EXECUTIVE SUMMARY
Recommendation to approve a Stipulated Final Judgment in the amount of $154,900 for
Parcels 110 & 710 in the lawsuit styled Collier County v. Regions Bank, et aL, Case No. 07-
3641-CA (Collier Boulevard Project #(,0001). (Fiscal Impact $ .00.)
OBJECTIVE: That the Board of County Commissioners approve a Stipulated Final Judgment for
payment of full compensation, for the taking of Parcels] 10 and 710 in the lawsuit styled Collier
County v, Regions Bank. el. aI.., Case No. 07-364I-CA (Collier Boulevard Project #60001),
CONSIDERATIONS: Collier County condemned a 6,360 square foot parcel for road right-of-way
and a temporary construction easement (Parcels ]] 0 and 710) from property owners Brittney
Village, LLC. The County"s appraisal dated January 4, 2008, yalued the taking at $154,900, The
County offered the owner $] 54,900 as the County's statutory offer on August 26, 2007 based on the
initial appraisal. An Order of Taking hearing was held on February 7, 2008, and the County
deposited the sum of$154,900 in the Court Registry.
The attached Stipulated Final Judgment and Joint Motion for Stipulated Final Judgment reflect
compensation for the amount placed in the Court Registry. There are no attorney's fees, expert fees
and costs sought by Owner's counsel. Staff recommends settlement for the original offer amount of
$154,900. See attached Stipulated Final Judgment.

STIPULATED FINAL JUDGMENT
THIS CAUSE, having come before the Court upon Joint Motion made by Petitioner,
COLLIER COUNTY, FLORIDA, and Respondent, BRITTANY INVESTMENTS, LLC, by and
through their undersigned counsel, for entry of a Stipulated Final Judgment as to Parcels 110 and
710, the Court finding that the compensation to be paid by Petitioner, COLLIER COUNTY,
FLORIDA, is the full compensation due Respondent, BRITT ANY INVESTMENTS, LLC, and
the Court being otherwise fully advised in the premises thereof, it is thereupon
ORDERED AND ADJUDGED that:
I. Respondent, BRITTANY INVESTMENTS, LLC, reCelye from Petitioner,
COLLIER COUNTY, FLORIDA, the sum of One Hundred Fifty-Four Thousand Nine Hundred
and No/lOO Dollars ($154,900,00), as full payment for the property interests taken and for
damages resulting to the remainder, if less than the entire property was taken, business damages,
all attorney's fees and costs, and for all other damages in connection with said parcels,
2. Petitioner will be entitled to a credit for the good faith estimate of value
previously deposited in the amount of $154,900,00.

3, Within thirty (30) days of receipt of this order, without further order of this Court,
the Clerk shall pay the amount of One Hundred Fifty-Four Thousand Nine Hundred and Noll 00
Dollars ($154,900.00) to BRITTANY INVESTMENTS, LLC, c/o Michael T. Traficante, Grant,
Fridkin, Pearson, Athan & Crown, P.A., 5551 Ridgewood Drive, Suite 501, Naples, Florida
34108-2719.
4. No other costs shall be awarded to Respondent, Brittany Investments, LLC in this
proceeding.
5. Title to Parcel 110 and 710, in Fee Simple and as a Temporary Construction
Easement, respectively, being fully described in Exhibit "A" attached hereto and incorporated
herein, which vested in Petitioner, COLLIER COUNTY, FLORIDA, pursuant to the Order of
Taking dated February 7, 2008, and the deposit of money heretofore made, is approved, ratified,
and confirmed.
6, The Notice of Lis Pendens filed in the above-styled cause and recorded in Official
Record Book 4291, Page 2206 of the Public Rccords of Collier County, Florida, is dismissed as
to Parcel 110 and 710,
7. That pursuant to Section 74.051(5), F.S., the Clerk of Courts shall disburse the
interest earned on the funds on deposit in the amount of $_, plus any additional accrued
interest for parcels 110 and 710, to the Board of County Commissioners, account number: 336-
163656-60001.3.
8. This Stipulated Final Judgment is to be recorded in the Official Records of Collier
County, Florida,
9, Respondent, EDISON VILLAGE PROPERTY OWNERS' ASSOCIATION,
INC., having waived its interest, shall receive no compensation or costs for the taking of these
parcels,
