EXECUTIVE SUMMARY
Recommendation to direct Enginccring Review Staff to issue Commercial Excavation Permit
Number 60.030, AR 12838, to Rinker Materials of Florida, Inc. and Barron Collier Companies
for the project known as "Hogan Island Quarry". The project consists of 967.65 acres, more or
less, sitting in Sections 9,10,15,16,21,22 of Township 47 South, Range 28 East, Collier County,
Florida, more particularly sitting about 0.75 miles north of whcre Oil Well Grade intersects
Immokalee Road.
OBJECTIVE:
To issue a Commcrcial Excavation Pcrmit Numbcr 60.030 t()r the project known as "Hogan Island
Quan-y", AR Number 12838. in accordance with Article 4 of Chapter 22 of the Collicr County Code of
Laws and Ordinances. The project is bounded on all sides by land zoned Agricultural with a Mobile
Home Overlay (A-MHO).
CONSIDERA TJONS:
The petitioners are requesting an excavation permit for an "earth-mining" operation and related
processing of materials in a Rural Agricultural (A).- Mobile Home Overlay (A-MHO) Zoning District
on approximately 967.65clc acres (')1' a project to be known as the Hogan Island Quarry.
The Conditional Use, CU,2006-AR- I 0805, for this project was heard by the Environmental Advisory
Council on May 7, 2008 and the petition was recommended for approval with stipulations by a votc of
seven in favor and onc opposed. The Collier County Planning Commission heard Petition CU-2006-
AR-10805 on June 5, 2008 and by a vote of 9 in favor and 0 opposed forwarded the petition to the
Board of Zoning Appeals (BZA) with a recommendation of approval subjcct to the stipulations.
Conditional Use CU-2006-AR-I0805 was approved with stipulations by the Board of County
Commissioners (BCe) acting as the BZA, as item 1 7D on the BCC agenda of July 22, 2008.
On January 7, 2009, the Environmental AdvisOl-Y Council (EAC), by a vote of 7 to 1, forwarded the
Excavation Permit Application for the Hogan Island Quarry to the Bce with a recommcndation of
approval with slipulalions.
The Excavation Permit Application seeks approval of a limestone and sand quan-y (mine) on 967 acres
to alJow the following:
. Maximum of 740 acres of excavation area;
. On-site related processing, but no asphalt or concrete batch ~making plant;
. Systcm of internal roadways;
. 12.77-acrc on-site preserve
Mining activities will invo Ive excavating overburden and underlying limestone deposits through the
creation of various cell pits. Two or three cell pits may be built at a time. As new cells are built, old
cells are excavated to remove remaining underlying limestone. Blasting will be necessary as pmi of
the mining operation, which would occur 6 to 8 feet below ground, but would only be conducted

during day light hours. Actual mining activities, however, would be implemented twenty-four hours a
day.
The aggregate processing plant, consisting of crushers and conveyors, would involve the processing of
excavated materials. Stock piles of raw and processed product (limestone aggregate, sand) would be
stored here. The plant would operate 12 to 16 hours per day. There will also be a small office
building, maintenance shop/storage facility(s), parking areas, and above ground fuel and oil storage
tanks. A system of haul roads would he built within the mining area around and throughout the
various cell pits. These roads would lead to the processing plant near stock piles of excavated
materials on-site.
FISCAL IMPACT:
The petitioner has paid fees in the following amounts:
Excavation Permit Application $ 2,000.00
Excavation Permit Fee $20,000.00
Excavation Inspection Fee $ 2,400.00
Vegetation Removal Fees $ 3,000.00
Conservation Easement App Fee $ 300.00
Conservation Easement Clearing Fee $ 800.00
Total $28,500.00
GROWTH MANAGEMENT IMPACT:
None
ENVIRONMENTAL ADVISORY COUNCIL (EAC) RECOMMENDA nONS:
On January 7,2009, the Environmental Advisory Council (EAC), by a vote of 7 to I, forwarded the
Excavation Permit Application for the Hogan Island Quarry to the BCC with a recommendation of
approval with the following stipulations:
I. The applicant must adhere to the document titled "Conditions of Approval Hogan Island Quarry,
CU-2006-AR-10805" and attached Appendix #1 "Hogan Island Dust Control Plan Rinker Materials."
2. The work area artificial lighting shall be shielded, downward-pointing (cutoff) lighting to minimize
light spillage on to adjacent properties.
3. Flashing caution lights must be posted at the east and west ends of the Immokalee Road grade
crossing of Camp Keais Strand to warn drivers of the imminent danger of panthers crossing the road.
Said lights and signs are subject to the applicant receiving the appropriate pernlits.
4. A sign must be posted on the access road in both Spanish and English (in the area where the drivers
would stack awaiting the opening of the quarry or other appropriate location) warning drivers of
panthers crossing roads in the area.

WHEREAS. the Legislalurc of the State of Florida in Chapter 67-1246, Laws of Florida,
and Chapter 125, Florida Statutes, has confcm:d on Collier County the power to establish,
coordinate and enforce zoning and such business regulations as are ne<:essary for the protection

WHEREAS, the County pursuant thereto has adopted a Land Development Code

County Planning Commission has found as a matter of fact (Exhibit . A") that satisfactory
provision and an:angement have been made concerning all applicable mattel1l required by said
regulations and in accoolance with Subsection 1O.08.00.D. of tile Land Development Code; and
WHEREAS, all interested parties have been given opportunity to be heard by this Board
in a public meeting assembled and the Board having considered all matters presented.
