BROCI, CLlRf 16Al RESOLUTION NO. 2003- h <; RESOLUTION FOR PETITION A VESMT2002-AR3349 TO DISCLAIM, RENOUNCE AND VACATE THE COUNTY'S AND THE PUBLIC'S INTEREST IN TWO 30 FOOT WIDE PARCELS OF LAND CONVEYED TO COLLIER COUNTY BY SEPARATE INSTRUMENT FOR ROAD RIGHT OF WAY, UTILITIES AND DRAINAGE, AS RECORDED IN OFFICIAL RECORD BOOK 484, PAGE 523 AND PAGE 525, PUBLIC RECORDS OF COLLIER COUNTY, FLORIDA. LOCATED IN SECTION 21, TOWNSHIP 48 SOUTH, RANGE 26 EAST. WHEREAS, pursuant to Section 125.01(t), Florida Statutes, Michael J. Volpe, Esq., of Robins, Kaplan, Miller & Ciresi, L.L.P., as agent for the petitioner, H.D. Development, L.L.c., does hereby request the Board of County Commissioners to vacate, renounce and disclaim the County's and the Public's interest in two 30 foot wide parcels of land conveyed to Collier County by separate instrument for road right of way, utilities and drainage, as recorded in Official Record Book 484, Page 523 and Page 525, Public Records of Collier County, Florida; and WHEREAS, the granting of Petitioner's request will not adversely affect the ownership or right of convenient access of other property owners; and NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that the County's and the Public's Road Right of Way, Utility and Drainage interests over and across the following two 30 foot wide parcels are hereby vacated, extinguished, renounced and disclaimed, and this action is declared to be in the Public's interest and for the Public's benefit: See Exhibit "A" attached hereto and incorporated herein BE IT FURTHER RESOLVED, that the Clerk to the Board is hereby directed to record a certified copy ofthis Resolution in the Official Records of Collier County, Florida.
