Reauesl to Soeak under Public Petition
1) OUr law firm has been engaged by a group of property owners affected by the
proposed Collier County Stormwater Management Section project titled Palm River
Estates Unit No: 5 North/South Stormwater Improvements (see relevant portions of
project plans attached), I am requesting to speak on behalf of our clients in order to
convey their strong objection to this project for a variety of reasons, including the
following:
a. The project will destroy the environmental habitat located on our clients'
properties;
b. The project will significantly decrease the level of privacy and security provided by
the current condition of the habitat;
c. The drainage ditch contemplated by the project's design will constitute a safety
hazard, particularly to young children;
d. The project will decrease the value of the properties owned by our clients;
e, The project's design will decrease the conveyance capacity of the stormwater
ditch by at least 10% (see attached letter dated February 16, 2009 from Jeppesen
Engineering Corp); and
f, The proposed project will cost between $350,000.00 - $475,000.00 of public
funds, bul does not achieve the purpose for which it is being proposed and at the
same time has many negative effects as outlined above.
2) We ask the Commission to disapprove the project and dlrectthe Stormwater
Management Section to evaluate alternative plans to address any stormwater
management issues, while at the same time preserving the current environmental habitat
loealed on our clienls' properties,

Fcbmary 11"', In reviewing this infonnation, 1 have determined the following:
1, It appears that the Counly does have the righllo do lhe construction they are propo.ing.
There is a 50' drainage easemenllhat was dedicated to the public (Collicr County I in the
"Palm RIver Estates Unit Nu, 5" plat. I have attached a copy of the apphcallle pages of
the plat for your use.
2. Per the meeting attendees, a permit was not required by the South Florida Water
Management District because they are classifying this as a "maintenance" project.
3, T1te proposed construction will consist of re-grading the entire existing ditch with a new
design, This will eliminate al1 existing landscaping, In order to alleviate the concc'fTlS the
affected homeowners over the loss of hmdscaping, the County is now proposing io ..:d "
cocoplum hedge on the east side of the ditch, In order for this proposed hedge to hew,""e
a reality, County Staff will need to secure Board of County Commissioners approval and
also secure tbe approval of thc homeowners.
4, The subject ditch carries flows from property north of Palm River Estates, including
