EXECUTIVE SUMMARY
Recommendation to approve Change Order Number Two (2) to Agreement No. 18-7276
“Immokalee Road (Collier Boulevard to Wilson Boulevard) Landscape and Irrigation Installation”
(Project No. 60208.1) adding 120 days, and approving a $1,643.70 project increase.
OBJECTIVE: To complete the landscape and irrigation installation project for Agreement No. 18 -7276
with Hannula Landscaping & Irrigation, Inc., by adding 120 days to the final completion date, and
approving changes resulting in a $1,643.70 increase to the project.
CONSIDERATIONS: On April 24, 2018, the Board of County Commissioners (Board) awarded
Agreement No. 18-7276 “Immokalee Road (Collier Boulevard to Wilson Boulevard) Landscape and
Irrigation Installation” to Hannula Landscaping & Irrigation, Inc. for $1,512,274.87 (Agenda Item 11.E).
On May 31, 2018, staff issued a Notice to Proceed and Purchase Order No. 4500187133 to Hannula
Landscaping & Irrigation, Inc. with services commencing on June 15, 2018, and a final completion date
of January 11, 2019, for a total of 210 days.
On June 20, 2018, staff issued a Suspension of Work suspending services the same day for design -related
issues. At that time, there were 205 days remaining on the contract. On September 4, 2019, Staff is sued
a Start Work Notice and services resumed on September 5, 2018, with a corresponding adjusted final
completion date of March 29, 2019. On March 26, 2019, the Board approved Change Order One
(Agenda Item 16.E.1.b), providing for the reduction of plant materials and to add 41 days to the contract
time; further revising the final completion date to May 9, 2019. Change Order No. 1 decreased the
contract amount by $65,552.20. On April 30, 2019, Staff issued another Suspension of Work as
authorized in Section 19.2 of Agreement No. 18-7276. That suspension became effective on May 6,
2019, and became necessary due to design-related delays involving Florida Power & Light (“FPL”) at the
project site. Like the original issued Suspension of Work, this suspension “freezes” the expiration of the
contract time until Staff issues a Start Work Notice to resume work on the Project.
There are multiple issues included in Change Order No. 2. First, FPL advised staff that the design
locations for the wells and pumps may cause potential issues with overhead power lines. As a result, the
County agreed to request a design change relocating the pumps and wells into the median. Therefore,
additional time is needed for FPL to redesign the power needed for the pump stations and to install the
transformers and electrical components. Other issues include plant material unavailability and time
delays. The contractor is unable to purchase the full quantity of Yellow Necklace Pod due to shortages at
nurseries throughout Florida. The project manager and landscape architect decided to substitute that plant
with other readily available plant materials further reducing the contract amount by $3,369.00. Change
Order No. 2, however, also includes one additional directional bore increasing the contract amount by
$5,012.70. The existing bore that was intended for use in the plans set is broken under the pavement. As
a result, this Change Order includes a net increase to the contract by $1,643.70.
Staff requests that the Board approve Change Order No. 2 two, adding 120 days to the contract time,
acknowledging Staff’s issuance of its Start Work Notice, which is currently suspended, to the contractor
effective May 15, 2019, and approving the contract amount by an additional $1,643.70. This change order
requires individual Board approval because the number of days exceeds 20 percent.
FISCAL IMPACT: The change order will increase the contract by $1,643.70. Funds are available
within the Landscaping Projects Fund (112), Project # 60208.
LEGAL CONSIDERATIONS: This item is approved as to form and legality and requires majority vote

this action.
RECOMMENDATION: To approve Change Order No. 2 to Agreement No. 18-7276 “Immokalee Road

adding 120 days to the contract time, approve a contract increase of $1,643.70, acknowledge Staff’s
issuance of its Start Work Notice to the contractor effective May 15, 2019, and authorizing the Chairman
to sign the attached Change Order.
