EXECUTIVE SUMMARY
Recommendation to approve a Developer Agreement with BCHD Partners II, LLC., (Developer)
and Collier County (County) to reserve capacity within the Transportation concurrency system and
allow a traffic signal and specific access points in exchange for the Developer donating land and
easements to the County and receiving stormwater for a future overpass at Collier Boulevard and
Immokalee Road. (This is a companion to agenda item 9.A, PUDR-PL20170000768).
OBJECTIVE: For the developer to accept and treat the stormwater run-off from the future intersection
improvements at Immokalee Road and Collier Boulevard, donate 1.34 acres along Immokalee Road and
grant easements for Public Utilities and Stormwater in exchange for reserving capacity wit hin the
transportation concurrency system and agreeing access points on Immokalee Road and to permit a traffic
signal at the Developments access point on Collier Boulevard.
CONSIDERATIONS: The County has a planned future overpass at the intersection of Immokalee Road
and Collier Boulevard. The proposed Baumgarten Mixed Use Planned Unit Development (MPUD) is
located at the southeast corner of this intersection. The conceptual plans for the overpass will require
addition right-of-way and stormwater management on the south side of Immokalee Road. The Developer
has agreed to accept and treat the stormwater created by the overpass as well as install manholes and
piping along the south side of Immokalee Road. A construction easement, as well as a maintenance
easement, will be granted to the County at no cost to the County. The Developer shall convey, at no cost
to the County, 1.34 acres and a 20-foot Utility Easement along Immokalee Road to accommodate future
FPL transmission lines and other utilities.
The County will allow two access points along Immokalee Road and one signalized access point on
Collier Boulevard across from the existing directional access into the Shoppes at Pebblebrook. The
Developer shall be responsible for the design, permitting, and constr uction costs of the traffic signal and
intersection improvements.
The County shall reserve capacity within its concurrency management system for the entire development
as initially approved within the Baumgarten MPUD.
FISCAL IMPACT: The County will not be responsible for any costs associated with the traffic
signalization on Collier Boulevard. The Developer will be responsible for all design, permitting, and
construction costs of the traffic signal. No impact fee credits will be given for the Agreement.
LEGAL CONSIDERATIONS: This proposed Agreement was drafted by the County Attorney, is
approved as to form and legality, and requires majority vote for approval. -JAK
GROWTH MANAGEMENT IMPACT: The proposed Agreement is consistent with the GMP.
RECOMMENDATION: To approve the Developer Agreement to accept and treat the stormwater run -
off from the future intersection improvements at Immokalee Road and Collier Boulevard, donate 1.34
acres along Immokalee Road and grant easements for Public Utilities and Stormwater in exchange for
reserving capacity within the transportation concurrency system and agreeing access points on Immokalee
Road and to permit a traffic signal at the Developments access point on Collier Boulevard.
