EXECUTIVE SUMMARY
Recommendation for the Board of County Commissioners to approve expenditures for
capital improvements to henefit the Naples Production Park and Pine Ridge Industrial
Park Municipal Service Taxing Units (MSTUs).
OBJECTIVE: To approve a prioritized list of capital improvements to benefit the Naples
Production Park and Pine Ridge Industrial Park MSTUs and authorize staff to make any
necessary budget amendments to fund those projects and reimburse the county for expenses
associated with advertising, project management and Construction, Engineering and Inspection
(CEI).
CONSIDERATIONS: The two industrial park MSTUs were created in the early 1980s to fund
capital improvements that benefit the park owners. The access points, roadways and drainage
systems do not meet county standards and were not designed to manage their needs at build out.
Many of the intersections do not have adequate capacity and geometry to facilitate safe and
efficient travel. The roadway open drainage systems have been compromised by incoherent
culvert crossings, fill material and multiple driveways. The roadway pavement is failing in
multiple locations and lacks adequate shoulders along the roadway and at intersections.
The Naples Production Park MSTU was created through Ordinance No. 85-39. The proposed
improvements and MSTU boundary is attached and S~10wn on Exhibit A. There is $2,776,860 in
funds available in FY 2009 and an additional $1,070,235 will be available within the next three
years. A summary sheet of available funds, individual project cost estimates and option details in
a priority order are attached as Exhibit B. The Naples Production Park improvements are
recommended to begin with an intersection improvement at Progress Avenue at Livingston Road
and then continue with roadway, drainage and intersection improvements within the MSTU
boundary. The intersection improvements are necessary in conjunction with the construction of
an additional turn lane within the MSTU, which will facilitate ingress and egress from the MSTU
industrial park.
The Pine Ridge Industrial Park MSTU was created through Ordinance No. 81-94. The proposed
improvements and MSTU boundary is attached and shown on Exhibit C. There is $3,393,940 in
funds available in FY 2009 and an additional $1,308,065 will be available within the next three
years. A summary sheet of available funds, individual project cost estimates and option details in
a priority order are attached as Exhibit D. The Pine Ridge Industrial Park improvements are
recommended to begin with an intersection improvement at J&C Boulevard at Airport Road and
then continue with roadway, drainage and intersection improvements within the MSTU
boundary. The intersection improvements are necessary in conjunction with the construction of
an additional turn lane within the MSTU, which will facilitate ingress and egress from the MSTU
industrial park.
County staff held a public meeting to review the various options at Barron Collier high school on
February 25, 2009. The 905 property owners were sent individual notices informing them of the
meeting and only 19 people, representing 2% of the owners, attended the public meeting. No
specific consensus was achieved at the public meeting.

The improvements identified in Exhibits Band 0 consists of access, roadway and drainage
improvements that would provide a special benefit to the owners within those industrial parks.
Staff is recommending proceeding with the priorities as outlined in the above exhibits subject to
available funding within the individual MSTUs. Staff is also recommending that the projects are
managed by the Transportation Engineering Construction Management (TECM) Department.
CEI and project management usually represents 10-15% of project costs. Staff is recommending
that no more than 5% of each project cost be allocated to the TECM department for these
services so more funding can be allocated to physical improvements.
FISCAL IMP ACT: A budget amendment will be needed to transfer funds in the amounts of
$3,393,940 and $2,776,860 and future revenues into newly created project numbers specifically
earmarked for each MSTU's capital improvements. No general fund or gas tax funds will be
expended.
LEGAL CONSIDERATIONS: This item has been reviewed and approved by the County
Attorney's Office, is not quasi-judicial and requires no ex parte disclosure, requires only a
majority vote for approval, and is otherwise legally sufficient for Board action.-SRT
GROWTH MANAGEMENT IMPACT: There is no Growth Management impact associated
with this Executive Summary.
RECOMMENDATION: That the Board of County Commissioners approves the prioritized
lists of capital improvements within the Naples Production Park and Pine Ridge Industrial Park
MSTUs shown in Exhibits B & D and authorize staff to make any necessary budget amendments
to fund the projects, complete construction and reimburse the county for expenses associated
with advertising, project management and Construction, Engineering and Inspection (CEI) with
an amount not to exceed 5% of each individual project.

