CESM Minutes 04/05/2019 April 5, 2019 1 MINUTES OF THE HEARING OF THE COLLIER COUNTY SPECIAL MAGISTRATE Naples, Florida, April 5, 2019 LET IT BE REMEMBERED the Collier County Special Magistrate, having conducted business herein, met on this date at 9:00 AM in REGULAR SESSION in Administrative Building “F,” 3rd floor, Collier County Government Complex, Naples, Florida, with the following persons present: SPECIAL MAGISTRATE: Honorable Brenda C. CALL TO ORDER-SPECIAL MAGISTRATE BRENDA GARRETSON PRESIDING The Honorable Special Magistrate Brenda C. Garretson called the Hearing to order at 9:00 A.M. All those testifying at the proceeding did so under oath. Prior to conducting the Hearing, Respondents were given an opportunity to speak with their Investigating Officers for a Resolution by Stipulation. The goal is to obtain compliance without being punitive. II. The Stipulation was entered into by the Respondent Joseph Antenor on April 5, 2019. Special Magistrate found the Respondent GUILTY of the alleged violation and ordered them to: 1. Pay Operational Costs in the amount of $112.05 incurred in the prosecution of this case by May 5, 2019. 2. Abate all violations by obtaining all required Collier County Building Permit(s), inspections and Certificate of Completion, or remove the fence by May 5, 2019 or a fine of $100.00 per day will be imposed until the violation has been abated. 3. Notify the Code Enforcement Investigator when the violation has been abated in order to conduct a final inspection to confirm abatement. If the Respondent fails to abate the violation the County may abate the violation and may use the assistance of the Collier County Sheriff’s Office to enforce the provisions of this agreement and all costs of abatement shall be assessed to the property owner. VIOLATIONS: Large amount of litter in and around dumpster 118-64 FOLIO NO: PROPERTY ADDRESS: 50 Wilson Blvd S, Naples, FL Investigator Nichols requested the hearing. The Stipulation was entered into by the Respondent’s representative Gary Carlisle on April 5, 2019. Special Magistrate found the Respondent GUILTY of the alleged violation and ordered them to: 1. Pay Operational Costs in the amount of $50.00 incurred in the prosecution of the case. 2. Pay an Administrative Fee of $5.00 incurred in the prosecution of the case. 3. Pay a Civil Penalty of $500.00. Total Amount Due: $555.00 by May 5, 2019. VI. PUBLIC HEARINGS A. HEARINGS 1. CASE NO: CEEX20190001041-DAS24457 OWNER: Roberto Martinez OFFICER: DAS Officer McQueen H. VIOLATIONS: DAS Abandon Sick Animal, Animal Cruelty 828-12, 14- 37(1)(E) FOLIO NO: PROPERTY ADDRESS: 49 Moon Bay St, Naples, FL : Officer McQueen represented the County. Roberto Martinez was present however had not seen the County’s proposed exhibits. Special Magistrate Garretson requested the parties to convene and discuss the case to be recalled later in the meeting. 4. CASE NO: CEEX20190001897-PR060341 OWNER: Scott A Sackstein OFFICER: Park Ranger Araquistain M. VIOLATIONS: PR Boat Ramp Parking 130-66 FOLIO NO: PROPERTY ADDRESS: Conner Park, 111th Ave N, Naples, FL Ranger Araquistain represented the County. Mr. Sackstein was present and questioned the case as it referenced a boat ramp parking citation and he was not parked at a boat ramp. County Staff noted the alleged violation was misprinted on the Agenda and the Citation references parking in a handicap space without paying the necessary fee. Special Magistrate Garretson allowed the case to proceed. April 5, 2019 5 Mr. Sackstein cited Section 316.1964(1) of the Florida Statute which exempts a person parking in a handicap space from paying a fee (“A state agency, county, municipality, or any agency thereof, may not exact any fee for parking on the public streets or highways or in any metered parking space from the driver of a vehicle that displays: (1) A disabled parking permit or a license plate issued under (a) s. 316.1958 or s. 320.0848”). Ranger Araquistain countered noting Section 316.1964(8) states “Notwithstanding subsection (1), a county, municipality, or any agency thereof may charge for parking in a facility or lot that provides timed parking spaces any vehicle that displays a disabled parking permit, except for a vehicle:   