A RESOLUTION PROPOSING AMENDMENTS TO THE
COLLIER COUNTY GROWTH MANAGEMENT PLAN,
ORDINANCE 89-05, AS AMENDED, SPECIFICALLY AMENDING
THE FUTURE LAND USE ELEMENT AND FUTURE LAND USE
MAP AND MAP SERIES, THE GOLDEN GATE AREA MASTER
PLAN, THE RECREATION AND OPEN SPACE ELEMENT, THE
IMMOKALEE AREA MASTER PLAN; THE
INTERGOVERNMENTAL COORDINATON ELEMENT, THE
CAPITAL IMPROVEMEfIIT ELEMENT, THE TRANSPORTATION
ELEMENT, THE CONSERVATION AND COASTAL
MANAGEMENT ELEMENT; AND ADDING AN ECONOMIC
ELEMEMT, AND FURTHERMORE RECOMMENDING
TRANSMITTAL OF THESE AMENDMENTS AND ADDITIONS
TO THE FLORIDA DEPARTMENT OF COMMUNITY AFFAIRS.
WHEREAS, Collier County, pursuant to Section 163.3161, et. sea., Florida Statutes, the
Florida Local Government Comprehensive Planning and Land Development Regulation Act, was
required to prepare and adopt a comprehensive plan; and
WHEREAS, the Collier County Board of County Commissioners adopted the Collier
County Growth Management Plan on January 10, 1989; and
WHEREAS, the Local Government Comprehensive Planning and Land Development
Regulation Act of 1985 provides authority for local governments to amend their respective
comprehensive plans and outlines certain procedures to amend adopted comprehensive plans
pursuant to Sections 163.3184 and 163.3187, Florida Statutes; and
WHEREAS, Collier County has prepared plan amendments to the following elements of
its Growth Management Plan:
Future Land Use Element, including the Future Land Use Map and Map Series;
Golden Gate Area Master Plan;
Immokalee Area Master Plan;
Recreation and Open Space Element;
Conservation and Coastal Management Element;
Intergovernmental Coordination Element;
Capital Improvement Element;
Transportation Element; and
Economic Element;
and
WHEREAS, the Collier County Planning Commission has considered the proposed
amendments to the Growth Management Plan pursuant to the authority granted to it by Section
163.3174, Florida Statutes, and has recommended approval of said amendments to the Board of
County Commissioners; and
WHEREAS, upon receipt of Collier County's proposed Growth Management Plan
Amendments, various State agencies and the Department of Community Affairs (DCA) have
ninety (90) days to review the proposed amendments and DCA must transmit, in writing, to Collier
County, its comments along with any objections and any recommendations for modification, within
said ninety (90) days pursuant to Section 163.3184, Florida Statutes; and
WHEREAS, Collier County, upon receipt of the written comments from DCA must adopt,
adopt with changes or not adopt the proposed Growth Management Plan Amendments, within
sixty (60) days of such receipt pursuant to Section 163.3184, Florida Statutes; and

WHEREAS, the DCA, within forty-five (45) days of receipt of Collier County's adopted
Growth Management Plan Amendments, must review and determine if the Plan Amendments are
in compliance with the Local Government Comprehensive Planning and land Development Act of
1985; the State Comprehensive Plan; the appropriate Regional Policy Plan and Rule 9J-5, Florida
Administrative Code, pursuant to Section 163.3184, Florida Statutes.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Collier County, Florida, that:
The Board of County Commissioners hereby approves the proposed Growth
Management Plan Amendments, attached hereto as Exhibit A and incorporated by reference
herein, for the purpose of transmittal to the Department of Community Affairs thereby initiating the
required State evaluation of the Growth Management Plan Amendments and new Economic
Element, prior to final adoption and State determination of compliance with the local Government
Comprehensive Planning and Land Development Regulation Act of 1985 and Rule 9J5, Florida
Administrative Code, Minimum Criteria for Review of Local Government Comprehensive Plans
and Determination of Compliance.