Oc it ordained by the Board of County Commissioners of
Collier County, Florida:
SECTION 1.
There is hereby created the Naples Production Pa~k Municipal
Service Taxing and Benefit Unit. The Unit shall include all lands
within the following boundaries set forth in Exhibit "A- attached
hereto and made a part hereof.
SECTION 2.
The Udit hereby created is for the pl..rpose of exercising
those powers authorized by Chapt~r 125, Fl~rida Statutes, and
other applicable law.
SECTION 3.
The Boarj of County Commissioners ot Collier County ahall be
the governing board of th~ Unit, with power and authority to
conduct the aff~irs of the Unit as pr~8cribed by Florida Statutes.
SECTION 4.
The Unit may levy ad valorem taxes on real property within
the Unit as authorized by Florida Statutes.
SECTION 5.
As used in this ordinance, the following word~ and terms
shall have the followin~ meanings, unless some other meaning i8

(1) 'Unit" shall mean the Naples Production Park Municipal
Service Taxing and Benefit Unit created by this ordinance.
(2) RBoard- ahall mean the Board of County Commissioners of
Collier County, Florida.
(3) 'Cost" ss applied to the acqu1ai tion and construction of
any improvemento authorized by the Board shall include the cost of
construction or reconstruction, acquisition or purchase, the coat
of all labor, materials, machinery and equipment, coat of all
lands and interest therein, property, righta, easements and
franchises of any nature whatsoever, financing charges, interest
prior to and during construction and for not more than two years
after completion of the construction or acquisition of luch
improvements, the creation of initial reserve or debt service
funds, bond discount, cost of plans and specifications, cost of
construction plans, surveys And estimates of costs and revenues,
cost of engineering, financial and legal oervices, and all other
expenBee necessary or incidental in determining the feasibility or
practicability of such construction, reconstcuction or
acquisition, admtnistrative expenses and such other expenses aa
may be necessary I or incidental to financing authorized by this
ordinance, and inclUding reimbursement of the county or any other
person, firm or corporation for any moneys advanced to the Unit
for any expenses incurred by the Unit or county in connection with
any of the foregoing items of cost, or the creation of the Unit.

SECTION 6.
The unit may provide for the construction or reconstruction
of assessable improvements as defined in Section 1 of this
ordindnce, and for the levying of special Assessments upon
benefited property for the payment t:lereof, under the provisions
of this section.

(1) The initiel proceeding shall be the passage by the Boerd
of a resolution ordering the construction or reconstruction of
8uch aBBessable improvements, indicating the location by terminal
points and rauto. and either giving a description of the improve-
ment. by it_ material, nature, character and .ize or giving two or
more descriptions with the direction. that the material, nature,
character and elze ahall be 8ubaequently determined 1n conformity
with one of such descriptions. The improvement. need not be
continuous and may be in more than one locality or street. The
resolution ordering any 8uch improvement may give any short and
convenient designation to each improvement ordered therby.
(2){a) As 800n 48 p08sible after the passage of such rosolu-
tion the county engineer shall prepare in duplicate plana and
specifications as defined herein for each improvement ordered
thereby and an estimate of the cost thereof. Such cost shall
include, in addition to the items of cost a8 defined in this
ordinance, the following items of incidental expenses:
1. Printing and publishing notices and proceedings.
2. Costs of abstracts of title, and
3. Any other expense necessary or proper. in conduct!ng the
proceed i ng s and work prov ided for in th i s sect ion, lncl ud Ing the
estimated amount of discount, if any, upon the 8111e of ..Slllelament
bonds or any other obligations issued hereunder for which nuch
special assessments are to be pledged. If the resolution shall
provide Ilternative descriptions of material, nature, character
and size. Buch estimate shall include an estimate of the cost of
the improvement of each such description.
(b) The engineer shall alBa prepare in ~uplicate a tentative
apportionment of the estimated total cost of the improvements 4S
between tho unit and each lot or parcel of land Dubject to special
assessment under the resolution. Such tent~tive apportionment of
total estimated cost shall not be hel~ to l&mit or restrlct the
duties of the engineer in the preparation of the preliminary
assessment roll. One of the duplicates of such plans,
specifications and ~stimates and such tent8tive apportionment
shall be filed with the ClerkJ and the other dup~icate shall be
retained by the engineer in his files, all thereof to remain open
to public inspection.
(3) The Clerk upon the filing with him of such plans,

