EXECUTIVE SUMMARY
Recommendation to approve Change Order No. 1 to Professional Service
Agreement No. 07-4133 in the amount of $120,460.20 with PB America, Inc., for the
design of Northbrooke Drive improvements from the northern terminus of the
Bridge to Mill Creek Road and Valewood Drive Extension from Immokalee Road to
Autumn Oaks Lane, Project No. 60106.
OBJECTIVE: To receive Board approval of the negotiated Change Order No. I for
Engineering and Permitting Services, in the amount of $] 20,460.20, to be provided by
PB America Inc., for capacity improvements to Northbrooke Drivc and Valewood Drive
Extension, Project No. 60106.

CONSIDERATION: Improvements to Northbrooke Drive, ITom the northern terminus
of the Bridge to Mill Creek Road and Valewood Drive Extension from Immoka]ee Road
to Autumn Oaks Lane, Project No. 60]06, are currently being designed to widen
Northbrooke Drive to four lanes from just north of the bridge to approximately 500' north
of the intersection with Oakes Boulevard. There is also a fourth (southern) leg being
added to the intersection of Immokalee Road with Valewood Drive and connecting
Autumn Oaks Lane. Change Order I is necessary to extend the project limits on
Northbrook Drive by 500' including utility relocation design for the PUED ]2" water-
main and force-main and Phase] contamination assessment at the 7-11 Service Station.
Associated with the extension of Valewood Drive, is providing a 400' westbound left
turn lane on Immokalee Road; providing improved driveway access for the First
Congregation a] Church, as well as, revisions to the storm water management design and
permitting.
The scope changes as outlined in the Change Order Contract (attached) are consistent
with the intent of the original project scope with the cxception of the Phase ]
contamination assessment, which is an unanticipated occurrence. During the recent
Bridge construction at Northbrooke Drivc under the Immokalee Road Design/Bui]d
project, it was discovered that thc 7-1 ] Service Station underground storage tanks may be
leaking into the ground water. A Phase I contamination assessment is needed to
determine if any contamination has spread into the County right-of-way that could affect
the roadway construction.

The scope changes that are being requcsted will add sidcwalk continuity within the
existing residential and commercial community as well as provide increase turn lane
capacity on Immoka]ee Road at Valcwood Drive. County Public Utility Engineering
Department requested to partner with the roadway projcct to add capacity to their existing
service within the project limits. This change order will provide a cost benefit to the
County as both projects can be donc undcr onc construction contract without going back
to reconstruct the roadway to add the utilities.

FISCAL IMPACT: Funds in the amount of $116,724.20 are available within the
Transportation Supported Gas Tax Fund and Road Impact Fee Funds. Funds in the
amount of $ 3,736.00 are available in water capital fees. Source of funds are in gas tax
impact fees and water capital fees.
LEGAL CONSlDERA nONS: This item has been reviewed and approved by the
County Attorney's Office, is not quasi-judicia] and requires no ex parte disclosure,
requires only a majority vote for approval, and is otherwise legally sufficient for Board
action.-SRT
GROWTH MANAGEMENT IMPACT: The project is currently identified on the
Capita] Improvement Plan as cm 71 and is consistent with the Growth Management
Plan.
RECOMMENDATION: That the Board of County Commissioners approve Change
Order No. I to Professional Services Agreement No. 07-4133 with PB America, Inc., in
the amount of $] 20,460.20 for design and engineering services for roadway and capacity
improvements to Northbrooke Drive and Valewood Drive Extension, and authorize the
Chairman to execute the Change Order on behalf of the County.