a. Existina oubUc educational olants and ancillary olants: The sites containina existina oublic
educational olants (schools and associated on-site facilities. includina seorts stadiums.
gymnasiums and recreation areas) and ancillary olants (suooort facilities. includina
administrative offices. transoortation facilities. maintenance yards. and bus barns) are
deoicted on the Future Land Use Mao Series. This includes four sites where educational
olants have been aooroved but construction either has not commenced or is not comoleted.
More detailed descriotions or deoictions of all of the sites containina these existina
educational olants and ancillary olants are contained in the FLUE Suoport Document.
Exoansion of these educational olants and ancillary olants on these existina sites. as well as
exoansions to the sites themselves. are subiect to the orovisions outlined in the two Interlocal
Aareements adooted in accordance with Sections 163.3177(6)(h) and 163.31777. F.S.. on
May 15. 2003 by the Collier County School Board and on May 27.2003 bv the Board of
County Commissioners. and subiect to the imolementina land develooment reaulations to be
adooted.
b. Existina sites for future oubUc educational olants: The Collier County School Board has
acauired numerous sites for which educational olants are olanned for future develooment:
these sites contain no existina educational olants. Most of these sites are consistent with
locational criteria in the FLUE. GGAMP. or lAMP. as aoolicable. and are allowed within the
existina zonina district on the orooertv: these sites are deoicted on the Future Land Use Mao
Series. As consistency is achieved for the remainina sites. via future GMP amendments
and/or zonina amendments and/or conditional use aoorovals. these sites will be added to the
Future Land Use Mao Series. Deyelooment of the maeped sites shall be subiect to the
orovisions of the two Interlocal Aareements adooted in accordance with Sections

orovided for in the two Interlocal Aareements adooted in accordance with Sections
163.3177(6)(h) and 163.31777. F.S.. on May 15. 2003 by the Collier County School Board
and on May 27.2003 bY the Board of County Commissioners. Future develooment of these
sites will be subject to the orovisions of the two Interlocal Aareements. and subject to the
imolementina land develooment reaulations to be adooted. Durina the consistency review
orocess orior to site acauisition. as set forth in the Interlocal Aareements. Collier County will
orovide notification to imoacted orooerty owners. All oublic commentary received as a result
of these notices will be orovided to the Collier County School Board.
e. Zoning district orovisions for future educational olants: Exceot to the extent that such would
be in conflict with the Rural Frinae Mixed Use District adooted on June 19. 2002. all future
educational olants shall be allowed in zonina districts as follows:
(1) Educational olants are orohibited in the Residential Tourist (RT)' Golf Course (GC).
Conservation (CON). Travel Trailer Recreational Vehicle Camoaround (TTRVC).
Business Park (BP). and Industrial (I) zonina districts.
(2) Educational olants are oermitted by riaht in all other zonino districts. However. for a hioh
school facility to be located in any residential zonina district or residential comoonent of a
PUD. a formal comoatibility review and determination is reauired. as set forth in the
Interlocal Aareements adooted in accordance with Sections 163.3177(6)(h) and
163.31777. F.S.. on May 15. 2003 by the Collier County School Board and on May 27.
2003 by the Board of County Commissioners.
f. Zonina district orovisions for future ancillary clants: Exceot to the extent that such would be in
conflict with the Rural Frinae Mixed Use District adooted on June 19. 2002. all future ancillary

the reauirements of Chaoter 163 F. So. which can utilize tax increment financing.

The Land Develooment Code shall be amended so that existina residential
neiahborhoods and commercial or industrial develooments can reauest a
Community Plannina Process. This orocess will be a means bv which citizens
can receive assistance to imorove or redeveloo their neiahborhoods. and will
include an aoolication orocess. timeframe. scooe of oroiect. and funding issues.
Obiectlve 2.2
In order to increase land use diversity. mobility and reduce traffic conQestion. the County
should reauire as oart of its technical evaluation on all PUD zonina subiect to Section
2.7.3.4 (Sunsettina PUD Master Plans) that a oroiect demonstrate interconnectivity
internallv. to neiahborina develooments, and to the external roadway system.

All rezoninas reviewed under Section 2.7.3.4 (Sunsettina PUD Master Plans)
shall incoroorate modifications. as necessary. to locate new aated entries away
from maior roads: decrease the number of housina units behind aates with a
sinale ooint of access to a oublic road: shorten block lenaths: increase
connectivity within neiahborhoods and to adioinina neiahborhoods: create
neiahborhood centers or focal ooints. such as neiahborhood oarks. within
walkable oortions of neiahborhoods: increase connectivity of local streets: and

must include the followino comoonents. as aoorooriate: sidewalks. bike oaths.

Policy 3.1.2
Buildinas on Great Streets should be taller than one stOry. and should have

develooment alona maior corridors to convert to mixed-use neiahborhood centers.
Policy 3.2.1
Collier Countv. in coniunction with orooertv owners and commercial businesses.
will orovide community olannina assistance to redeveloo commercial corridors

