EXECUTIVE SUMMARY
Recommendation to terminate the existing Contract #08-5017 for the Annual
Contract for County Wide Exotic Vegetation Removal and award ITB #09-5225 for
the Annual Contract for County Wide Exotic Vegetation Removal.
OBJECTIVE: To obtain approval from the Board of County Commissioners to terminate
the existing contract for exotic vegetation removal services due to failure by vendors to
provide the required licenses, and to award a new contract for those same services.
CONSIDERATIONS: On March 11, 2008, the Board of County Commissioners
approved the award for RFP #08-5017 for the Annual Contract for County Wide Exotic
Vegetation Removal. Four contracts were issued to Resource Restoration, Inc,
Environmental Aquatic, Earth Balance and Aquagenix and signed by the Chairman. In
November 2008, three of the four vendors expressed interest in renewing their contract
including Environmental Aquatic, Earth Balance and Aquagenix. The fourth vendor
Resource Restoration, Inc did not respond to the annual renewal request, and therefore,
the contract was not renewed.
In February 2009, the Purchasing Department became aware that the three vendors did
not meet the County's licensing requirements. The contract was temporarily suspended
in order to give the three vendors the opportunity to submit Collier County contractor's
licenses per the contract requirements. The three vendors did not comply with the
request, and Purchasing Staff recommends that the Board of County Commissioners
terminate all contracts affiliated with contract 08-5017, for cause effective immediately.
The Purchasing Department contacted the Contractor Licensing staff to review and
confirm the licensing requirements for the mechanical and chemical removal of exotic
vegetation in Collier County. Subsequently, the Purchasing Department issued an
Invitation to Bid (ITB) on March 11,2009 containing the appropriate licensing standards.
Notices were sent to 417 vendors; 37 suppliers requested ITS packages. Nine (9)
proposals were submitted by vendors; one (1) proposal was deemed non-responsive.
As directed in the ITB to award to the lowest qualified and responsive vendor(s), the
Purchasing Department recommends the following multiple awards by category:
· Chemical Removal: Aquagenix / Deangelo Brothers and Johnson's Tree Service
· Mechanical Removal: Environmental Restoration Consultants LLC and
Johnson's Tree Service
Each of the recommended awardees meets the licensing requirements specified in the
bid invitation.
The County spends approximately $350,000 annually on these services and will issue
purchase orders associated with the contract

FISCAL IMPACT: Departments have budgeted for exotic vegetation removal services
in FY 2009 budgets; there is no new budget impact.
GROWTH MANAGEMENT IMPACT: There is no Growth Management Impact
associated with this Executive Summary.
LEGAL CONSIDERATIONS: This item is not quasi-judicial, and as such ex parte
disclosure is not required. This item requires majority vote only. This item is legally
sufficient for Board action. - CMG
RECOMMENDATIONS: That the Board of County Commissioners 1.) Terminate the
existing contracts for #08-5017 for the Annual Contract for County Wide Exotic
Vegetation Removal with Environmental Aquatic, Earth Balance and Aquagenix;
Resource Restoration, Inc and 2.) Award the Invitation to Bid (ITB) # 09-5225 for Annual
Contract for County Wide Exotic Vegetation Removal to Aquagenix / Deangelo
Brothers, Johnson's Tree Service, and Environmental Restoration Consultants LLC.
