BROCK, CLBRX 10J of ...~.., m PHI 19,50 coms 4,00 RESOLUTION NO. 2004--1.1.3 A RESOLUTION OF THE COLLIER COUNTY BOARD OF COUNTY COMMISSIONERS FOR PETITION A VESMT2003-AR5088 TO DISCLAIM, RENOUNCE AND VACATE THE COUNTY'S AND THE PUBLIC'S INTEREST IN A PORTION OF THE UTILITY EASEMENT CONVEYED TO COLLIER COUNTY BY SEPARATE INSTRUMENT AND RECORDED IN OFFICIAL RECORD BOOK 637, PAGE 857, AND IN ALL OF THE DRAINAGE EASEMENT CONVEYED TO COLLIER COUNTY BY SEPARATE INSTRUMENT AND RECORDED IN OFFICIAL RECORD BOOK 2248, PAGES 1057 THROUGH 1058, PUBLIC RECORDS OF COLLIER COUNTY, FLORIDA. LOCATED IN SECTION 23, TOWNSHIP 48 SOUTH, RANGE 25 EAST. WHEREAS, pursuant to Section 125.01(t), Florida Statutes, Michael Delate, P.E., from Q. Grady Minor & Associates, P.A., as agent for the petitioner, Horse Creek Partners, Ltd., does hereby request the vacation of a portion of the Utility Easement conveyed to CoIlier County by separate instrument and recorded in Official Record Book 637, Page 857, and all of the Drainage Easement conveyed to CoIlier County by separate instrument and recorded in Official Record Book 2248, Pages 1057 through 1058, Public Records of Collier County, Florida; and WHEREAS, the Board has this day held a public hearing to consider vacating a portion of the Utility Easement conveyed to Collier County by separate instrument and recorded in Official Record Book 637, Page 857, and all of the Drainage Easement conveyed to Collier County by separate instrument and recorded in Official Record Book 2248, Pages 1057 through 1058, Public Records of Collier County, Florida; and WHEREAS, the granting of the vacation will not adversely affect the ownership or right of convenient access of other property owners. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that the County's interests in the foIlowing described portion of the Utility Easement and in the following described Drainage Easement be and are disclaimed, renounced and hereby vacated, and this action is declared to be in the Public's interest and will provide a public benefit: See Exhibit "A" attached hereto and incorporated herein.