With specialized equipment, such as ramps, lifts, or foot or hand controls, for use by a person who has a disability; (a) Displaying a license plate for disabled veterans issued under (b) s. 320.084, s. 320.0842, or s. 320.0845; or (c) Displaying the Florida Toll Exemption permit.” Special Magistrate Garretson, after hearing the testimony, took the case UNDER ADVISEMENT and notified Mr. Sackstein he would receive the decision in writing via the US mail. 8. CASE NO: CENA20190002133 OWNER: Nian Financing Corp. OFFICER: Boris Molina VIOLATIONS: Collier County Code of Laws, Chapter 54, Article VI, Section 54-179 and Section 54-181 and the Collier County Land Development Code 04-41, as amended, Section 1.04.01(A). Litter throughout the property. FOLIO NO: 41827480008 PROPERTY ADDRESS: 5130 Cherry Wood Dr., Naples, FL. Investigator Molina represented the County. Evidence Entered: Composite Exhibit A: 3 photos dated 2/26/19 He testified the violation is reoccurring but has been abated; however the County is seeking a finding the violation occurred. Bibiana Franco, Property Manager represented Nian Financing Corp. and testified:  That the property is under construction and the dumpsters were outside with unauthorized individuals disposing of refuse on site.  The violation was abated, the dumpsters were removed and they now visit the site twice a week to ensure no further violations occur.  When construction restarts, there will be a person on site on a daily basis. Special Magistrate Garretson, after hearing the testimony and reviewing the evidence found the violation occurred and ordered the Respondent to pay $111.95 in Operational Costs by May 5, 2019. April 5, 2019 6 VIOLATIONS: DAS Abandon Sick Animal, Animal Cruelty 828-12, 14- 37(1)(E) FOLIO NO: PROPERTY ADDRESS: 49 Moon Bay St, Naples, FL Officer Mcqueen represented the County. Evidence Entered: Composite Exhibit A: 3 photos dated 12/18/18 Exhibit B: Veterinarian Report She testified the dog was found running at large and this is the 3rd Notice and requires an appearance before the Magistrate. Roberto Martinez was present and noted that he has recently become the legal owner of the dog as previously he was a minor and the parents were responsible for the dog. He is working to improve the dog’s health and repairing areas where the dog is able to escape out the fence. Dave Quantez, Domestic Animal Services reported the main concern is the health of the dog which has improved. Mr. Martinez noted he is doing his best but does have financial constraints. Special Magistrate Garretson, after reviewing the evidence and hearing the testimony found there was no violation and recommended the Investigators monitor the fence repairs to help ensure the dog does not escape in the future. VIOLATIONS: SO Handicapped Parking 130-67 FOLIO NO: PROPERTY ADDRESS: 12730 Tamiami Trail, Naples, FL Deputy Mironov represented the County and testified that on the day of the incident he was on routine patrol and observed the vehicle parked blocking 2 handicap spaces and accordingly issued the Citation. Evidence Entered: Composite Exhibit A: 2 photos dated 2/6/19 The Respondent was not present but was notified by regular mail on 3/21/19 on the hearing schedule. Finding the Notice of Hearing was properly served, Special Magistrate Garretson UPHELD issuance of the Citation and ordered the Respondent to pay Operational Costs in the amount of $50.00 incurred in the prosecution of the case, an Administrative Fee of $5.00 and a Civil Penalty of $250.00 for a total amount due of $305.00 payable by May 5, 2019. 3.A CASE NO: CEEX20190001556-SO187092 OWNER: Kenneth J Smullen OFFICER: Deputy Mironov J VIOLATIONS: SO Handicapped Parking 130-67 FOLIO NO: April 5, 2019 7 PROPERTY ADDRESS: 12730 Tamiami Trail, Naples, FL Deputy Mironov represented the County and testified that on the day of the incident he was on routine patrol and observed the vehicle parked in a space reserved for handicapped individuals without displaying the proper placard and accordingly issued the Citation. Evidence Entered: Composite Exhibit A: 3 photos dated 12/10/18 The Respondent was not present but was notified by regular mail on 3/21/19 on the hearing schedule. Finding the Notice of Hearing was properly served, Special Magistrate Garretson UPHELD issuance of the Citation and ordered the Respondent to pay Operational Costs in the amount of $50.00 incurred in the prosecution of the case, an Administrative Fee of $5.00 and a Civil Penalty of $250.00 for a total amount due of $305.00 payable before May 5, 2019. 