Contracts: If the change exceeds 10% of the current BCC amount, then BCC approval is required. If the
change is equal to or less than 10%, the change is reported to BCC by the purchasing department.
CCNA Work Orders: For all work orders where the change does not exceed 10% or $10,000 of the original
work order amount, these changes are reported by the Purchasing Department to the BCC administratively.
Changes to these work orders that exceed those thresholds require prior BCC approval.
NON-CCNA Work Orders: If the change exceeds 10% of the current BCC amount, then BCC approval is
required. If in doubt, contact your contract specialist. For more specific information regarding work order
thresholds, please refer to the Procurement Administration Procedures, Section IV.3.d.
Categories of Change Orders
1. Planned or Elective: Include, but not limited to, work or actions generally identified or referenced in the
agreement, but not specifically authorized or elected at the time of contract execution. Examples include, but
are not limited to:
. Implementing phased scope or tasks that are contingent upon the outcome of preceding work
(performed within or apart from the agreement) or that are pending budget appropriations.
. Selectively implementing direct purchase procedures for the purpose of legitimately avoiding the
incurring of state sales tax (and other taxes) where permitted by law or applicable administrative code.
. Granting increases and/or decreases in costs/prices that are generally permitted or specifically
contemplated under the terms of the agreement.
2. Unforeseen Conditions: Include, but not limited to:

must be changed to remedy errors in the contract documents that have a material impact on the delivery of the
work. In instances where an independent third party is responsible for the errors (e.g.; design professional), the
project manager and the contract specialist shall seek recovery of the appropriate portion of any resulting
additional costs from the responsible party(ies).

Additional Final Design Services
Project No. 60106
The CONSULTANT has been retained to provide additional engineering services
associated with completion of the final design phase for the Northbrooke Drive
WideningN a]ewood Drive Extension project not included in the original design scope of
services. These additional services are based on various design and permitting revisions
requested by the COUNTY Transportation Engineering & Construction Management
Department (TECMD) and Public Utilities Engineering Department (PUED) to address
unforeseen issues and re-design related to alignment and typical section changes to
Valewood Drive; revised Valewood Drive stormwater treatment pond layout design;
driveway access changes associated with the 1;t Congregational Church site
modifications; revised Valewood Drive and Immokalee Road intersection and signa]
design; added left turn and median opening along Northbrooke Drive; additional interface
connection coordination for the designlbuild Northbrooke Drive bridge at the Immokalee
Road intersection; extension of project limits an additional 400 feet on lmmokalee Road
east of the newly proposed Valewood Drive intersection and an additional 500 feet on
Northbrooke Drive; all associated plan revisions with the re-submittal of the 60% plans
package; separate plans into two separate sets; and utility relocation design for the PUED
12' water main in conjunction with the Northbrooke Drive ExtensionlValewood Drive
Extension project.
In a letter dated November ]4, 2007, the CONSULTANT was notified that there was
scope overlap with the Immokalee Road Design-Bui]d Project (66045). The
CONSULTANT was given an estimate of the credit for the scope change and is expected
to include this credit with this change order.
Thc CONSULTANT is currently providing final design engineering services for the
preparation of final construction documcnts associated with the widening of Northbrooke
Drive from approximately 150 [(lot north of the Immokalee Road intersection to the new
terminus at the Mill Creek Road intersection and the addition of a fourth (southern) leg to
the intersection of Valewood Drive extension to provide a new connection at Autumn
Oaks Lane. The CONSULTANT has been retained for additional engineering services
related to providing comprehensive design and permitting for the improvements
previously provided in the submitted 60% plans and the newly requested revisions
described in this Change Order No.1 scope of serviccs.
The CONSULTANT's additional services scope of services shall include the following:
data collection; roadway analysis and design; revised roadway plans; drainage analysis
and design; revised stormwater treatment pond design; revised drainage plans;
permitting; additional permitting coordination with the South Florida Water Management
District for Environmental Resource Application; revised trat1ic control plan; additional

