EXECUTIVE SUMMARY
Recommendation to approve a Stipulated Final Judgment in the amount of $157,000 for
Parcel 109 in the lawsuit styled Collier Coullty v. Regiolls Balik, et al., Case No. 07-3641-CA
(Collier Boulevard Project #60001). (Fiscal Impact $9,800.)
OBJECTIVE: That the Board of County Commissioners approve a Stipulated Final Judgment for
payment of full compensation, for the taking of Parcel 109 in the lawsuit styled Collier COllnty v.
Regions Bank, et. al., Case No. 07-3641.CA (Collier Boulevard Project #6(001),
CONSIDERATIONS: Collier County condemned a 5,102 square foot parcel for road right-of-way
and a temporary construction easement (Parcels 109 and 709) from property owner Regions Bank.
The County's appraisal dated May 12,2006, valued the taking at S153,800 for both Parcels 109 and
709. The County offered the owner $153,800 as the County's statutory offer on August 31, 2007
based on the initial appraisal. Parcel 709 was resolved by the execution of a temporary construction
easement between the County and the propeliy owner. An Order of Taking hearing was held on
February 7,2008, and the County deposited the sum of $147,200 in the Court Registry for Parcel
109 only.
The attached Stipulated Final Judgment ~md Joint Motion for Stipulated Final Judgment rellect a
universal settlement agreement in the amount of $157,000 that includes full compensation for the
parcel taken, as well as any attorncy's fees and expert fees and costs. If approved, the County will
be responsible for the following costs:
Additional compensation, attorney's fees,
expert fees and costs: S9,800.00
FISCAL IMPACT: Funds in the amount of $9.800.00 will come ham Gas Taxes and Impact
Fees. Source of funds are Gas Taxes and Impact Fees.
GROWTH MANAGEMENT IMPACT: None.
LEGAL CONSIDERATIONS: This itcm is Icgally suiIicient for Board action, is not quasi-
judicial and as such, ex-pmie diselosure is not required. This itcm requires only a majority vote.

STIPULATED FINAL JUDGMENT
THIS CAUSE having come before the Court upon Joint Motion made by Petitioner,
COLILIER COUNTY, FLORIDA, hy and through its undersigned counsel, and Respondent,
REGIONS BANK, by and through its undersigned counsel, for entry of a Stipulated Final
Judgment as to Parcel 109 for Project No. 6000 I, and it appearing to the Court that the parties arc
authorized to make such Motion, the Court finding that the compensation to be paid by Petitioner is
the full compensation due the Respondent, REGIONS BANK, and the Court being otherwise fully
advised in the premises thereof, it is thereupon
ORDERED AND ADJUDGED that
I. Respondent, REGIONS BANK, have and recover from Petitioner, COLLIER COUNTY,
FLORIDA, the total sum of One Hundred Fifty-Seven Thousand and Noll 00 Dollars ($157,000.00)
for Pareel 109, as full payment for Lhe property interest taken 3...T1d for damages resulting to Lt,e
remainder, if less than the entire property was taken, and for all other damages in connection with
said parcel, and for attorney's fees, expert fees and costs.

2. Petitioner, COLLIER COUNTY, FLORlDA, is entitled to a credit for the good faith
estimate of value previously deposited in the amount of$147,200.
3. ORDERED that without further order of the Court, that within thirty (30) days hereof, the
Clerk shall disburse the amount of One Hundred Twenty-Two and 02/100 ($122.02) to the Collier
County Tax Collector, c/o E. Glenn Tucker, Esquire, Rhodes, Tucker & Garretson, P. O. Box 887,
Marco Island, Florida 34 I 46 for payment of real property (axes.
4. Within tllirty days of this Judgment, the Clerk shall disburse One Hundred Forty-Seven
Thousand Seventy-Seven and 98/100 Dollars ($147,077.98) to REGIONS BANK, c/o Tatia
Givens-Stone, Regions Bank Corporate Real Estate Department, 7130 Goodlett Fanus Parkway,
A4W, Cordova, TN 38016.
5, Petitioner, COLLIER COUNTY, FLORIDA, shall pay an additional Nine Thousand Eight
Hundred and No/lOO Dollars ($9,800,00) to Respondent as remaining compensation for subject
Parcel 109.
6. Within thirty days of this Judgment, Petitioner shall disburse $9,800.00 to REGIONS
BANK, c/o Tatia Givens-Stone, Regions Bank Corporate Real Estate Department, 7130 Goodlett
Farms Parkway, A4W, Cordova, TN 38016.
7. No other costs or fees shall be awarded to Respondent, REGIONS BANK, in this case for
Parcel 109.
8. Fee simple title to Parcel 109, being fully described in Exhibit "A" attached hereto and
incorporatcd herein, which vested in Petitioner pursuant to the Order of Taking dated February 7,
2008, and the deposit of money heretofore made, is approved, ratified, and confirmed,
9. As to Parcel 709, Petitioner and Respondent recognize a Temporary Construction Easement
recorded in Official Records Book 4333, Page 0458 of the Public Records of Collier County,
Florida.

10. Notice of Lis Pendens filed in the above-styled cause and recorded in Official Record
Book 4291, Page 2206 of the Public Records of Collier County, Florida be dismissed as to Parcels
109 and 709.
11. Pursuant to Section 74,051(4), F.S" the Clerk of Courts shall disburse the interest earned
on the funds on deposit in the amount of $2,884.26, plus any additional accrued interest for Parcel
109, to the Board of COUllty Commissioners, account number: 336- I 63656,60001.3.
12. Respondent, EDISON VILLAGE PROPERTY OWNERS' ASSOCIATION, INC., having
waived its interest, shall receive no compensation or costs for the taking of these Parcels,
13. ORDERED AND ADJUDGED that this Stipulated Final Judgment is to be recorded in
the Official Records of Collier County, Florida.
14. This Order disposes of all claims arising out of the taking of Parcels 109 and 709 and
that have or could have been asserted in this cause.
