Recommendation to accept the partial apportionment of the Federal Transit
Administration (FT A) FY 2009 Section 5307 grant in the amount of $901,448.00
OBJECTIVE: To acquire approval to accept the FTA FY09 Section 5307 grant in the
amount of$901,448.00.
CONSIDERATION: The Federal Transit Administration (FTA) released partial
appropriation for Fiscal Year 2009 Section 5307 grant award on December 18, 2008.
Congress authorized only an estimated 40% of the total FY 2009 Section 5307 Urbanized
Area Apportionment with the balance to be funded in March 2009. Of the amount released
thus far, the Bonita Springs - Naples Urbanized Area has been allocated $1,024,373. Collier
County's portion of the grant funds is estimated at $901,448.00 the difference of $122,925 is
the Bonita Springs/Lee County's portion. The Alternative Transportation Modes Department
together with the Collier Metropolitan Planning Organization (MPO) is opening a public
comment period for the approval of the apportionment of the FTA funds. The public
comment period will run concurrently with the submittal of this Executive Summary to the
Board of County Commissioners. If there are any substantial public comments received, we
will present them to the Board at a subsequent meeting. The funds will be utilized to improve
the security at the CAT Operations Facility; purchase of benches, shelters and related
amenities; provide ADA ParaTransit services; and for preventative maintenance of the
rolling stock. The grant funds will be budgeted as follows:

FISCAL IMPACT: A budget amendment is required to recognize the partial apportionment
amount Federal Transit Administration (FIA) Section 5307 Grant revenue of $901,448.00
and align budgeted expenses with the actual revenue received to be deposited in Fund 426
Project 35027.
LEGAL CONSIDERA nONS: This item has been reviewed and approved by the County
Attorney's Office, is not quasi.judicial and requires no ex parte disclosure, requires only a
majority vote for approval, and is otherwise legally sufficient for Board action.-SRT
GROWTH MANAGEMENT IMPACT: There is no Growth Management Impact
associated with this Executive Summary.

RECOMMENDATION: That the Board of County Conunissioners approves necessary
budget amendments to accept these grant dollars including those incremental grant dollars
received ahove or below the target grant award.

AUTHORIZING DESIGNATED RECIPIENT
OF FTA SECTION 5307 FORMULA FUNDS
A RESOLUTION of the Lee County Board of County Conunissioners authorizing designation of
Collier County s the recipient of Federal Transportation Administration (FTA) Section 5307 Formula
Funds for the Bonita Springs - Naples, FL Urbanized Area.
WHEREAS, the Lee County Board of County Corrunissioners has the authority to enter into
an agreement with Collier County to designate the recipient of FT A Section 5307 funds for the
portion of the Bonita Springs - Naples, FL Urbanized Area in Lee County.
NOW, THEREFORE, BE IT RESOLVED BY THE Lee County Board of County
Corrunissioners. Lee County, Florida:
I, That Collier County be designated as the recipient of FTA Section 5307 Formula
Funds for the Bonita Springs. Naples, FL Urbanized Area.
2. That the FTA Section 5307 Funds allocated to the Bonita Springs - Naples, FL

Dear Ms. Martin:
Lee County Transit has received notification from Collier County, Florida of
their intent to make available $122,924 from the Fiscal Year 200812009
Bonita Springs UZA allocation under the USC 5307 Urbanized Area Formula
Program. This amount based on a proportionate amount of allocation as
provided under the Consolidated Appropriations Act, 2008 as noticed in the
Federal Register published Thursday, December 18, 2008.
Lee County Transit concurs with this distribution as provided by Collier
County in Resolution 2004-190 and accepted by Lee County in Resolution
03-07-20.
We trust this will provide the necessary concurrence needed by Collier
County to proceecl with committing these formula grant funds.

FTA Releases Partial FY 2009 Apportionments
The Federal Transit Administration released its partial-year FY 2009
apportionments, allocations, and program information on December 18. In
September, Congress passed a continuing resolution that will fund public
transportaticn at FY 08 levels until March 6, 2009. Consequently, under the
apportionment, the FT A will distribute $4.1 billion -- approximately 43 percent of
the projected total for FY 09. Full year apportionments will not be available until
Congress enacts a subsequent appropriations bill for the remainder of FY 09.
The notice provides detailed information on funding amounts currently available
for transit programs and provides program guidance and requirements, as well
as tables that show unobligated funding from certain discretionary programs
that will be available for obligation during FY 09. The partial-year
apportionments do not include funds for specific local projects.
