EXECUTIVE SUMMARY
Recommendation to release Golden Gate Estates Land Trust properties from the Future Saleable
List to the Active Sale List, to reserve certain properties for governmental agencies, and to require
100% of appraised value for the sale of properties.
OBJECTIVE: To obtain Board approval to transfer Golden Gate Estates Land Trust properties currently
appearing on the Future Saleable List to the Active Sale List, retain several properties for future
governmental use, and to require that all properties are sold at 100% of the appraised value.
CONSIDERATIONS: On November 15, 1983, Avatar Properties Inc. and Collier County entered into
an Agreement (1983 Agreement) that dedicated 1,061.5 acres of property in Golden Gate Estates to the
County. The dedication came with the stipulation that the land itself or money derived from the sale of
the land would be used by the County for purposes directly beneficial to the residents of Golden Gate
Estates, i.e., fire and police protection facilities and services, public schools, libraries, and recreational
facilities. The 1983 Agreement requires that all capital improvements must be physically located within
the geographical boundaries of Golden Gate Estates. The Golden Gate Estates Land Trust was then
created which later formed the Golden Gate Estates Land Trust Advisory Committee (Committee).
Since the inception of the Golden Gate Estates Land Trust, of the 1,061.5 (+/-) dedicated acres, 969.8
acres have been sold to the public or transferred to other governmental agencies.
At the Committee meeting on September 24, 2018, and again at the meeting on January 29, 2019, a 5-0
vote was made in favor of recommending that the Board release all properties currently on the Future
Saleable List to the Active Sale List so that properties may be sold during the current, active real estate
market. At those meetings, the Committee also directed staff to contact each of the agencies that reserved
properties to determine if the properties are still of interest.
The following is a breakdown of the Reserved List by agency. Staff has contacted each agency to inquire
if the previously reserved lands are still required for future use, and all requested that the properties
remain reserved.

At the October 8, 2018 Committee meeting, and again at the meeting on January 9, 2019, a vote of 5-0
was made in favor of recommending that the Board approve that all properties sold under the Golden
Gates Estates Land Trust be sold at 100% of the appraised value rather than 90% as stipulated in the 1983
Agreement.
FISCAL IMPACT: Proceeds from the sale of properties will be deposited into Fund 605.
GROWTH MANAGEMENT IMPACT: This item has no impact on the Collier County Growth
Management Plan.
LEGAL CONSIDERATIONS: This item is approved for form and legality and requires a majority vote
for Board action. - JAB
RECOMMENDATION: That the Board of County Commissioners, acting as Trustee, approves the
release of lands as outlined above, retain those properties for government use, and approves the
recommendation for properties to be sold at 100% of appraised value.
