THIS CAUSE came before the Code Enforcement Board(the"Board")on May 23,2019,for public hearing
upon Respondent's Motion for Extension of Time to Comply, and the Board, having heard testimony under oath,
received evidence and heard argument respective to all appropriate matters, hereupon issues its Findings of Fact,
Conclusions of Law,and Order of the Board as follows:
FINDINGS OF FACT
1. On November 16, 2018, Respondent, GERMAINE NELSON, was found guilty of violating Sections
10.02.06(B)(1)(a), 10.02.06(B)(1)(e),and 10.02.06(B)(1)(e)(i),Collier County Land Development Code 04-
41, as amended, on the subject property located at 2671 55th Ter SW, #A, Naples, FL, Folio No.
36325440005 (Legal Description: GOLDEN GATE UNIT 6 BLK 226 LOT 14, and hereinafter referred to
as the"Property")in the following particulars:
Garage altered to living space and no Collier County Building Permit obtained.
2. On the same date as above, the Board issued an Order ordering Respondent to abate the violations on or
before February 14,2019,or a fine of$250.00 per day would be assessed for each day the violations remained
thereafter(A copy of the Order is recorded at OR 5575,PG 1974).
3. On or about May 8,2019,Respondent filed a Motion for Extension of Time to Comply.
4. Respondent,having been notified of the date of hearing by certified mail and posting,appeared at the public
hearing.
CONCLUSIONS OF LAW
Based upon the foregoing facts,the Board makes the following Conclusions of Law:
4. All notices were properly and timely issued,and the Board has jurisdiction pursuant to Chapter 162,Florida
Statutes,and Chapter 2,Article IX,Code of Laws and Ordinances of Collier County,Florida.
5. Respondent has not demonstrated by the preponderance of the evidence that mitigating circumstances exist
under Section 162.09(2), Florida Statutes,to extend the time to comply. However,the Board concludes that
a 90-day continuance of this case is warranted.
ORDER
Based upon the foregoing Findings of Fact and Conclusions of Law,and pursuant to the authority granted in
Chapter 162,Florida Statutes,and Chapter 2,Article IX,Code of Laws and Ordinances of Collier County,Florida,it
is hereby ORDERED that:
A. Respondent's Motion for Extension of Time to Comply is DENIED.
B. Respondent is granted a 90-day continuance.
C. All parties shall be re-noticed for the subsequent hearing date on/or about August 23,2019.
D. Fines shall continue to accrue during the continuance period.

4. The violations have not been abated as of the date of this hearing.
CONCLUSIONS OF LAW
Based upon the foregoing facts,the Board makes the following Conclusions of Law:
5. All notices were properly and timely issued,and the Board has jurisdiction pursuant to Chapter 162,Florida
Statutes,and Chapter 2,Article IX,Code of Laws and Ordinances of Collier County,Florida.
6. The preponderance of the evidence shows that violations of Sections 22-242 and 22-231(12)(i), Code of
Laws and Ordinances of Collier County, Florida, do exist, and that Respondent committed, and was
responsible for maintaining or allowing the violations to continue as of the date of this hearing.
ORDER
Based upon the foregoing Findings of Fact and Conclusions of Law,and pursuant to the authority granted in
Chapter 162,Florida Statutes,and Chapter 2,Article IX,Code of Laws and Ordinances of Collier County,Florida,it
is hereby ORDERED that:
A. Respondent is found guilty of violating Sections 22-242 and 22-231(12)(i),Code of Laws and Ordinances of
Collier County,Florida.
B. Respondent must abate the violations by either: 1.)Repairing and replacing all broken/missing windows and
exterior doors if the above described dwelling is to remain on the Property,and obtaining all required Collier
County Building Permit(s), inspections, and Certificate(s) of Completion/Occupancy for such repairs and
replacements on or before June 22,2019, or a fine of$200.00 per day will be imposed for each day the
violations remains thereafter;or 2.)Demolishing the above described dwelling on the Property,and obtaining
all required Demolition Permit(s), inspections, and Certificate(s) of Completion/Occupancy for such
demolition on or before June 22, 2019, or a fine of$200.00 per day will be imposed for each day the
violations remains thereafter.
C. If Respondent fails to comply with this Order,Petitioner may abate the violations using any method to bring
the violations into compliance and may use the assistance of the Collier County Sheriff's Office to enforce
the provisions of this Order and all costs of abatement shall be assessed to Respondent.
D. Respondent is ordered to pay operational costs for the prosecution of this case in the amount of$59.27 on or
before June 22,2019.
E. Respondent shall notify Code Enforcement within 24 hours of abatement of the violations and request the
investigator to perform a site inspection to confirm compliance.

