EXECUTIVE SUMMARY
Recommendation to authorize acceptance of the conveyance of a Sovereignty
Submerged lands Easement from the Board of Trustees of the Internal
Improvement Trust Fund of the State of Florida at a total cost not to exceed
$129.00, Project No. 800711.
OBJECTIVE: To obtain approval from the Board of County Commissioners (Board) for the
execution and acceptance of a Sovereignty Submerged Lands Easement (Easement) from the
Board of Trustees of the Internal Improvement Trust Fund of the State of Florida (TIfTF) at the
Collier Boulevard Boating Park facility in order to comply with Florida Department of
Environmental Protection (FDEP) permit application No.: 11-0197753-003.
CONSIDERATIONS: The County would like to expand its existing boat ramp facility at the
Collier Boulevard Boating Park from 19 trailer spaces to 88 trailer spaces. As part of the
permitting process for this expansion, an Easement is required by FDEP for the construction of
the proposed concrete grade level parking area expansion; the proposed stone rip rap and
mitagative planlings which will be located in areas under the jurisdiction of FDEP.
The policies of TIITF and DFEP require that the Grantee (Board) approve, execute and accept
the attached Easement prior to execution by Grantor (TIITF). TIfTF and FDEP have approved
the Easement in principle.
The Easement will remain in effect for a period of ten years, at which time the County may apply
for renewal.
FISCAL IMPACT: The associated costs to the County for this Easement shall not exceed
$129.00 for recording fees.
GROWTH MANAGEMENT IMPACT: This project meets current Growth Management Plan
standards to ensure the adequacy and availability of viable public facilities.
LEGAL CONSIDERATIONS: The Sovereignty Submerged Lands Easement has been
approved for form and legal sufficiency. This item is not quasi-judicial, and as such, no ex-parte
disclosure is required. This item requires majority vote only. Please note that in the rare
instance that litigation arises between TIITF, FDEP and the County over this Easement, the
venue would be in Leon County. The County Attorney's Office typically does not agree to venue
being outside of Collier County. However, since it is required for us to obtain the permit for the
Collier Boulevard Boating Park Expansion Project, we are making an exception - JBW.
RECOMMENDATION: That the Board of County Commissioners approves, accepts and
authorizes its Chairman to execute the attached Sovereignty Submerged Lands Easement with
the Board of Trustees of the Internal Improvement Trust Fund of the State of Florida and directs
the County Manager or his designee to proceed to follow all appropriate closing procedures,
and to record the Easement in the Public Record when executed by TifFT and approved by the
County Attorney's Office.

2. RlGHTS GRANTED: The rights hereby granted shull be subjcct 10 allY and all prior rights of the Unned Stites

3. DAMAGE TO EASEMENT PROPERTY AND INTERFERENCE WITH PUBLIC AND PRIV ^ TE RIGHTS:
Grantee shall not damage (he easement lands or unduly interfere with publie or priVate rights therein.
4, GRANTOR'S RIGHT TO GRANT COMPATlBLE USES OF THE EASEMENT PROPERTY: ThiJ easement is
nonexclusive, and the Grantor, or its duly authorized agent, shall retoin the right to enter the property or to enge:ge in
management e:ctivitics not inconsistent with the use herein provided for and shall retain the right to grant compatible! uses of

and operations of me Grantee in any matter pertaining to this easement.
6. INDEMNIFICATIONfINVP.STIGATION OF ALL CLAIMS: The Grantee shall investigate all claims of every
nature at Its expense. Each party is responsible for all per!K)nal injury and propll'rty damage attributable to the negligent acts or
omissions ofthat party and the offi~ l:mpktyees and agents thereof. Nothing herein sball be construed liS an indemnity or a
waiver ofsoven'Jign immunity enjoyed by any party hcre10, as provided in Stction 768.28, Florida Statutes, as amended from
time to time, or any other law providing limitations on claims.
7. ~: Grantee waives venUClIlS to Bny litigation arising from matters relating to tbis ell3ement and any such
litigation between Grantor and Grantee shall be initiated and maintained only in Leon County. Florida.

