EXECUTIVE SUMMARY
Recommendation that the Board or County Commissioners, acting as the Community
Redevelopment Agency Board, approve a Second Lease Modification for the Bayshore
Gateway Triangle CRA office with 3750 Bayshore Drive, LLC and authorize the Chairman
to sign.
OBJECTIVE: To secure an extension of short-term office space for the Bayshore Gateway
Triangle CRA (BGTCRA) until the CRA can be moved onto Government Center campus.
CONSIDERATIONS: The Bayshore Gateway Triangle CRA office has been located at 3570
Bayshore Drive since June 2013. The lease expired on July 31, 2018. The CRAB approved a
lease modification to extend the terms of the lease to April 30, 2019. Since its expiration, the
CRA has been occupying the space on a month to month basis.
On March 12, 2019 the CRAB terminated the lease to relocate Bayshore Gateway Triangle CRA
office to 2348 Pineland Avenue, Naples, Florida, and directed staff to move the BGTCRA onto
Government Center campus at the April 23, 2019 BCC meeting. In the meantime, the Landlord
at the current location has requested that another modification be approved by the CRA.
The proposed second lease modification includes a three-month term beginning June 1, 2019 and
continues through July 31, 2019, subject to an option to extend for an additional three months, in
increments of one month at a time through October 31, 2019. The rental rate has been increased
by 3% and continues throughout the Term of the Lease at $16.00 per square foot for an agreed
space of 1,750 square feet, for a monthly total of $2,403.33 per month.
Similar to the first modification, should the CRA elect to exercise the one-month options it must
give Landlord 30 days advance written notice and may not be in default of the Lease. However,
the Second Modification requires the CRA to pay double rent for any holdover period the CRA
occupies the space past July 31, 2019. To avoid paying double rent the CRA will move onto
Government Center campus prior to the expiration of this extension.
LEGAL CONSIDERATIONS: This item is approved for form and legality and requires a
majority vote for Board action. -JAB
FISCAL IMPACT: The FY19 Bayshore Gateway Triangle CRA Fund (187) budget provides
sufficient funding to support the proposed lease expense.
GROWTH MANAGEMENT IMPACT: The lease allows the CRA staff to continue its’
programs and projects within the budgetary and policy guidance and directives of the CRA
Board.
RECOMMENDATION: That the Board or County Commissioners, acting as the Community
Redevelopment Agency Board, approve a Second Lease Modification for the Bayshore Gateway
Triangle CRA office with 3750 Bayshore Drive, LLC and authorize the Chairman to sign.
