EXECUTIVE SUMMARY
Recommendation to award Bid #09-5199 including Alternate No. 1 for construction of
Palm River Estates Unit 5 N-S Stormwater Improvements, Project No. 51030.1, to
Stahlman - England Irrigation, Inc. in the amount of $348,269.11 plus a ten percent
contingency and to approve necessary budget amendment.
OBJECTIVE: To receive Board of County Commissioners approval for the award of a contract
to proceed with the Palm River Estates Unit 5 N-S Stormwater Improvements Project in the
amount of $348,269.11 per plans and specifications to the lowest, qualified and responsive
bidder, Stahlman - England Irrigation, Inc.
CONSIDERATIONS: The bid was advertised on March 2,2009 in the Naples Daily News and
notices were sent to eight hundred seventy-eight (878) vendors. On March 12, 2009, a non-
mandatory pre-bid meeting was held to explain the contract specifications and answer any
questions that the prospective bidders may have. On April 2, 2009, ten (10) bids were received
and reviewed by the Stormwater Management Section's staff and the Project's Design
Professional in conjunction with the Purchasing Department. Responses were received from the

The ten (10) responsive base bids received ranged from $334,250.00 to $790,054.00. Bid
alternates and costs are noted above. The Engineer's project estimate was $370,000.00.
Staff has reviewed the bids received and recommends awarding the construction contract to
Stahlman - England Irrigation, Inc. as the lowest, qualified and responsive bidder including the
Bid Alternate.
In April 2003, an Engineering study was completed by Camp Dresser & McKee (COM) for the
North Livingston Road Basin Stormwater Management Plan. The study reviewed and detailed
regional basin stonnwater issues. The report also pointed out system problem areas which the
County needed to address as to improve stormwater management in the basin.

During fiscal Year 2007-2008 Palm River Estates Area Stormwater Improvements were
completed at the following locations:
. Ibis Way and Cypress Way East Intersection.
. East to West Drainage and Utility Easement between Palm River Estates Unit No.5 and
Imperial Golf Estates Phase IV.
. Palm River Estates Unit No.4 50' N/S Utility & Drainage Easement the segment from
Sawgrass Court to Piper Boulevard which outfalls into the Immokalee Road Drainage
Canal Right-of-Way.
for Fiscal Year 2008-2009, the remaInIng funded segment scheduled for reconstruction in
compliance with the CDM North Livingston Road Basin Stormwater Management Plan is the
Palm River Estates Unit No. 5 - fifty foot (50') N/S utility & drainage easement segment
northerly ofIbis Way to Imperial Golf Estates.
The proposed project scope generally consists of clearing and grubbing, relocation/widening of
an existing north/south ditch flow way's capacity, providing a grassed access pathway for
maintenance services, cleaning and televising culverts which drain into the easement and minor
design adjustments to the existing northerly east to west drainage and utility easement.
Construction shall be in accordance with the plans and specifications by Q. Grady Minor and
Associates, P.A.
In this project's community involvement efforts, the Stormwater Management Section staff
notified the adjacent property owner(s) adjacent to the utility and drainage easement and met
with them at two (2) community meetings (12/08/08 & 01/15/09). As a result of the owner(s)
meeting requests, staff undertook ex1ra steps to have completed a unique site specific Listed
Species Survey (Wildlife Report) and a Vegetation Inventory within the typical platted public
utility and drainage easement limits. Other adjacent owner(s) comments received were evaluated
and considered within the project design's final plans.
With regards to awarding the project including Bid Alternate # I (Cocoplum plant materials),
after discussions with Road Maintenance, staff is recommending that:
. native landscape materials be installed as part of the stormwater improvements with the
stipulation that the Collier County will not perform future maintenance of any kind
regarding the landscape materials installed.
. each lot owner(s) provide authorization for Collier County's placement of the native
landscape materials within the rear easterly five foot (5') of the fifty foot (50') Utility and
Drainage Easement of Palm River Estates Unit 5 of their property.
. each lot owner(s) agrees, by execution of an approved County form, to accept future
maintenance responsibility of the landscape materials.
· each lot owner(s) agrees to compensate Collier County for their appropriate footage of
landscape materials installed should they choose to participate.
Bid Alternate # I provides pricing for the purchase, installation, and watering for the seven gallon
(7 Gal) Cocoplum plant materials with mulch on four foot (4') centers.