14. CASE NO: CEV20180012357 OWNER: Rene Dorvil and Clomene Dorvil OFFICER: William Marchand VIOLATIONS: Collier County Code of Laws, Article III, Section 130-95. Observed an inoperable vehicle with an expired tag. FOLIO NO: 48600002282 PROPERTY ADDRESS: 12150 Fuller Lane, Naples, FL Investigator Marchand presented the case. Evidence entered: Composite Exhibit A: 2 photos dated 10/3/18 Exhibit B: 1 photo dated 10/25/18 Composite Exhibit C: 2 photos dated 3/21/19 Exhibit D: 1 photo dated 4/1/19 Investigator Marchand testified the vehicle was inoperable in October with a flat tire and as of yesterday there was no registration on the car. Rene and Clomene Dorvil were present and testified they renewed the registration for the vehicle recently and are selling the vehicle. They acknowledged the violation existed. Special Magistrate Garretson, after hearing the testimony and reviewing the evidence found the Respondent GUILTY of the alleged violation and ordered them to: 1. Pay Operational Costs in the amount of $115.85 incurred in the prosecution of this case by May 5, 2019. 2. Obtaining and affixing a current valid license plate to each vehicle not stored within the confines of a completely enclosed structure, or store said vehicles within a completely enclosed structure, and/or repair defects so vehicle is immediately operable or remove offending vehicles from residentially zoned area within by April 15, 2019 or a fine of $50.00 per day will be imposed until the violation is abated. 3. Notify Code Enforcement Investigator when the violation has been abated in order to conduct a final inspection to confirm abatement. If the Respondent fails to abate the violation the County may abate the violation and may use the assistance of the Collier April 5, 2019 8 County Sheriff’s Office to enforce the provisions of this agreement and all costs of abatement shall be assessed to the property owner. Total Amount Due: $115.85 5. CASE NO: CEEX20190002069-PR060340 OWNER: Development Realty LC and Robert B Leslie OFFICER: Park Ranger Araquistain M. VIOLATIONS: PR Handicapped Parking 130-67 FOLIO NO: PROPERTY ADDRESS: Vanderbilt Access, Naples, FL Ranger Araquistain represented the County and testified that on the day of the incident he was on routine patrol and observed the vehicle blocking a handicap parking space and accordingly issued the Citation. Evidence Entered: Composite Exhibit A: 2 photos dated 2/2/19 The Respondent was not present but was notified by regular mail on 3/21/19 on the hearing schedule. Finding the Notice of Hearing was properly served, Special Magistrate Garretson UPHELD issuance of the Citation and ordered the Respondent to pay Operational Costs in the amount of $50.00 incurred in the prosecution of the case, an Administrative Fee of $5.00 and a Civil Penalty of $250.00 for a total amount due of $305.00 payable before May 5, 2019. Prohibited exotic vegetation consisting of but not limited to, Brazilian Pepper, Earleaf Acacia, Air Potato, and World Climbing Fern, etc. FOLIO NO: 00447360002 PROPERTY ADDRESS: 12100 Tamiami Trail, Naples, FL Ryan White, Davidson Engineering represented the Respondent however Special Magistrate Garretson notified him he did not have proper standing in the case as the affidavit provided by the Respondent addressed processing of permits on behalf of the landowner, not representation in a code enforcement case. Manager Letourneau withdrew the case. 5. CASE NO: CENA20180008199 OWNER: KGB PROPERTIES LLC OFFICER: Jonathan Musse April 5, 2019 9 VIOLATIONS: Collier County Code of Laws and Ordinances, Chapter 54, Article VI, Sections 54-179 and 54-181. FOLIO NO: 62266000002 PROPERTY ADDRESS: 5402 Texas Ave, Naples, FL Supervisor Mucha represented the County and reported that the violation had been abated but not in the prescribed time frame. Kevin Benito of KGB Properties, LLC testified contractor issues led to a delay in abating the violation. Special Magistrate Garretson, after hearing the testimony DENIED the County’s Motion. 