shall also state that plans, specifications, estimates arid ill
tentative apportionment of coat thereof Are on file with the
Clerk. In addition to the pubUshed notice described above, thw
Clerk .hall mail a copy of the notice by first clas. mail to .ach
property owner to be assessed. Notice shall be mailed to the
owner at such address a8 ia shown on the tax rolla. The failure
of the Clerk to mail such notics shall not constitute a valid
objection to holding the he.ring as provided in thia section or to
any other action taken under the authority of this section.
(4) At the time named in Buch notice, or to which an
adjournment may be taken by the Board, the Board shall receive any
objections of interested person~ and may then or thereafter repeal
or confirm such resolution with such amendments, if any, a8 may be
desired by the Board and which do not cause any additional
property to be specially assessed. Assessments shall be levied
against all property in the Unit specially benefited by the
improvements. Such assessment shall be based on frontage, and/or
any other method deemed equitable by the Board.
(S) All objections to any such resolution on the ground that
it contains item. which cannot be properly Assessed against
property, or that it is, for any default or defect in the paBsage
or character of ~he resolution or the plans or specifications or
estimate, void o~ voidable in whole or in part, or that it exceeds
the power of thel Board, shall be made either in writing, and flle~
with the Clerk at or before the time or adjourned time of such
hearing, (Ir shall be made orally at the hearing. Any objections
not so made shall be considered as waived, and if any objection
shall be made and overruled or shall not be sustained, the
confirmation of the ,,:er.olution shall be the (inal adjt,;,uication of
the issues presented unless proper steps shall be taken in a court
of competent jurisdiction to secure relief within 20 days from the
date of Board action on the resolution.
(6) Whenever any. resolution providing for the construction
or reconstruction of Assessable improvements and for the levying
of special aSBeBsments upon benefited property for the payment
thereof shall have been confirmed, as hereinabove provided, Or at
any time therafter, the Board may issue assessment bonds payable
out of such Assessments when collected. Said bonds shall mature
not later than two year! after the last installment in which said
special assessments may be paid, as provided in subsection 11, and
shall bear interest at not exceeding the maximum amount permitted

Such assessment bonds shall be executed, shall have such
provisions for redemption prior to maturity and shall be sold in
the manner prescribed herein. The amount of such asseasment bonda
to be issued shall not exceed the amount of special assessments
actually confirmed and levied by the Board as provided in
subsection 4.

The Board shall have the right to reject any or all bids, and if
all bids are rejected the Board may readvert!se or may determine
to do the work by the county forces without contract.
(8) Promptly after the completion of the work, the county
engineer, who is hereby designated 8S the official to make the
prelimin3ry assessment of benefita from assessable improvements,
shall prppare a preliminary aSsessment roll and file the 8ame with
the Clerk which roll shall contain the followings
(a) ^ description of abuttIng lots and parcels of land or
lands within the unit which will benefit from such DBsessable
improvements and the amount of Buch benefits to each such lot or
parcel of land. Such lots and parcels shall include the property
of the county and any school district or other political subdivI-
sion. There shall also be given the name of the owner of record
of each lot or parcel as shown on the tax rolls.
(b) The total cost of the impr~~ement and the amount of
incident::l expense.
(9) The preliminary roll shall be advisory only an~ shall be
SUbject to the action of the Board 48 hereil'after provided. Upon
the filing with the Clerk of the preliminary assessment roll, the
Clerk shall publish at least once in a newspaper of general circu-
lation, p~~li9hed in the county, and circulating in the distrIct,
a notice btating that at a meeting of the Board to be held on a
certAin day alld hour, not less than 15 days from the date at such
publication, which meeting may be a regular, adjourned or special
meeting, all int~reBted persons may appear and file written
objections to the confirmation of the preliminary assessment roll.
Such not ice shall deBcr ibe the assessable improvements and the
location thereof.
(10) At the time and place atated in such notice the Board
ahall meet and receive the objectIons in writing of all interested
----persona as stated in such notice. The Board may adjourn the
hearing from time to time. After the completion thereof the Board
shall either annular sustain or modify in whole or in part the
preliminary assessment as indicated on such roll, either by con-
firming the preliminary Assessment aqainst any or all lots or
parcels described therein or by cancelling, increasing or reducing
the same, according to the special benefits which the BOArd
decided each such lot or parcel has received or will re~eive on

account of such improvement. If any property which may be

to the special benefits. Forthwith after such confirmation such
Assessment roll shall be delivered to the Clerk. The Assessment