The purpose of this provision subdistrict is to encourage the development of Traditional
Neighborhood Design (TND) projeots a mix of residential and commercial uses at a
neiahborhood scale to serve surroundina neiahborhoods with needed commercial uses.
+NG& Mixed Use NeiQhborhood Centers are typically human-scale, pedestrian-oriented,
interconnected residential neighborhood projects that are centered around a village
green with a mix of commercial uses including retail, office, and civic amenities that
complement each other. Residential uses are often located above retail uses. A grid
pattern is the basis for the transportation network. The main street component af-tAe
+N9 is appropriately integrated in the TND and sized in proportion to the scale of the
project with :::l m:::lximum of 15 acres of mixed use residential/commercial permitted.
Standards An overlay district &Aa# will be developed in the Land Development Code
wRiGR that will regulate access, permitted uses, square footage and/or acreage
thresholds, lot frontage dimensions, street widths, setbacks, maximum block size to
insure that it is walkable in scale, buildinQ coveraae and other standards that are integral

Pursuant to Rule 9J-5.0055(6)la)3.. F.A.C. and the Urban Infill and Urban
Redevelooment Strateav contained in the Future Land Use Element of the GMP. the
South U.S. 41 Transoortation Concurrency Exceotion Area (TCEA) is hereby
desianated. Develooment located within the South U.S. 41 TCEA (MaoTR-4) shall be
exemot from transoortation concurrency reauirements. so lona as imoacts to the
transoortation system are mitiaated usina the orocedures below.

reduce the LOS on Florida Intrastate Hiahwav System (FIHS) roadways within the
County bv more than 5% of the caoacity at the adooted LOS standard must meet the

reduce the LOS on FIHS roadways within the County bv less than 5% of the caoacity at

encouraae comoact urban develooment where an intearated and connected network of
roads are in olace that orovide multiole. viable alternative travel oaths or modes for
common trios. Performance within each TCMA shall be measured based on the

Element. The followina Transoortation Concurrency Manaaement Areas are desianated:
1 Northwest TCMA - This area is bounded by the Collier - Lee County Line on the

Pollcv 5.8
Each TCMA shall maintain 85% of its lane miles at or above the LOS standards
described in Policies 1.3 and 1.4 of this element. If any Traffic Imeact Statement (TIS)
for a orooosed develooment indicates that fewer than 85% of the lane miles in a TCMA
are achievina the LOS standards indicated above. the orooosed develooment shall not
be oermitted where such condition occurs unless modification of the develooment is
made sufficient to maintain the LOS standard for the TCMA. or the facilities reauired to
maintain the TCMA LOS standard are committed utilizina the standards for committed
imorovements in Policy 1.5.3 of the Caoitallmorovement Element of the GMP.
Policv 5.9
Should the TIS for a orooosed develooment reflect that it will imoact either a constrained
roadway link and/or a deficient roadway link bv more than a de minimis amount (more
than 1 % of the maximum service volume at the adooted LOS)' yet continue to maintain
the established oercentaae of lanes miles indicated in oaraaraoh 1. above. a
oroportionate share payment oursuant to Rule 9J-5.0055(9t F.A.C. shall be reauired as
follows:
a. Prooortionate share oayments shall be calculated usina the formula
established in Rule 9J-2.045(2)(h). F.A.C. with credit for the full recovery rate of imoact
fees in effect at that time. The facility cost for a constrained roadway link shall be
established usina a tvoical lane mile cost as determined bv the Collier County
Transoortation Administrator of addina lanes to a similar area/facilitv tvoe as the
constrained facilitv.
b. Prooortionate share oavments shall be utilized by Collier County to add trio
caoacity within the imoacted TCMA. road segmenHs) and/or to enhance mass transit or
other non-automotive transoortation alternatives. which adds trio caoacitv within the
imoact fee district or adioinina imoact fee district.

Policy 2.2:
Deficiencies or potential deficiencies that have been determined through the Annual
Update and Inventory Report on capital public facilities may include the following
remedial actions: establish an area of significant influence for roads, TCEA. TCMA. add
projects to the Capital Improvements Element. enter into a bindina commitment with a
Develooer to contribute orooortionate share fundina as orovided for in Policv 5.9 of the
Transportation Element. or to construct the needed system wide facilities or defer

development until improvements can be made or the level of service is amended to
ensure available capacity.
Policy 2.3:
Continue the Certificate of Adequate Public Facility Adequacy regulatory program, which
requires the certification of public facility availability prior to the issuance of a final local
development order.

The Naples Airport Authority developed an airport noise compatibility plan under the
guidelines of the Federal Aviation Regulation, Part 150. This plan included identifying
noise contours at the ~ 65,70 and 75 Ldn (day-night average sound level). The
Airport Noise Area Overlay shown on the Future Land Use Map reflects the 60 e& Ldn
contour, the least severe impact of these ~ four noise contours. Residential and
other noise sensitive land uses are considered "normally unacceptable" in areas
exposed to levels between 60 e& Ldn and 75 Ldn. This Overlay is informational and has
no regulatory effect. However, the Land Development Code contains an Airport Overlay
District, which regulates development near the Naples Municipal Airport.
