EXECUTIVE SUMMARY
Recommendation to grant final approval of the roadway (private) and
drainage improvements for the final plat of Bellagio at Fiddler's Creek with
the roadway and drainage improvements being privately maintained.
OBJECTIVE:
To grant final approval of the infrastructure improvements associated with that
subdivision known as Bellagio at Fiddler's Creek.
CONSIDERATIONS:
1. On August 28, 2001, Engineering and Environmental Services
Department granted preliminary acceptance of the roadway and drainage
improvements in Bellagio at Fiddler's Creek.
2. The roadway and drainage improvements will be maintained by the
project's homeowners association.
3. The required improvements have been constructed in accordance with the
Land Development Code. The Engineering and Environmental Services
Department has inspected the improvements and is recommending final
acceptance of the improvements.
4. A resolution for final acceptance has been prepared and approved by the
County Attorney's Office. A copy of the document is attached.
5. This PUD has been found to be in substantial compliance.
FISCAL IMPACT:
The roadway and drainage improvements will be maintained by the project's
homeowners association.
GROWTH MANAGEMENT IMPACT: There is no growth management impact.
LEGAL CONSIDERATIONS:
The County Attorney's Office has reviewed and approved the Resolution for legal
sufficiency. This item is ready for Board consideration and approval. This matter
is quasi-judicial and requires ex parte disclosures. A majority vote of the Board is
necessary for Board action. STW

RECOMMENDATION:
That the Board of County Commissioners grant final acceptance of the roadway
and drainage improvements in Bellagio at Fiddler's Creek and release the
maintenance security.
1. Authorize the Chairman to execute the attached resolution authorizing
final acceptance.
2. Authorize the release of the maintenance security.

RESOLUTION NO. 09-_
A RESOLUTION OF THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY,
FLORIDA AUTHORIZING FINAL
ACCEPTANCE OF CERTAIN ROADWAY AND
DRAINAGE IMPROVEMENTS IN BELLAGIO
AT FIDDLER'S CREEK, ACCORDING TO THE
PLAT THEREOF RECORDED IN PLAT BOOK
36, PAGES 41 THROUGH 44; RELEASE OF THE
MAINTENANCE SECURITY; AND
ACCEPTANCE OF THE MAINTENANCE
RESPONSIBILITY FOR THE ROADWAY AND
DRAINAGE IMPROVEMENTS THAT ARE NOT
REQUIRED TO BE MAINTAINED BY 951 LAND
HOLDINGS, LTD.
WHEREAS, the Board of County Commissioners of Collier County, Florida, on
November 28, 2000, approved the plat of Bellagio at Fiddler's Creek for recording; and
WHEREAS, the Developer has constructed and maintained the roadway and
drainage improvements in accordance with the approved plans and specifications as
required by the Land Development Code (Collier County Ordinance No. 04-41, as
amended); and
WHEREAS, the Developer is requesting final acceptance of the roadway and
drainage improvements and release of his maintenance security; and
WHEREAS, the Engineering and Environmental Services Section of the
Community Development Department has inspected the roadway and drainage
improvements, and is recommending acceptance of said facilities.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that final acceptance is hereby
granted for those roadway and drainage improvements in Bellagio at Fiddler's Creek,
pursuant to the plat thereof recorded in Plat Book 36, pages 41 through 44, and the Clerk
is hereby authorized to release the maintenance security.

BE IT FURTHER RESOLVED AND ORDERED that the County accept the
future maintenance and other attendant costs for those roadway and drainage
improvements that are not required to be maintained by 951 Land Holdings, Ltd.
This Resolution adopted after motion, second and majority vote favoring same,
this day of , 2009.

Fiddler's Creek PUD Monitoring files record the following compliance. I have copied the
reviewing departments/agencies, asking for an update on the compliance status as it relates to the
subdivision, Bellagio at Fiddler's Creek. Once I receive updated reports I'll provide a final
report.
Collier County Real Properties: October 21, 2008 Memo from Sue Zimmerman in Real
Properties indicates that a library and a fire station/ EMS facilities is to be provided pursuant to
Section 11.4 of Ordinance 00/84. These dedications have been requested but at the time of the
memo found to be incomplete.(Report attached)
Environmental: In a report provided December 29,2008 the environmental compliance was
found as follows:
Conservation/Preserve commitment is Incomplete. Of the 756.40 acres required, only 53.1
acres have been completed.
Special Wildlife Management Plan commitment is Incomplete. Only 45% of commitment is
complete.
Exotic Vegetation Removal commitment is Incomplete.
Park land, Recreation, and Open Space commitment is Incomplete
Engineering: No current report
Transportation: No current report
PUED: In an October 16, 2008 report the PUD was found to be in compliance. (Report attached)
SFWMD: Correspondence from the District dated November 20, 2008 indicated that the surface
water management system permitted under Permit 11-00685-S, Application 99] 118-4, to be
constructed in substantial conformance with the plans and specifications approved by the
District. Although the certification was accepted, further action by the permittee was required.
The correspondence states that the permitee shall initiate the permit transfer to the responsible
operating entity and the permit conversion to the operation phase. (See correspondence attached)
