EXECUTIVE SUMMARY
Recommendation to grant final approval of the roadway (private) and
drainage improvements for the final plat of Professional Village at
Northbrooke with the roadway and drainage improvements being privately
maintained.
OBJECTIVE:
To grant final approval of the infrastructure improvements associated with that
subdivision known as Professional Village at Northbrooke,
CONSIDERATIONS:
1. On September 10, 2007, Engineering and Environmental Services
Department granted preliminary acceptance of the roadway and drainage
improvements in Professional Village at Northbrooke.
2. The roadway and drainage improvements will be maintained by the
project's homeowners association.

The required improvements have been constructed in accordance with the
Land Development Code. The Engineering and Environmental Services
Department has inspected the improvements and is recommending final
acceptance of the improvements.
4. A resolution for final acceptance has been prepared and approved by the
County Attorney's Office. A copy of the document is attached.
5. This PUD has been found to be in substantial compliance.
FISCAL IMPACT:
The roadway and drainage improvements will be maintained by the project's
homeowners association.
GROWTH MANAGEMENT IMPACT: There is no growth management impact.
LEGAL CONSIDERATIONS:

The County Attorney's Office has reviewed and approved the Resolution for legal
sufficiency. This item is ready for Board consideration and approval. This matter
is quasi-judicial and requires ex parte disclosures. A majority vote of the Board is
necessary for Board action. STW

RECOMMENDATION:
That the Board of County Commissioners grant final acceptance of the roadway
and drainage improvements in Professional Village at Northbrooke and release
the maintenance security.
1. Authorize the Chairman to execute the attached resolution authorizing
final acceptance.
2. Authorize the release of the maintenance security.

A RESOLUTION OF THE BOARD OF COUNTY
COMMISSIONERS 'OF COLLIER COUNTY,
FLORIDA AUTHORIZING FINAL
ACCEPTANCE OF CERTAIN ROADWAY AND
DRAINAGE IMPROVEMENTS IN
PROFESSIONAL VILLAGE AT
NORTHBROOKE, ACCORDING TO THE PLAT
THEREOF RECORDED IN PLAT BOOK 48,
PAGES 65 THROUGH 66; RELEASE OF THE
MAINTENANCE SECURITY; AND
ACCEPTANCE OF THE MAINTENANCE
RESPONSIBILITY FOR THE ROADWAY AND
DRAINAGE IMPROVEMENTS THAT ARE NOT
REQUIRED TO BE MAINTAINED BY THE
PROFESSIONAL VILLAGE AT
NORTHBROOKE OWNERS' ASSOCIATION,
INC.
WHEREAS, the Board of County Commissioners of Collier County, F]orida, on
September 2], 2005, approved the plat of Professional Village at Northbrooke for
recording; and
WHEREAS, the Deve]oper has constructed and maintained the roadway and
drainage improvements in accordance with the approved plans and specifications as
required by the Land Development Code (Collier County Ordinance No. 04-4], as
amended); and
WHEREAS, the Developer is requesting final acceptance of the roadway and
drainage improvements and release of his maintenance security; and
WHEREAS, the Engineering and Environmental Services Section of the
Community Development Department has inspected the roadway and drainage
improvements, and is recommending acceptance of said facilities.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that final acceptance is hereby
granted for those roadway and drainage improvements in Professional Village at
Northbrooke, pursuant to the plat thereof recorded in Plat Book 48, pages 65 through 66,
and the Clerk is hereby authorized to release the maintenance security.

BE IT FURTHER RESOLVED AND ORDERED that the County accept the
future maintenance and other attendant costs for those roadway and drainage
improvements that are not required to be maintained by the Professional Village at
Northbrooke Owners' Association, Inc.
This Resolution adopted after motion, second and majority vote favoring same,
this day of , 2009.

This letter is to acknowledge receipt of your consulting engineer's construction completion
certificatiDn pertaining to the subject parcel's surface water management system, The submitted
information has been accepted and incorporated intD the permit file.
By accepting the engineer's certification, the District staff considers the surface water
management system permitted under the above listed application number(s) to be constructed
in substantial conformance with the plans and specifications approved by the District. This
satisfies your permit's conditions regarding submittal of an engineer's certification for
construction completion of the permitted drainage facilities_
AI.though the certification has been accepted, further action by you, as permittee, is required. In
accordance with Rule 40E-1 and 40E-4. Florida Administrative Gode (FAG) - upon
construction completion and acceptance of the engineer's certification of the surface water
management system, the permittee shall initiate the permit transfer to the responsible operating
entity and the permit conversion to the operation phase.
The enclosed permit conversion I transfer Form #0920 should be completed by an officer Df the
association (operating entity) and submitted (if not previously fumished), along with a copy each
of:
1. the ownership transfer or turnover document, I.e., warranty deed, tumover
meeting minutes, etc_,
2. the recorded declaration of covenants or declaration of condominium (including
amendments, if any),
3_ a copy of the SFWMD Permit recorded as an EXHIBIT to the recorded
declarations or a recorded Public Noticing of the SFWMD Permit
4. a copy of the flied articles of incorporation,
5. a copy of the certificate of incorporation for the property owners association,
and
6. a copy of all recorded plats (11 x 17 is preferred).

Also enclosed is an affidavit which attests that the items required by the Basis of Review are
contained in the documents. If you do not choose to execute the affidavit, you may enter the
requisite information in the boxes and return to us in lieu of a checklist. Submitting this
completed affidavit or checklist will expedite the legai I institutional review of your request for
permit conversiDn I transfer to the Dperational phase. In addition, as required by rule 40E-
4.361, F.A.C., the permit file must contain dDcumentation that applicable conditions to the
permit have been satisfied.
Please be aware that rules 40E-1.6107 and 40E-4.351. FAC. also specify "Until transfer is
approved by the District, the permittee shall be liable for compliance with the permit. The
permittee transfsrring the permit'shall remain liable for any corrective..iIctions that are required
as a result of any violations of the permit which occurred prior to the transfer of the permit."- As
a consequence of noncompliance with these mandates you could be held respDnsible for

NORTHBROOKE PROFESSIONAL CENTER PUD COMPLIANCE
Zamira, Claudine, Steve and Susan: Please review what I found in the PUD Monitoring files and
advise John Houldsworth and I of any updates on compliance with Northbrook PUD. Some
reports have aged and there maybe updates.
Environmental: Our files indicate that the PUD was inspected In September of 2004 and the
findings follow Preserve requirements were not met within the PUD and Gopher Tortoise habitat
surveys were requested but not submitted. A recent review conducted March 2009 indicates that
a Gopher Tortoise Survey still needs to be filed and a vast population of new prohibited exotics in
the Hodges parcel have established themselves
Engineering: Memo from July of 2004 rndicated that all provisions of the DO within the
Jurisdiction of Engineering Services have been met.
Transportation: As of a Memo issued by Transportation Planning from August 2007, Claudine
reported that Northbrook Plaza was In compliance. Memo attached.
PUED: PUD Monitoring does not find any reports filed for utilities reviews.
Stormwater: SFWMD' Final Notice and Notice of Noncompliance were issued to Hampton Inn
at Northbrooke Plaza, Northbrooke Plaza POA, Bob Evans, Collier County Red Cross and Tru-
Value Hardware. All of these noncompliance notifications were issued October of 2008 notifYing
that the permit needed to be converted from construction phase to operational phase and the
construction completion certified.
No updates have been filed to indicate compliance.
Acceptance of Construction Completion Certification has been flied for the following' Northbrooke
Prof. Center, Northbrooke Ventures Tract Sand Borgata Square.
