EXECUTIVE SUMMARY
Recommendation to approve a Resolution of the Collier County Board of County
Commissioners (BCC) authorizing the submission of the Transportation Disadvantaged
Trust Fund Trip/Equipment Grant Application with the Florida Commission for the
Transportation Disadvantaged (CTD).
OBJECTIVE: To approve the attached grant application (Transportation Disadvantaged Trust
Fund Trip/Equipment Grant Acknowledgement Form) and Resolution authorizing the Chairman
of the BCC to sign the application, any assurances, reimbursements invoices, warranties,
certifications and any other documents which may be required in connection with this
application, and to authorize the Chairman to approve any budget amendments to use grant
dollars actually received, including incremental grant dollars received either above or below the
specified target grant award,
CONSIDERATIONS: Recently staff received the attached memo from Bobby Jernigan, the
Interim Executive Director of the Commission for the Transportation Disadvantaged concerning
the FY09/10 Transportation Disadvantaged Trust Fund Trip/Equipment Funding allocations.
The letter indicated that Collier County is eligible to receive $571,781.00 in FY09/1 O.

Collier County must formally apply for these funds in order to receive this funding. As the
Community Transportation Coordinator (CTC) for Collier County, the BCC is eligible to submit
a Transportation Disadvantaged Trust Fund Trip/Equipment Grant application with the
Commission for the Transportation Disadvantaged each year. Funds from this grant cover a
portion of the operating expenses of the Transportation Disadvantaged Program.
FISCAL IMPACT: This reimbursement grant application will provide transportation
disadvantaged grant funding in the amount of $571,781.00. A 10% local grant match of the total
project is required and will be funded through the FYIO budget fund 427, project # 45006.
LEGAL CONSIDERA nONS: This item has been reviewed and approved by the County
Attorney's Office, is not quasi-judicial and requires no ex parte disclosure, requires only a
majority vote for approval, and is otherwise legally sufficient for Board action.-SRT

GROWTH MANAGEMENT IMPACT: Consistent with Objectives 10 and 12 10 the
Transportation Element ofthe Growth Management Plan.
RECOMMENDATION: That the Board authorize the Chairman of the Board of County
Commissioners to sign the grant application, any assurances, reimbursements invoices,
warranties, certifications and any other documents which may be required in connection with this
application.

It should be recognized that the grant award referenced above in the amount of $571,781.00 is a
preliminary number and is subject to change. In approving this item, the BCC is providing
authorization to approve all necessary budget amendments to receive and use these grant dollars
including those incremental grant dollars received above or below the target grant award. By
providing this latitude, the BCC is authorizing its Chairman to recognize by budget amendment
actual grant revenue received currently and as may be adjusted in the future and align expenses
accordingly.

STANDARD ASSURANCES
The recipient hereby assures and certifies that:
(1) The recipient will comply with the federal, state, and local statutes, regulations,
executive orders, and administrative requirements which relate to discrimination
on the basis of race, color, creed, religion, sex, age, and handicap with respect
to employment, service provision, and procurement.
(2) Public and private for-profit, transit and paratransit operators have been or will
be afforded a fair and timely opportunity by the local recipient to participate to
the maximum extent feasible in the planning and provision of the proposed
transportation planning services.
(3) The recipient has the requisite fiscal, managerial, and legal capacity to carry out
the Transportation Disadvantaged Program and to receive and disburse State
funds.
(4) The recipient intends to accomplish all tasks as identified in this grant
application.
(5) Transportation Disadvantaged Trust Funds will not be used to supplant or
replace existing federal, state, or local government funds.
(6) Capital equipment purchased through this grant meets or exceeds the criteria set
forth in the Florida Department of Transportation's Guidelines for Acquiring
Vehicles on file with the em on July 1, 2001 or criteria set forth by any other
federal, state, or local government agency.
(7) Capital equipment or consultant services purchased through this grant comply
with the competitive procurement requirements of Chapter 287 and Chapter 427,
Florida Statutes,
(8) If capital equipment is purchased through this grant, the demand responsive
service offered to individuals with disabilities, including individuals who use
wheelchairs, is equivalent to the level and quality of service offered to individuals
without disabilities. Such service, when viewed in its entirety, is provided in the
most integrated setting feasible and is equivalent with respect to:
(a) response time;
(b) fares;
(c) geographic service area;

(d) hours and days of service;
(e) restrictions on trip purpose;
(f) availability of information and reservation capability; and
(g) contracts on capacity or service availability.
In accordance with 49 CFR Part 37, public entities operating demand responsive
systems for the general public which receive financial assistance under Sections 5310 or
5311 of the Federal Transit Administration (FTA) have filed a certification with the
appropriate state program office before procuring any inaccessible vehicle. Such public
entities not receiving FTA funds have also filed a certification with the appropriate
program office. Such public entities receiving FTA funds under any other section of the
FTA have filed a certification with the appropriate FTA regional office,

grant application is filed.

A RESOLUTION BY THE BOARD OF COUNTY COMMISSIONERS,
COLLIER COUNTY, FLORIDA, APPROVING, AND AUTHORIZING ITS
CHAIRMAN TO EXECUTE AND SUBMIT A TRANSPORTATION
DISADVANTAGED TRUST FUND TRIP/EQUIPMENT GRANT
APPLICATION WITH THE FLORIDA COMMISSION FOR THE
TRANSPORTATION DISADVANTAGED FOR FUNDING IN THE AMOUNT
OF $571,781.00.
WHEREAS, at the May 12, 2009, meeting of the Board of County Commissioners the
Board by majority vote approved an agenda item authorizing its Chairman to execute and submit
a Transportation Disadvantaged Trust Fund Trip/Equipment Grant Application with the Florida
Commission for the Transportation Disadvantaged seeking funding in the amount of
$571,781.00; and
WHEREAS, the Florida Commission for the Transportation Disadvantaged requires the
Board provide a resolution memorializing and confirming the Board's aforementioned
affirmative vote acknowledging its authorization of the Chairman to execute and submit a grant
application for funds.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that;
On May 12, 2009, the Board of County Commissioners authorized its Chairman, by
majority vote, to execute and submit a grant application for funding in the amount of
$571,781.00, any assurances, reimbursements invoices, warranties, certifications and any other
documents which may be required in connection with this application, and to approve all
necessary budget amendments to use any grant dollars received, including incremental grant