topographical surveys; geotechnical investigations; Northbrooke Drive phase I
contamination assessment; revisions to the signing & pavement marking plans; revisions
to the signalization plans; water/sewer design, plans, and permitting; revised quantities
and engineers estimate; and revised design documentation..
A. 60% Resubmittal Design Review Meeting
The CONSULTANT shall meet with COUNTY staff immediately following receipt
of the Notice to Proceed for this change order. The participants in this meeting will
include the CONSULTANT'S Project Manager and any other of the
CONSULTANT'S staff that is deemed necessary. The CONSULTANT will re-
submit the 60% design plans based on review comments received October 23, 2008
and November 6, 2008. This submittal shall occur not less than 14 calendar days from
Change Order No. I Notice to Proceed. The CONSULTANT will provide an initial
bar chart schedule and monthly updates as requested by the COUNTY Project
Manager. The COUNTY will also explain the financial administration of the
contract.
B. Data Collection
Immediately following the Advance Notification, the CONSULTANT shall update
and obtain additional data not collected during the current Design Phase needed for
completion of the revisions described in this Change Order agreement to the final
design scope of services. This activity consists of collecting additional information
relative to engineering, environmental, traffic, and various COUNTY departments
concerns. The information shall include all data necessary for final design,
permitting, and the preparation of the construction documents required for completion
of the Northbrooke Drive WideningNa]ewood Drive Extension project.
] . Meetings with Countv Departments
The CONSULT ANT shall meet and coordinate with the appropriate COUNTY
Departments for modifying the previously developed design, permitting
strategies, added design elements, addressing specific COUNTY department
needs, and the requirements for the design phase submittals.
2. Design Phase Field Reviews
Fie]d reviews shall be performed by the CONSULT ANT prior to the 60% re-
submittal and subsequent Construction Plans submittal to perform data collection,
coordinate with the permitting agencies for the newly designed elements, access
added design and permitting elements, and review topographic features for the
preparation of the final design documents.

The CONSULTANT shall perform additional topographic surveys to augment the
design survey information previously collected to include the extended project
limits and the added/modified design elements described in this Change Order no.
] scope of services in accordance with the original design agreement provisions
for work.
Revised legal descriptions & sketches with ROW maps as required shall be
provided for the re-design of the Northbrooke Drive alignment and
reconfiguration of the proposed storm water treatment pond. All associated ROW
mapping activities shall be in accordance with the original design agreement
requirements and COUNTY standards.
4. Utilities Impacts/Subsurface Utilitv Engineering
Update the previous investigation of existing and proposed private, other public
and COUNTY utility services within the improvement project limits that were
extended to include the added/modified design elements described in this revision
for the final design phase.
The CONSULT ANT shall provide subsurface utility locates in accordance with
the original design agreement scope of services to Change Order the previously
performed locatcs included in the 60% plans submittal. Subsurface utility ]ocatcs
will be provided as required within the extended project limits and
added/modified design elements described in this Change Order no. I scope of
servIces.
5. Permitting Requirements
CONSULTANT shall update the requirements for the added design elements,
including SFWMD, DEP, and any other required permits. CONSULT ANT shall
contact or meet with the applicable agencies as necessary to determine final
permit and the added/modified design elements. At the 60% plans submittal the
CONSULTANT shall demonstrate that the plans have been submitted for an ERP
with RA] expected 30 days from submittal.
C. Re-submit 60% Plans Package
1. Re-Submit 60% Plans Package
a. The CONSULTANT shall add/modify the elements described in this scope of
services with the re-submitta] of the 60% roadway and drainage plans, signing
& pavcmcnt marking plans, and signalization plans. The CONSULTANT
shall separate the previously submitted 60% plans into two separate plans
sets- one for the Northbrooke Drivc Widening and one for the Valewood
Drive Extension roadway improvement locations.

