EXECUTIVE SUMMARY
This item requires that ex parte disclosure be provided by Commission members. Should a hearing
be held on this item, all participants are required to be sworn in. Recommendation to approve
Petition VAC-PL20180003348, to disclaim, renounce and vacate the County and the public interest
in a portion of the 25-foot Drainage and Lake Maintenance Easement located in the rear of Lot 15
of the Quarry Phase 1A, as recorded in Plat Book 42, page 31 of the Public Records of Collier
County, Florida, located approximately one mile east of Collier Boulevard in Section 23, Township
48 South, Range 26 East, Collier County, Florida.
OBJECTIVE: To adopt a Resolution to vacate the County and the public interest in a portion of the 25-
foot Drainage and Lake Maintenance Easement located in the rear of Lot 15 of the Quarry Phase 1A, as
recorded in Plat Book 42, page 31 of the Public Records of Collier County, Florida, located in Section 23,
Township 48 South, Range 26 East, Collier County, Florida, being more specifically shown in Exhibit A.
CONSIDERATIONS: Petition VAC-PL20180003348 has been received by the Development Review
Division, Growth Management Department from Robert and Regina Black, owners of the subject
property, to vacate a portion of the 25-foot Drainage and Lake Maintenance Easement located in the rear
of Lot 15 of the Quarry Phase 1A, as recorded in Plat Book 42, page 31 of the Public Records of Collier
County, Florida, located in Section 23, Township 48 South, Range 26 East, Collier County, Florida.
According to the Property Appraiser, Regina and Robert Black are the fee simple owners of the subject
Lot. The applicant is proposing to vacate an approximately 6-foot x 75-foot portion of the 25-foot
Drainage and Lake Maintenance Easement located in the rear yard of Lot 15, Quarry Phase 1A plat, in
order to allow an existing pool cage/screen structure to encroach into the drainage easement.
The pool and spa were cracking due to faulty construction, and the screen enclosure was destroyed by
Hurricane Irma. In the planning of the reconstruction of the pool and screen cage, it resulted in extending
the screen cage approximately 6-foot into said 25-foot Drainage and Lake Maintenance Easement.
The Stormwater Management Program staff has no objection to the proposed vacation of a 6-foot portion
of this 25-foot HOA maintained easement as there are no pipes located within this area. The easement
runs along the rear yard of all single-family lots located on Hideaway Harbor Court. The Drainage and
Lake Maintenance Easement is an internal part of the developments stormwater management system that
was conveyed to the County without maintenance responsibilities on January 26, 2005, by Centex Homes,
a Nevada General Partnership. The purpose of the drainage easement was to allow the installation and
maintenance of a swale and piping system to internally collect and convey stormwater runoff. The
vacation will not have an adverse impact on the internal performance of the developments stormwater
management system or any portion of the County’s external stormwater management systems.
A letter of no objection was received from the Quarry Community Association, Collier County
Stormwater Department, one abutting property owner, and a certified mail receipt from one abutting
property owner who elected not to respond.
The Development Review Division has reviewed this petition and found no reason for objection.
FISCAL IMPACT: Growth Management Department, Development Review Division staff, has
collected a $2,000 “Petition to Vacate” fee from the petitioner which covers the County’s cost of
recording and processing the Petition.

recorded in Plat Book 42, page 31 of the Public Records of Collier County, Florida, located in Section 23,
Township 48 South, Range 26 East, Collier County, Florida, being more specifically shown in Exhibit A.
Direct the Clerk to the Board to record a certified copy of the Resolution in the Public Records and to
make proper notation of this Resolution on the plat of the Quarry Phase 1A, as recorded in Plat Book 42,
Page 31, of the Public Records of Collier County, Florida.

Dear Mr. Blake,
The comments in this e-mail are consistent with comments placed into the County Cityview permit tracking program
under your vacate application (PL20180003348). The Stormwater Program has no ob.jections to the proposed 6-foot
easement vacation. I have reviewed the ERP permit, site development plans and visited the site. The expansion of the
pool cage six feet into the easement will have an unquanliflable impact in relationship to the total ERP site criteria. Please
let me know if you need any additional assistance or clarification.