asses Bed unless proper steps be taken within 30 days in a court of
competent jurisdiction to secure relief. If the assessment
Against any property shall be sustained or reduced or abated by
the court, the Clerk ahall note that fact on the assessment roll
opposite the description of the property affected thereby.
111) (.) Any u....ment may be pe1d at the office of the
Clerk within 60 ~ay. after the confirmation thereof, without
interest. Thereafter all assessments shall be payable in equal
installments, wlth interest at not exceeding the maximum amount
permitted by la\of, or, if bonds are issued pursuant. to this
ordinance, at. ~'rate not to exceed one percent above the rate of
intereAt at whiah such bonda arc Bold,_ from the expiration of said
60 days in each of the succeeding number of years which the Board
Bhall determine by resolution, not exceeding 40, provided however,
that the Board may provide that any Asseosment may be paid at any
time before due, t0gether with interest accrued thereon to the
date of payment, if such prior paY""l!nt shall be permitted by the
procoedings authorizing any assessment bonds or other obliqationl
for the payment of which such special Assessments have been
pledged.
(b) All such ape-cia I asse8fnlents may be collected by the tax
collector at the SAme time as the ad valorem taxes of the Unit and
general county taxes are collected by the tax collector if the
Board Bhall, prior to the confirmation of the resolution orderin9
the improvements pursuant to subsection 4 hereof, have entered
into an Agreement with the Property Appraiser and otherwise met
the requirements of Section 197.0126 Flori~a Statutes.
(c) All assessments ahall constitute a lien upon the

tion ordering the improvement, of the same nature and to the same
extent as the lien for gen~ral county taxes falling due in the
samr year or years in which such assessments or installments
thereof fall due, and any assessment or installment not paid when
due shall be collectible with such interest and with a reasonable
attorney's fee and costs, but without penalties, by the unit by
proceedings in a court of equity to foreclose the 11en of aase88-
ments as a lien for mortgages is or may be foreclosed under the
laws of the BtateJ provided that any such proceedings to foreclose

shall embrace all installments ot principal remaln~n9 unpaid with
accrued Interest thereon, which installments shall, by virtue of
the institution of such proceedings, immediately become due and
payable. The collection procedure described herein shall be an
additional or alternative method to the method of collection
described in subsection (11)(b) above.
(d) NevertheleS8, if prior to any sale of the property under
decree of foreclosure In such proceedings, payment be made of the
installment or installments which are shown to be due under the
provisions of the resolution paased pursuant to subsection (10),
and by this subsoction, and all coata including intereat And
attorney IS fee.. such payment shall have the effect of restoring
the remaining in8tallment~ to their orIginal maturities as
provided by the resolution passed pursuant to this subsection and
the proceedings shall be dismissed.
(e) It shall be the duty of the Board to enfo~ce the prompt
collection of assessment by the means herein provided, and such
duty may be enforced at the Buit of any holder of bonds issued
under this ordinance in a court of competent jurisdiction by
mandamus or other appropriate proceedings or action.
(f) Not later than 30 days after th~ annual installMent. are
due and payable, it shall be the duty of the Board to direct the
attorney or attorneys whom the Board shall then designate, to
institute action within two months after such direction to entorce
the collection of all special assessments for Assessable improve-
men,s made under this Bection and remaining uue and unpaid at the
time of such direction. Such action shall be prosecuted in the
manner and under the conditions 1n ant: under which mortgages are
foreclosed under the laws of the state.
(9) It sh~ll be l~wful to join in one action the collection
of assessmont. a9~in.t any or all property aBBeBsod by virtue of
the same assessment roll unless th~ court shall deem such jOinder
prejudicial to the interest of any defendant. The court anall
allow a reasonable attorney1s fee ~or the ftttorney or attorneys of
the unit, and the SAme shall be collectible a8 a part of or 1n
addition to, the costs of the llIction.
(h) At the sale pursuant to decree in any such action, the
unit may be a purchaser to the same extent as AI. individual person
or corporation, except that the part of the purchase price
represented by the assessments sued upon and the interest thereon
---need not be paid in CAsh. Property 80 Acquired by a unit may be
Bold or otherwise disposed of, the proceeds of such disposition to
be placed in such fund as provided by any resolution authorlzln9