June 22,2019,or a fine of$200.00 per day will be imposed for each day the violations remain thereafter;
2.)Erect a temporary pool barrier on or before May 28,2019,or a fine of$250.00 per day will be imposed
for each day the violations remain thereafter; and 3.) Erect a permanent pool barrier and obtain all required
Collier County Building Permit(s) or Demolition Permit(s), inspections, and Certificate(s) of
Completion/Occupancy such permanent pool barrier on or before August 21,2019,or a fine of$250.00 per
day will be imposed for each day the violations remain thereafter.
C. If Respondents fail to comply with this Order,Collier County may abate the violations using any method to
bring the violations into compliance and may use the assistance of the Collier County Sheriff's Office to
enforce the provisions of this Order and all costs of abatement shall be assessed to Respondents.
D. Respondents are ordered to pay operational costs for the prosecution of this case in the amount of$59.91 on
or before June 22,2019.
E. Respondents shall notify Code Enforcement within 24 hours of abatement of the violations and request the
investigator to perform a site inspection to confirm compliance.

A. Respondents are found guilty of violating Chapter 130, Article Ill, Section 130-95, Code of Laws and
Ordinances of Collier County,Florida.
B. Respondents must abate all violations by taking any combination of the following corrective actions: 1.)
Unlicensed Vehicles-obtain and affix a current, valid license plate to each unlicensed vehicle not stored
within the confines of a completely enclosed structure, store unlicensed vehicles within a completely
enclosed structure, or remove unlicensed vehicles from the Property; and 2.) Inoperable Vehicles-repair
defects so that vehicles are immediately operable, store inoperable vehicles within a completely enclosed
structure, or remove inoperable vehicles from the Property on or before July 22, 2019, or a fine of
$100.00 per day will be imposed for each day the violations remain thereafter.
C. If Respondents fail to comply with this Order,Collier County may abate the violations using any method to
bring the violations into compliance and may use the assistance of the Collier County Sheriffs Office to
enforce the provisions of this Order and all costs of abatement shall be assessed to Respondents.
D. Respondents are ordered to pay operational costs for the prosecution of this case in the amount of$59.56
on or before June 22,2019.
E. Respondents shall notify Code Enforcement within 24 hours of abatement of the violations and request the
investigator to perform a site inspection to confirm compliance.

ORDER OF THE CODE ENFORCEMENT BOARD
THIS CAUSE came on for public hearing before the Code Enforcement Board (the "Board") on May 23,
2019, and the Board, having heard testimony under oath, received evidence and heard argument respective to all
appropriate matters,hereupon issues its Findings of Fact,Conclusions of Law,and Order of the Board as follows:
FINDINGS OF FACT
1. Respondents,PAUL A.BURCKY and CATHLEEN T. BURCKY,are the owners of the subject property
(the"Property").
2. Respondents,having been notified of the date of hearing by certified mail and posting,appeared at the public
hearing.
3. Prior to the hearing, Respondents entered a Stipulation, which is attached hereto as Exhibit "A". The
Stipulation is adopted and incorporated into this Order,and Respondents are ordered to comply.
4. The Property,located at 4425 North Rd,Naples,FL,Folio No.26480720007(Legal Description:COCONUT
CREEK UNIT 2 LOT 19), is in violation of Sections 10.02.06(B)(1)(a), 10.02.06(B)(1)(e) and
10.02.06(B)(1)(e)(i), Collier County Land Development Code 04-41, as amended, in the following
particulars:
Allowed numerous permits to expire and installed irrigation system, new windows, and a cupola on
the roof without obtaining required Collier County permits.
5. The violations have not been abated as of the date of the public hearing.
CONCLUSIONS OF LAW
Based upon the foregoing facts,the Board makes the following Conclusions of Law:
6. All notices were properly and timely issued,and the Board has jurisdiction pursuant to Chapter 162,Florida
Statutes,and Chapter 2,Article IX,Code of Laws and Ordinances of Collier County,Florida.
7. The preponderance of the evidence shows that violations of Sections 10.02.06(B)(1)(a)and 10.02.06(B)(1)(e)
and 10.02.06(B)(1)(e)(i), Collier County Land Development Code 04-41, as amended, do exist, and that
Respondents committed, and were responsible for maintaining or allowing the violations to continue as of
the date of this hearing.
ORDER
Based upon the foregoing Findings of Fact and Conclusions of Law,and pursuant to the authority granted in
Chapter 162,Florida Statutes, and Chapter 2,Article IX,Code of Laws and Ordinances of Collier County,Florida,it
is hereby ORDERED that:
A. Respondents are found guilty of violating Sections 10.02.06(B)(1)(a), 10.02.06(B)(1)(e) and
10.02.06(B)(1)(e)(i),Collier County Land Development Code 04-41,as amended.
B. Respondents must abate all violations by obtaining all required Collier County Building Permit(s) or
Demolition Permit(s), inspections, and Certificate(s) of Completion/Occupancy for the irrigation system,
windows,cupola,roof,fence,and pole barn on the Property on or before November 19,2019,or a fine of
$200.00 per day will be imposed for each day the violations remain thereafter.
C. If Respondents fail to comply with this Order,Collier County may abate the violations using any method to
bring the violations into compliance and may use the assistance of the Collier County Sheriffs Office to
enforce the provisions of this Order and all costs of abatement shall be assessed to Respondents.
D. Respondents are ordered to pay operational costs for the prosecution of this case in the amount of$59.77 on
or before June 22,2019.
E. Respondents shall notify Code Enforcement within 24 hours of abatement of the violations and request the
investigator to perform a site inspection to confirm compliance.

