor shall not be required to begin work until underlying areas are ready and acceptal>le to receive Contractor;; work
and sufficient atellli of waf deck are available and free from dirt, water, or debris to allow continuous full operation until job <;ompletion.

12. Site Conditions. Contractor shall not be responsible for additional coste required clue to the existence of utilities, wet insulation,
deteriorated deck, or other subsurface or latent conditions that are not disclosed in writing to Contractor. The .raising, disconnection,
re-connection, or rdocation of any mechanical equipment on the roof that may be necessary for Contractor to perform the roofing work
shall be performed by others or treated as an extra. The following sllall be supplied to Contractor at site of work water, power, site
security, and clear QCCes1l to work area.

13. Electrical Conduit. Contrac:ton price is based upon there not being electrical conduit or oilier materiills embedded within the
roof assembly unless expressly identified on the face of this proposal. Customer will indemnify Contractor from any personal injury,
damage, claim or expense due to the presence of electrical conduit, shall render the conduit hannless so as to avoid injury to Contractor 1;
personnel, and shall compensate Contractor for additional tim.e and expense resulting from the presence of such materials.
14. Back Charges. No back charges or claims fOf payment of services rendered or m<lterials lUld equipment fumjshed by Customer to
Contractor shall be valid unless previously authorized in writing br Contractor and unless written notice is given to Contractor within ten
(10) days of the event, act, or omission that is the basis of the back charge.
15. Working HO\lf8. 'This proposal is based upon the performance of all work during Contractor 15 regular working hoU!i. Exln
charges will be mJlde for overtime and all work perfomled other than during Contractors' regular working hours, if required by' Customer.
16. Interior Protection. Customer acknowledges that re-roofmg of an existing building may cause disturban<:e, dust, Of'debris to fill
into the interior and possibly, jf hot asphalt is used, may result in asphalt drippage, depending upon cleek conditions. Customer agrees to
remove Of protect property dire<:tiy below the roof in order to minimize potential interior damage. Conlnctor shall not be responsible for
disturbance, loss of use, clean up, or dama.ge to interior property that Customer did not remove or prote<:t prior to comrnencemmt of
rooling operations. Customer shall notify terunt:s of re-roofing and the need to provide protection underneath areas being re.roofed.
Customer agrees to hold Contractor barmless from claims of tenants who were not so notified and did not pro\oide protection.
17. Mold. Contractor is not responsible for indoor air quality, mold, or mildew, Customer should m..<pcct periodically for the existence
of leaks and l:lke a<:tions promptly, including notice to Contractor if Customer believes there are roof leaks, so that the source of waitt
entry can be identified and corrected prior to ilie potential growth of mold.
18. Warranty. Contractor will warrant contractor 'S work in accordance with its stanthrd warrnnt:y, which is incOIpOroted by referc-nce.
A copy of Contrnctor'S standard warranty will be furnished upon fe<Juest. Contractor SHAlL NOT BE LIABLE FOR SPEClAL,
PUNITIVE, INCIDENTAL OR CONSEQUENTIAL D.A1I.iAGES, OR LOST PROFITS. The acceptance of this proposal by the
Customer signifies his agreement that this wammty shall be and is the exclusive remedy against Contractor pertaining to the roof
installation. A manufacturer 1; warranty shall be furnished to Customer if a manufaCl:lm:r'S wammty is called for on the face of this
proposaL It is expressly agreed that in the event of any defccts in the materials fumished pursuant to this contact, Customer shall have
recOUcse only ag.unst the manufacturer of such material.
19. Right to Stop Work. The failure of Customer to make propee payment to Contractor when due sha1l, in addition to all other
rights. constitute a material breach of contract and shall entitle Contrnctor, at its discretion, to suspend all work and shipments, including

21. TolerancC5. All materials and work shall be furnished in accordance with nonnal industry tolerances for wlor, variation, thickness,

roof area.
22. Fumc8 and Emissions. Customer acknowledges that odors and emissions from roofing products will be released and noise will be
generated as part of the roofing operations to be performed by Contractor. Customer shall be responsible for interior air quality, including
controlling mechanical equipment, IN AC units, inlllke vents, wall vents, windows, doors, and othee openings to prevent fumes and odors
from entering the building, Customer is aware that roofmg products emit fumes, vJlpore, and odors during the application process. Some
people are more sensitive to these emissions than others. Customer shall hold Contractor mrmless ftom claims from !him parties relllting
to fumes and odors that ate emitted during the normal mofing process.
23. Arbitration. If a dispute shall arise betwecn Contractor and Customer with rcspect to any matters or questions llrising out of or
rehting to this Agreement or the breach thereof, such dispute, other than collection matters, shall be decided by arbitration administered
by and in accordance with the Construction Industry Arbitration Rules of d,e American Aditration Association. TIlls Agreement to
arbitrate shall be specifically enforceabie tmder the prevailing arbitration law. The award rCfldercd by the arbilnlnrs shall be final, and