. Lots with rear lot footages of one hundred feet (100') typically would receive
approximately twenty- five (25) plants.
. Lots with rear lot footages of eighty-eight feet (88') would receive approximately twenty-
two (22) plants.
. The lot with rear lot footages of one hundred five feet (105') would receIve
approximately twenty-seven (27) plants.
. The lot with rear lot footages of one hundred thirty-six feet (136') would receive
approximately thirty-four (34) plants.
The Bid Alternate #1 adds an additional $13,062.50 to the bid ($27.50 per plant installed,
mulched, and watered to ensure root establishment). With the addition of Bid Alternate #1, the
lowest recommended total bid becomes $230.89 below the next bid submission of $348,500.00
(which also included Bid Alternate # I).
FISCAL IMPACT: Funds in the amount of $383,096.02 (total construction amount of
$348,269.] I plus a ten percent contingency amount of $34,826.91 for unforeseen related
expenses) are available in the Stormwater Management Section Fund 325, Project No. 51030,1.
A budget amendment in the amount of $382,617.64 is necessary to move the remainder of the
funds from five (5) completed storm water projects and to allocate the funds to this project.
LEGAL CON SID ERA nONS: This item has been reviewed and approved by the County
Attorney's Office, is not quasi-judicial and requires no ex parte disclosure. This item requires a
simple majority vote for approval, and is otherwise legally sufficient for Board action. -JW
GROWTH MANAGEMENT IMP ACT: There is no Growth Management Impact associated
with this Executive Summary.
RECOMMENDATION: That the Board of County Commissioners:
(I) approve award of Bid No. 09-5199 to Stahlman - England Irrigation, Inc., for the Palm
River Estates Unit 5 N-S Stormwater Improvements Project No. 51030.1 for the total
Base Bid and Alternate No. I of $348,269.11 plus a ten percent (10%) contingency
($34,826.9 I) totaling $383,096.02;
(2) authorize the Chair to execute, subject to final review and approval by the Co(!nty
Attorney's Office for legal sufficiency, the standard Board approved contract after
execution by the vendor.
(3) approve necessary budget amendment.

Dear Mr. Prince:
On April 2, 2009, the Bid Opening was held on the above referenced project. A total of 10 bids
were received on the project. The Bid included a Base Bid and a Bid Alternative. The Bid
Alternative provided for the construction of a landscape buffer along the east side of the stormwater
channel. The construction of this landscape buffer is to help mitigate the loss of the existing
vegetative screen between the residents in Palm River and the Quail Crossing Subdivision.
The Base Bids ranged from $334,250 to $790,054 with Earth Tech Enterprises being the lowest,
responsive bidder. The Bids with the Alternate ranged from $348,269.11 to $842,304 with
Stahlman-England being the lowest, responsive bidder. We have worked with Stahlman-England
on previous stormawater projects (including the previous project immediately adjacent) and have
been pleased with their work. We have not worked with Earth Tech and at this time are verifying
their references and previous work.
If the COWlty wishes to complete only the work under the Base Bid, (and if references check out),
the contract award is recommend for Earth Tech. If the Base Bid and Alternate work is chosen,
then the contract award should go to Stahlman-England.

. Should you be in agreement, owner(s) execution of the document is reQuired. Upon receipt of the
executed Block G, Lots 1- 20 documents and compensation to Collier County the native landscape
materials will be quantified, ordered, and scheduled for placement by our contractor.

! Introduction I Purpose
This report is an account of a Listed Species Survey. This wildlife and plants species
survey rccently performed along a drainage canal in Palm River. Its purpose is to
identify and describe key habitats and report any listed species using the area that would
be at risk due to possible future actions and potential wildlifc that may utilize the
proposed improvcd drainage canaL This survey and report arc based on fieldwork
perfOlmed during December 2008 and January 2009.
II Site Description
The subject area is a drainage canal. This drainage canal is located nOlth ofIbis Way east
of Cypress Way and west of Raven Way. The drainage Canal is located in Section 23,
Township 48, and Range 25.
This drainage canal is currently proposed to be modified. As such, a pre- and post study
was rcquested to examine the potential harm of any listed species on and/or utilizing the
area, The drainage canal is oriented nOlth - south and abuts single-family homes. Single-
family homes line both sides of the drainage canaL TIle drainage canal abuts sllch
amenities as swimming pools, gazebos, gardens and patios. This area does have some
habitat to support small, urban vertebrates.
III Listed SDecies Survey
The required survey for a Listed Species Survey calls for a survey covering 100 % ofthe
site, at prescribed transect. Such a survey was conducted in December 2008 - January
2009, All possible species of plants and animals listed by state and federal agencies were
noted.

V Conclusions
Focused searches were conducted over several days. Signs of small urban mammals such
as rabbits and raccoons were readily visible. Raccoon tracks could be seen along the
shore bank of the drainage canal. Several species of songbirds passed tlu'ough transect
areas during this survey. The site also has some potential as foraging habitat for wading
birds especially at the nOlih and south tcrminus whcrc tree cover is limited. Some were
seen foraging along the existing littoral area south oflbis Way where previous
improvements were made by the County. A Great Blue heron was secn actively foraging
along the banks.
The proposed project is to clear and widen the drainage canal. The improvements north
and south of Ibis Way has improved foraging utilization by wading birds. The
improvements were by widening the area and reducing the canopy and midstory
vegetation. These same improvements along the n01ih and south canal may improve the
utilization of wading birds.
Numerous individuals (residents) that I spoke with stated to me that a pair of Bald eagles
commonly forage along this drainage ditch. There a.re no active nests near by. I have
included in this rcport thc locations of the latest identified active Bald cagle nests. There
is nothing prohibiting Bald eagles from traversing and/or from foraging along this ditch.
During my survey time I did not witness any foraging by the Bald eagles.
Our survey has found no listed plant species on this site.