(12) All assee.mente and chsrgee made under the provi.ion. of
thi. section for the payment of all or any part of the coat of any
aSBessable improvements for which assessment bonds shall have been
issued under the provisions or this ordinance, or which have been
pledgQd aa additional ascurity for any other bond. or obligetions
issued under thia ordinance, ahall be used only for the payment of
principal of or interest on such assessment bonda or such other
bonds or Obligations.
(13) The county and the Bchool district and, any other
pOlitical subdivision wholly or partly within the Unit shall
p088ese the 8ame power and be subject to the same duties and
liabilities in respect of assessment under this Bection affecting
the real estate of such county, Bchool district or other political
subdivision which private owners of real eatate posless or are
subject hereunder, and such real estate of any such county, achool
district and political subdivision shall be subject to liens tor
said assessments in all cases where the same property would be
subject to such liens had it at the time the lien attached been
o~ned by a private owner.
(14) If any special assessment made undpr the provisions of
this chapter t01defroy the whole or any part of the expense of any
such improvement shall be deemed by the Board to be inadequate to
meet the obligation owed to bondholders, the Board may adjust the
duration of and the interest penalty on installment payment. of
the assessment so that payments of special assessments Bhall be
sufficient to satisfy the contractual Obligation owed by the Unit
to bondholders. Ho~ever, such ~djustl~ent shall not have the
effect of increasing the special asses~ment of any property,
including the affect of lncreaslng the amount of assessment of any
property in proportion to the amount of benefits conferred on that
property, nor shall Buch adjustment increase the interest rate or
the installment payment periOd beyond the interest rate and
payment per iod set forth In eubsect Ion (11) (a) . Further the
Board, in llodjuating the intere!llt rates and the periOd of payment
of assessments, shall follow the pr0vlsions of thIs section
providing for notice and hearing to interelted persons and
providing for passage of resolutions establishing special
assessments.
SECTION 7.
-..---.,-( 1) . The Board for and on behalf of the Uni t ia authorized to
provide from time to time for the iaBuance of assessment bonds to
pay all or part of the coat of improvements. The principal of and
intereat on any such bonds shall be payable from the pledge of
special assessment levied pursuant to this ordinance or by a
pledge of the full faith and credit of the Unit, if euch full
faith and credit pledge be authorized by ref~rendum. The bonda
shall be dated, ahall bear interest at such rate or rates aa shall

not e~ceed ~he maximum amount permitted by law, shall matur~ at
.uch time or times not exceeding 40 year. trom their date or dates
aa may be determined by the Board and may be made redeemable
before maturity, at the option of the Board, under such terms and
condi- tions and at such priess as may be fixed by ths Board prior
to the issuance of such bonds. The Board ahall determine the form
of the bonds, including any Interest coupons to be attached
thereto, and ahall fix the denomination or denominations of the
bonds and the place or places of payment of principal and
interest, which may be at any bank or trust company within or
without the state. Such authorizing resolution may further
provide that such bonds may be executed manually or by the
~n9raved, lithographed or facsimil~ signature of the chairman of
the BOllrd. Tho seal of the County may be affixed or litllographed,
engraved, or otherwise reproduced in facsimile on such bonds and
shall be attested by the manual or facsimile signature of the
Clerk. In CdSO any officer whooe signature or a facsimile of
whose s19naturo shall appn4r on the banda shall cease to be such
officer before the delivery of such bonds, such signature or
facsimile shall nevertheless be valid and sufficient for all
purposes the s~me a8 if he had remained in office until such
delivery. All bonds issued under the provisions ot this ordinance
shall he and constitute and have all the qualities and incidents
of negotiable instruments under the law merchant and the
negotiable instruments law of the state. The bonds may be issued
in coupon or registered form a8 the Board may determine in such
authorizing resolution and provision may be made for the
registrdtion of any coupon bonds a8 to principal alone and also as
to principal and interest, and for the reconversion of coupon
bonds or of any bond registered as to principal and interest. The
issullnce of such bonds shall not be SUbject to ~\ny limitations or.
conditions contained in any other law and the Board may sell such
bonds in such manner, either at public or private sale, and for
such price, as it may determine to be for the beat interest of the
Unit, but no such sale shall be made at a price 80 Iowa. to
require the payment of interest on money received therefor at a
rate in excess of the maximum amount permitted by law, computed
with relation to the absolute maturity of the bonds in accordance
with standard tables of bond values, excluding, however, from such
computation the amount of any premium to be paid for the
redemption of any bonds prior to maturity.
SECTION 8.