9. TERMlNATION: The Grantee, by acceptance of this casement., binds itself, its successors and assigns. to abide
by the provisions and conditions herein set forth, and said provisions and conditions shall be deemed covenants of the Gl1IDlee,
its successors and assigns. In the event tMc Gl1lntee fails or refuses to comply with the provisions and conditions herein set
forth or in the event the GrBIttee violates any oftbe provisions and conditions tlerein. this casement may be terminated by the
Grantor upon 30 days YrTitten notice to Grantee. If terminated, all of the above--described parcel orland shall revert to the
Grantor, All costs, including attorneys' fees, incurred by the Grantor to enforce the provisions aflhis ea5Cment shall be paid
by the Grantee. All notices required 10 be given to Gnmtee by this casement or applicable law or adminisb'lItive rules shall be

The Grantee agrees to notifY the Grantor by certified mail of any changes to this addres.s at least len (10) days before the
change is effective.
10. T AXI1S AND ASSESSMENTS: The Grantee shall assume all responsibility for liabilities that accrue to the
subject property or to lhe improvements thereon. including any and all drainage or special auessments or tl1xes of every kind
and description which are now or may be hereafter lawfully assessed and levied against the subject property during the
effective period of this easemenl which result from the grant ofmis easement or the attivities of Grantee hereunder.
J I. R..P.NEWAL PROVISIONS: Renewal oftbis easement i~ at the sole option of the Grantor. Such renewal shall be
subject to the terms, conditions and provisions or this easement, current management .lo~ndards, CWlement fees, and applicable
laws, rules and regulations in effoct at that time. In tbe event that Grantee is in full compliance with the terms of this
casement, the Grantee may apply in writing for a renewal. Such application for renewal must be received by Grantor DO litter
tban six months prior to the expiration date afthis easement. The term of any renewe.l gnmted by the Grantor shall commence
on the last day of the previous casement term. Ifthe Grantee fails to apply for II renewal, Of in the eVl!lnt the Grantor does not
grant a renewal, the Grantee shall vacate the easement premises IlDd remove all structures. and equipmenl occupying and
erected thereon at its expense.
12. REMOVAL OF STRUCTURES/ADMINISTRATIVE FINES: If the Grantee does not remove said s.tructures
and equipment occupying and erected upon tne premises after expiration or cancellation oflhis easement, such structures and
equipment will be deemed forfeited to the Grantor, BJld the Grantor may authorize removal and may sell such forfeited
structures and equipment after ten (10) days written notice by certiflod mail addressed to the Grantee at the address specified in
Item 10 or at such address on record as provided 10 the Grantor by the Grantc:e. However, such remedy shall be in addition to
all other remedies availab]e to Grantor under applicable laws, rules and regulations including the right [0 compel removal or all
structures and the right to impose administrativll fines.
13. ENFORCEMENT OF PROVISIONS: No failw-e, or successive failures, on !he part orthe Grantor to enforce any
provision, nor any waiver or successive waivm OD its plll't or any provision h~in, shall operate as a discharge thereofor
render the samCl inoperative or impair the right oflbe Granlor to enforce the same upon any renewal thereof or in the event of
subsequent breach or breaches.
]4. RECORDA nON OF EASh'MENT: The Grantee, at its own expense, shall record this fully executed easement
in irsentirety in the public records of the county within which the easement site is located within fourteen (14) day.'$ after
receipt, and shall provide to the Grantor within ten (10) days following the recordation a copy of the recorded easement in its
entirety which contains the O.R. Book and pages at which the ea..l:cmem is recorded.
15. AMENDMENTSfMODIFICA TIONS: This easement is lIle entire and only agreement between the parties. Its
provisions are not severable. Any amr:ndment or modjfication to this easement must be in writing and must be accepted,
acknowledged and executed by the Grantee and Grantor.
16. ACOE AUTHORIZATiON: Prior to commencement of construction and/or activities authorized herein, the
Grantee shall ob~in the U.S. Anny Corps ofEnginec:rs (COE) pennit ifit is required by the COE. Any modifu::ations to the
constrUction and/or activities authori1.ed herein that may be required by the COE shall requirc consideration by and the prior
written ilpproval of the Grantor prior to the commencement of construction and/or any activities on sovereign, submerged
lands.
17. ADDlTIONAL STRUCTIJRES OR ACTlVITJESlEMERGENCY STRUCTURAL REPAIRS: No additional
structures shall be erected andlor activities undert:aken, including but not limited to, dredging, relocation/realignment or major
repairs or renuvations made to authorized structures, on. in or over sovereignty, 5ubmoerged lands without the prior wrinen
consent of the Orftntor, with the exception of emergency repairs. Unless specifically authorized in writing by the Grantor, such
activities or structures shall be considered unauthorized and II violation of Chapter 253, Florida S~tutes, and shall subject the
Grantee to administrative fmes under Chapter lB~14, Florida Administrative Code. (femergency repairs are required to be
undertaken in the intereirts of public health, safety or welfare, the Grantee shall notify the Gnmtor of such repairs as quick.ly as
is practicable; provided, however, that suth emergency activities shall oot exceed the actiVities authorized by this easement.
