EXECUTIVE SUMMARY
To approve and execute Shoreline Stabilization Grant Agreement(s) between the Collier
County Community Redevelopment Agency and a Grant Applieant(s) within the Bayshore
Gateway Triangle Community Redevelopment area. (2772 Riverview Drive)
OBJECTIVE: To approve and execute a Shoreline Stabilization Grant Agreement(s) between the
Collier County Community Redevelopment Agency (CRA) and a Grant Applicant(s) within the
Bayshore Gateway Triangle Community Redevelopment area (2772 Riverview Drive).
CONSIDERA T10NS: Annually, the Community Redevelopment Agency's Shoreline
Stabilization Grant Program is funded at a level that satisfies existing grant obligations from prior
fiscal years and future grant opportunities. The purpose of the grant program is to provide an
incentive to revitalize the area by providing a matching grant to encourage the private sector to
upgrade/rehabilitate the shoreline of waterfront property. The grant requires applicants to provide
a project cost-match of at least 50% with the remaining project dollars supported by Tax
Increment dollars generated from the CRA District. For FY 09, a total of$320,000 is budgeted for
all grant programs. From this allocation, $302,500 is available for new projects and $17,500 is
committed and due to previously approved applicants upon satisfaction of all grant stipulations.
The Shoreline Stabilization Grant application submitted by William C. King, owner of the
property at 2772 Riverview Drive, Naples Florida, 34112 was recommended for approval by the
Bayshore/Gateway Triangle Community Redevelopment Local Advisory Board.
LEGAL CONSIDERATIONS: This item has been reviewed by the County Attorney Office and
is sufficient for Board consideration and approval. This item is not quasi-judicial and therefore
no ex parte disclosure is required. This item requires a simple majority vote. (MMSS)
FISCAL IMPACT: Sufficient budget exists within the FY 09 Bayshore Gateway Triangle Fund
(187) to satisfy this new grant application. A Shorcline Stabilization Grant may fund up to 50% of
the applicant's project cost up to a ceiling of $5,000. This shoreline stabilization project totals
$28,405.00 and the grant request is $5,000 which is 17% of the estimated project cost.
GROWTH MANAGEMENT IMPACT: Policy 4.7 of the Future Land Use Element of the
Growth Management Plan states that redevelopment plans may be developed for specific areas
within the County, including the Bayshore Gateway Triangle CRA that may consider alternative
land use plans, modifications to development standards, improvements to infrastructure and
incentives to encourage redevelopment.
RECOMMENDATION: That the CRA Board approvcs and authorizes for execution the
Shoreline Stabilization Grant Agreement between the Community Redevelopment Agency and
William C. King, owner of the propeliy at 2772 Riverview Drive, Naples Florida, 34112 in the
amount of $5,000.00.

Naples Dock & Marine Services agrees to furnish all equipment, labor, materials, supervision, insurance
and applicable taxes to:
Remove and dispose of Mangroves & brush along shoreline.
Installation of (97'6") of conventional seawall to Collier county code as follows:
Prepare berm to receive new slab panels. Pre-cast new (10') long, by 6" thick slabs, Complete with
rebar both vertical & horizontal. Jet new slabs into position with minimum penetration of (5') into
berm using land based equipment.
Form and pour 12" x 20" concrete structural seawall cap using 5,OOO-PSI concrete with fiber mesh.
- Installation of (1 0) hot dipped galvanized tic back rods installed on 10' centers and sleeved in I"
polyethylene pipe to cover the rods and embedded into new 2' x 3'x 2' 5,000 PSI concrete with fiber
mesh deadmen.
Also to include (1) 5' wing wall return on East end of property.
Installation of2'French drain system consisting of Nicolan filter x cloth and backfill to grade with
%" septic stone.
City Permits and engineering are included in the costs.
$ 36,150.00
*Naples Dock and Marine Services will not be responsible for electric, water or landscaping.
Dredging, if necessary will be @ $495.00 per hour plus disposal fees.
Rock drilling, if necessary will be @ $850.00 per hour.
*Naples Dock and Marine Services arc not responsible for any further damage to wall while work is
being scheduled and/or completed. Naples dock and marine services guarantees all work performed to be
free from defects in workmanship and materials for a period of one year. Guarantee is void if seawall is
damaged by natural occurrence or deterioration Df existing portion of seawall.
Note: Naples Dock & Marine will obtain the necessary exemptions from the Department of
Environmental Protection Agency (DEP) and the Army Corps of Engineers. If DEP and Army Corp of
Engineering permits are required, owner will be responsible fDr those costs.

WHEREAS, in Collier County Ordinance No. 2002-38, the Board of County
Commissioners delegated authority to the CRA to award and administer CRA grants including
contracts with Grantees for CRA grants; and
WHEREAS, CRA Ordinance No. 08-61 reestablished the Shoreline Stabilization
I mprovemertt Grant; and

County Community Shorelirte Stabilization Improvement Grant Program (hereinafter referred to
as "Grant Pro~'Tam"), that Grantee has read the Grant Program, and that Grantee has had ample
opportunity to discuss the Grant Program with Grantee's counselor advisor. Grantee further
acknowledges to the CRA that Grantee understands and agrees to abide by all of the terms and
conditions of the Grant Program. Grantee agrees to the terms and conditions of the Grant
Program.

4, Grantee agrees to complete the construction of the shoreline stabilization
improvements within one (I) year of CRA ApprovaL Grantee also agrees to fund at least 50% of
the costs of the shoreline improvements. Grantee is prohibited from paying for any
improvements funded under this program with cash. All payments for approved projects must be
in the form ofa check or credit card drawing on funds from Grantee's accounts,

imp'rovements, the grant amount shall be reduced dollar for dollar in matching CRA funds as
determined by ratio of matching private funds required.
6. Unless prior disclosure is included in the grant application, no Grantee, or any
immediate relative of Grantee, shall serve as a contractor or subcontractor for the construction of
the shoreline improvements and no Grarttee, or any immediate ,'cIative of Grantee, shall receive
compensation for labor for the construction of the shoreline improvements. An immediate
relative of Grantee shall include mother, father, brother, sister, aunt, uncle and cousin or family
member by marriage to include mother-in-lawl father~in-Iaw, brother-in-law and sister-ill-law.
7. Grantce agrees to obtain all necessmy pc,mits from thc US Army Corps of
Engineers, Department ofEnviromnental Protection artd Collier County, Upon completion of the
work, Grantee shall submit to the CRA staff a project summary report, two (2) 8 inch by 10 inch
photos of the completed improvemcnts, a list of materials and construction techniques used, a list
of architects and/or contractors, and any other information specific to the project or rcqucstcd by
the CRA staff. The CRA, through its staff, shall confirm that the shoreline improvements were
constructed pursuant to the terms of the upplication approvcd by the CRA.
8. Within forty-five (45) days after conJinnation that the sboreline improvcmcnts
wcre constructed pursuant to the terms of the approvcd application, Grantee shall be issued a
check in the amonnt of the grant. !-lmveveI'J if Grantee fails to make the improvements pursuant
to the terms oftbe approved application, or if the project is not cOlllpleted within one (I) year of
CRA approval, or if Grantee fails to fund at least 50% of the cost of the shoreline improvements,
thc grant shall be deemed automatically revoked and Grantce shall be entitled to no funding.

No change, modification or amendment, or any representation, promise or condition, or any

11. This Agreement is personal to Grantee, and may not be assigned or transferred by
Grantee or to Grantee's respective heirs, personal representatives, successors or assigns without
the prior written consent of the CRA.