A fence and cabana type structure installed without first obtaining Collier County permits.

hearing.
ORDER
Based upon the foregoing Findings of Fact and Conclusions of Law,and pursuant to the authority granted in
Chapter 162,Florida Statutes,and Chapter 2,Article IX,Code of Laws and Ordinances of Collier County,Florida,it
is hereby ORDERED that:
A. Respondent is found guilty of violating Sections 10.02.06(B)(1)(a) and 10.02.06(B)(1)(e), Collier County
Land Development Code 04-41,as amended.
B. Respondent must abate the violations by obtaining all required Collier County Building Permit(s) or

structure on the Property on or before November 19, 2019, or a fine of$100.00 per day will be imposed
for each day the violations remains thereafter.

the violations into compliance and may use the assistance of the Collier County Sheriff's Office to enforce
the provisions of this Order and all costs of abatement shall be assessed to Respondent.
D. Respondent is ordered to pay operational costs for the prosecution of this case in the amount of$59.63 on or
before June 22,2019.
E. Respondent shall notify Code Enforcement within 24 hours of abatement of the violations and request the
investigator to perform a site inspection to confirm compliance.

violations remains thereafter; or 2.) Boarding all broken/missing windows, exterior doors, or other areas
necessary to secure the dwelling on the Property, and obtaining a boarding certificate within 7 days of the
date of this hearing, then obtain all required Collier County Building Permit(s) or Demolition Permit(s),
inspections, and Certificate(s) of Completion/Occupancy for the repair/replacement of all broken/missing
windows and exterior doors,and other repairs necessary to secure the dwelling on the Property on or before
November 19, 2019, or a fine of$200.00 per day will be imposed for each day the violations remains
thereafter.

ORDER

A. Respondents are found guilty of violating Chapter 130, Article III, Section 130-95, Code of Laws and
Ordinances of Collier County, Florida.
B. Respondents must abate all violations by taking any combination of the following corrective actions: 1.)
Unlicensed Vehicles—obtain and affix a current, valid license plate to each unlicensed vehicle not stored
within the confines of a completely enclosed structure,store unlicensed vehicles within a completely enclosed
structure,or remove unlicensed vehicles from the Property;and 2.)Inoperable Vehicles—repair defects so
that vehicles are immediately operable, store inoperable vehicles within a completely enclosed structure,or
remove inoperable vehicles from the Property on or before June 22,2019,or a fine of$100.00 per day will
be imposed for each day the violations remain thereafter.
C. If Respondents fail to comply with this Order, Collier County may abate the violations using any method to
bring the violations into compliance and may use the assistance of the Collier County Sheriffs Office to
enforce the provisions of this Order and all costs of abatement shall be assessed to Respondents.
D. Respondents are ordered to pay operational costs for the prosecution of this case in the amount of$59.56 on
or before June 22,2019.
E. Respondents shall notify Code Enforcement within 24 hours of abatement of the violations and request the
investigator to perform a site inspection to confirm compliance.