6. FOLIO NO: 62266040004 PROPERTY ADDRESS: 5406 Texas Ave, Naples, FL Supervisor Mucha represented the County and reported that the violation had been abated but not in the prescribed time frame. Outside storage of building materials, tools and other related debris. FOLIO NO: 00769360007 PROPERTY ADDRESS: 950 Auto Ranch Rd, Naples, FL. Supervisor Mucha represented the County and reported that the violation had been abated but not in the prescribed time frame. Iris Laupert, owner of the property she acquired title to the property and abated the violation. Special Magistrate Garretson, after hearing the testimony DENIED the County’s Motion. 9. CASE NO: CENA20180010796 OWNER: Ruth Carvajal OFFICER: Jonathan Musse VIOLATIONS: Collier County Code of Laws and Ordinances, Chapter 54, Article VI, Section 54-179 and Section 54-185(a) and Collier County Land Development Code, 04- April 5, 2019 10 41, as amended, Section 2.02.03. Weeds that exceed eighteen inches and the illegal outside storage consisting of but not limited to wood, pile of pavers, etc. FOLIO NO: 62150560506 PROPERTY ADDRESS: 5237 Warren St, Naples, Fl Supervisor Mucha represented the County and reported that the violation had been abated. Martha Carvajal was present and noted the violation was abated. Special Magistrate Garretson, after hearing the testimony DENIED the County’s Motion. 10. CASE NO: CENA20180006121 OWNER: Malcolm Smith OFFICER: Daniel Hamilton VIOLATIONS: Collier County Code of Laws and Ordinances, Chapter 54, Article VI, Section 54-181 and Collier County Land Development Code, 04-41, as amended, Sections 1.04.01(A) and 2.02.03. Litter and outside storage of materials consisting of but not limited to appliances, chairs, windows, cardboard, buckets, barrels, tires, plastic tarps, plastic jugs, hose, auto parts, bicycle parts, lawn mowers on various states and various metal pieces. FOLIO NO: 01134803509 PROPERTY ADDRESS: 215 Old Train Ln, Copeland, FL Debra Smith, landowner was present. Supervisor Mucha reported the violation is 90 percent abated. Special Magistrate Garretson CONTINUED the case until the next hearing date. VIII. PUBLIC HEARINGS (Continued) A. HEARINGS 1. CASE NO: CELU20180000322 OWNER: Paul Craig OFFICER: John Johnson VIOLATIONS: Collier County Code of Laws and Ordinances, Chapter 54, Article VI, Sections 54-181 and 54-179 and Collier County Land Development Code 04-41, as amended, Section 2.02.03.a. Various debris and materials located throughout the property. FOLIO NO: 48171160006 PROPERTY ADDRESS: 2754 Shoreview Dr, Naples, Fl This case was recalled after the County and Respondent had an opportunity to discuss the case. Manager Letourneau reported that the violation remains as there is still debris on the property. Mr. Craig reported that he was unsure what items needed to be removed from the site and believes the violation may be abated. Special Magistrate Garretson, after hearing the testimony CONTINUED the case until the next hearing date so the County could develop a list of items to be removed so the matter is clarified between the parties. Obtain all required Collier County Building Permit(s) or demolition permit, inspections, and Certificate of Completion/Occupancy by May 5, 2019 for the repair of the roof/soffit damage and secure the open windows or a fine of $250.00 per day will be imposed until the violation is abated. 3. Alternatively, if a boarding certificate is obtained and the structure is boarded within April 12, 2019, then the time required to complete the repairs, inspections, and Certificate of Completion/Occupancy will be extended to and must be completed within October 5, 2019 a fine of $250.00 per day will be imposed until the violation is abated. 4. Notify Code Enforcement Investigator when the violation has been abated in order to conduct a final inspection to confirm abatement. If the Respondent fails to abate the violation the County may abate the violation and may use the assistance of the Collier County Sheriff’s Office to enforce the provisions of this agreement and all costs of abatement shall be assessed to the property owner.