Sign Craft will supply all labor, materials, equipment and supplies; and permits as required to perform the following work:
1. Remove wall-mounted signags at the above locations and store on roof tops as available/practical
2. Reinstall wall-mounted signage at the same locations upon notification of project completion.
Customer warrants that signs are currently permitted and have been manufactured according to Collier County Codes and
Specifications. Customer further maintains that the signs are in good working order. Should additional repair or parts
replacement be required to bring signs to code or for proper operation, additional charges will apply, based on time and materials
and with prior approval from customer.
Customer has further affirmed that an approximate 6" working space exists between the canopy and sign face at the Handy Store
#50, affording adequate space to remove sign face and then the cabinet. This quotation is based on that affirmation. Should we
encounter complications, additional charges may apply with prior discussion and approval from customer.
Customer will provide stub outs for electrical re-connection for the (3) box signs as well as stub~outs for electrical and holes for
bolts at Zach's Grocery.
Terms: 50% due with order - Remaining Balance is Net 10 days from date of final invoice.

Dear Charles,
Thank you for giving us the opportunity to provide you with a quotation for the cleaning and painting
at the different properties located in Immokalee.
Please find attached the proposed work scope for the project. We would be pleased to return to the
community and discuss our methods and proposal with you.
If the pressure cleaning method is used, the flat work or roof tiles would be cleaned using the "hydro-
scrubber)! as it gives a very even and consistent cleaning. The scrubbers do not damage the roof tile or
pavers. They ride above the surface and water is the only thing that is in contact with the substrate.
If we use a chemical method to clean we use 110 high pressure. The m.ajority of the work is done [Iom
a ladder and the fungicide is sprayed on all areas of the roof. This product is left and not rinsed off. It
will be absorbed into the tile and activated every time it rains for several months. Depending on how
dirty the roofis, you'll see the roofs clean in 3 to 8 months. We do guarantee this process and will add
additionaJ treatments in areas where there may be some mold left. If yo~ have co~cemS of people on
lhe roof, this is a good aIteroative.

Property Inspection
. The Supervisor and Technicians will walk tho property immediately prior to cleaning and point
out any problem areas. Sometimes the conununity i:, Ilware of these problems but often they
are not. These areas are building and landscaping related. The Supervisor will also do a post
inspection to ensure all work has been done and all areas are olean and free of any problems-
· Trafford can not be responsible fo)' old or damaged seals on windows and skyli,ihts at times
there could be water intrusion because of the age of seals or installation problems.
· Trafford can not be responsible fot: water intrusion through outside electrical fixtures, At times
water can get into these areas and trip a breaker. Nonnally waiting a few hours will let it dry
and the breaker can be reset. This includes outside air conditioning units (compressors) and
pool pumps. Nonna1ly these things are not an issue while cleaning.
· The home owner will be responsible for cleaning their screened Lanais after the pressure
washing, unless specified in this bid. Trafford can not be responsible for any cleaning issues on
the lanais.
· The black streaks on fascia boards and the outside of gutters sometimes have stains that will
not tota.lly cornEl off with pressure cleaning. Mildew will come off.

Plants
. Our policy with plants is that we feel we know what is required to protect them and the
methods are varied depending on the type of plant. Some plants will stress or bum if covered
for more th.!Ul an hour or so.
. We will covel' plants that we know have problems with mildewcide, We also avoid using a
mildewcide near any of these plants. We do take great care in proteoting your investment.
· If plants get damaged they usually lose some leaves, normally this does not kill the plant. In
our experience the plants usually come back w;thin two (2) months or less- often looking
better than before.
. I f plants should die then we (Trafford) will remove and replace them with the same type and
similar size of plant.

bids for individual unit owners. Our window cleaners can take care of all your window needs. We can
do interior and extel'ior windows plus clean all tracks and frames.
Terms

All work will be performed within the agreed time frame - with the exception of delays due to
inclement weather.