1. On March 28,2019, Respondent, YAVUZ KARAGOZ, was found guilty of violating Section 1.04.01(A),

of Laws and Ordinances of Collier County,Florida, on the subject property located at 102 New Market Rd
E, Immokalee, FL, Folio No. 63864480007_(Legal Description: NEWMARKET SUBD BLK 45 LOTS 37
THRU 40,hereinafter referred to as the"Property"),in the following particulars:
Repeat violations of a U-Haul Business operating without first obtaining all Collier County approvals
and a Collier County Business Tax Receipt.Also,U-Haul vehicles are being stored on the Property.
2. On the same date as above,the Board entered an Order ordering Respondent to: 1.)Pay a civil penalty/fine
in the amount of$1,000.00 for a repeat violation of CEOCC20180012074 on or before April 29,2019;and
2.)Abate the violations on or before April 29,2019,or a fine of$250.00 per day would be assessed for each

before January 28,2019,or a fine of$150.00 per day would be assessed for each day the violations remained
thereafter until abatement was confirmed(A copy of the Order is recorded at OR 5603 PG 2098).
3. Respondent, having been notified of the date of hearing by certified mail, posting and/or personal service,
appeared at the public hearing.
4. Operational costs of$59.63 previously incurred by Petitioner in the prosecution of this case were not paid.

before February 23,2019,or a fine of$100.00 per day would be assessed for each day the violations remained
thereafter until abatement was confirmed(A copy of the Order is recorded at OR 5603 PG 2101).
3. Respondent, having been notified of the date of hearing by certified mail, posting and/or personal service,
did not appear at the public hearing.
4. Operational costs of$60.19 previously incurred by Petitioner in the prosecution of this case were not paid

Chapter 162,Florida Statutes,and Chapter 2,Article IX,Code of Laws and Ordinances of Collier County,Florida,it
is hereby ORDERED that:
A. Petitioner's Motion for Imposition of Fines/Liens is GRANTED.
B. Daily fines of$100.00 per day are assessed and imposed against the Respondent for 62 days for the

ORDER OF THE CODE ENFORCEMENT BOARD
THIS CAUSE came before the Code Enforcement Board(the"Board")on May 23,2019,upon the Petitioner's
Motion for Imposition of Fines/Liens,and the Board,having heard testimony under oath,received evidence and heard
argument respective to all appropriate matters, hereupon issues its Findings of Fact, Conclusions of Law, and Order
of the Board as follows:
FINDINGS OF FACT
1. On March 28,2019, Respondent, LYNDA M. MAYOR, was found guilty of violating Sections 1.04.01(A)
and 2.02.03, Collier County Land Development Code 04-41, as amended, on the subject property located at
1276 Dove Tree Street,Naples, FL, Folio No. 304160002 (Legal Description: 14 49 27 COMM NW CNR,
S 1650FT, E 257FT TO POB, E 257FT, S 165FT, W 257FT,N 165FT TO POB, + E 35FT OF,hereinafter
referred to as the"Property"), in the following particulars:
Storage of school bus,tents, unpermitted accessory structures,junk,trash and debris on unimproved
vacant parcel zoned Agricultural.
2. On the same date as above,the Board ordered Respondent to abate the violations on or before April 11,2019,
or a fine of$200.00 per day would be assessed for each day the violations remained thereafter until abatement
was confirmed(A copy of the Order is recorded at OR 5618 PG 1660).
3. Respondent, having been notified of the date of hearing by certified mail, posting and/or personal service,
did not appear at the public hearing.
4. Operational costs of$59.77 previously, incurred by Petitioner in the prosecution of this case were not paid
5. Operational costs in the amount of$59.35 have been incurred by Petitioner for this hearing.
6. The violations have not been abated as of May 23,2019.
CONCLUSIONS OF LAW
Based upon the foregoing facts,the Board makes the following Conclusions of Law:
7. All notices were properly and timely issued,and the Board has jurisdiction pursuant to Chapter 162, Florida
Statutes, and Chapter 2,Article IX,Code of Laws and Ordinances of Collier County, Florida.
8. Pursuant to Section 162.09, Florida Statutes, Petitioner has demonstrated by the preponderance of the
evidence that accrued fines and costs shall be imposed against the Respondent.
ORDER
Based upon the foregoing Findings of Fact and Conclusions of Law,and pursuant to the authority granted in
Chapter 162,Florida Statutes,and Chapter 2,Article IX,Code of Laws and Ordinances of Collier County,Florida,it
is hereby ORDERED that:
A. Petitioner's Motion for Imposition of Fines/Liens is GRANTED.
B. Daily fines of$200.00 per day are assessed and imposed against the Respondent for 42 days for the
period from April 12,2019,to May 23,2019,for a total fine amount of$8,400.00.
C. Respondent shall pay operational costs in the total amount of$119.12
D. Respondent shall pay fines and costs in the total amount of $8,519.12 or be subject to Notice of
Assessment of Lien against all properties owned by Respondent in Collier County,Florida.
E. The daily fines of$200.00 shall continue to accrue until abatement has been confirmed by a Collier
County Code Enforcement Investigator.