a. The CONSULTANT shall provide any additional coordination with the
Northbrooke Drive Bridge designlbui]d consultant for the interface with the
proposed Northbrooke Drive widening improvements.
b. A new median opening along Northbrooke Drive with a southbound left turn
lane shall be added at the intersection with Oakes Bou]evard.
c. The project limits along Northbrooke Drive shall be extended to the
intersection at Mill Creek Road to include the required curb replacement,
milling and resurfacing, and sidewalk improvements.
d. The CONSULT ANT shall modify the associated roadway plans, profiles,
drainage plans, cross sections, driveway sections, traffic control plans, utility
adjustment plans, signing & pavement marking plans, quantities, and
engineers estimate.
3. Revise Valewood Drive Extension Roadwav Design
a. The CONSULTANT shall provide additional coordination with the adjacent
I" Congregational Church site development consultant for the driveway,
drainage, and shared slope/landscaping easement interface with the proposed
Va]ewood Drive Extension and Autumn Oaks Lane improvements.
b. The driveway connection to the ] st Congregational Church site development
on Autumn Oaks lane shall be modified to be compatible with the final site
design plans.
c. Typica] section elements for Va]ewood Drive shall be modified as requested
by the COUNTY TECM for sidewalk, gravity wall, and hand railing locations
and as required for the reconfiguration of the adjacent stormwater treatment
pond.
d. The Valewood Drive extension alignment shall be revised by the
CONSULTANT to provide an acceptable skew across the lmmokalee Road
intersection with removal of the previously proposed southbound left turn lane
at the existing Va]ewood Drive north leg. The north leg Valewood Drive
median improvements shown in the 60% plans shall also be eliminated and
removed from the plans. The revised ROW requirements shall also be
identified and provided to the COUNTY.
e. Based on the revised Va]ewood Drive Extension alignment described above,
the CONSULTANT shall revise the intersection design, ADA curb ramps,
pedestrian features, and signa] mast arm locations at the intersection with
Immoka]ee Road.
f. The CONSULTANT shall modifY the associated roadway plans, profiles,
drainage plans, cross sections, driveway sections, traffic control plans, utility
adjustment plans, signing & pavement marking plans, signalization plans,
quantities, and engineers estimate.
4. Reconfigure Storm water Treatment Pond 800

a. The CONSULT ANT shall re-configure stormwater treatment pond 800
located adjacent to the Valewood Drive Extension roadway segment. The
pond shall be designed to provide a more curvilinear shape and located further
south of the frontage along Immoka]ee Road.
b. All required pond sizing and stormwater treatment modeling and calculations
shall be modified by the CONSULT ANT for the 60% Plans Re-submittal.
c. The previously prepared drainage documentation associated with the ERP
permit application shall be modified to include the pond site re-design and
Valewood Drive Extension roadway revisions.
d. Wetland impact assessments shall also be updated based on the pond 800 re-
configuration and included as required with the 60% re-submittal and ERP
permit application.
e. The CONSULTANT shall modify the associated pond plan. pond detail sheet,
pond structure details, pond cross sections, quantities, and engineers estimate.
D. Water/Sewer Relocation
The COUNTY PUED department desires to add water utility system relocations with the
proposed roadway improvements within the Northbrooke Drive Widening road corridor.
The utility adjustments necessary to accommodate the roadway improvements include the
rclocation of an existing ] 2" water main along Northbrooke Drive and provide a new
connection in the median to the 12" water main on Oakes Boulevard.
The CONSULTANT will perfoml certain engineering design, permitting, bid and
construction phase services associated with utility adjustments for the Northbrooke Drive
Widening from approximately 150 foot north of the ]mmoka]ee Road intersection to the
new terminus at the Mill Creek Road intersection.
1. Preparation of Utilitv Relocation Plans
This task consists of the preparation of utility adjustment plans for water
adjustments to the existing COUNTY water mains within the project limits of
Northbrooke DriveN alewood Drive Extension project. The utility relocation
plans will be prepared utilizing the 60% and 90% design drawings for the
roadway project as the base information. It is assumed that all available
information concerning the location of existing underground utilities will be
provided by the COUNTY in the form of as-built drawings, data, etc. This does
not preclude the CONSULTANT from obtaining the necessary subsurface utility
locates. Tasks provided by the CONSULTANT consist of the following.
. Prepare preliminary utility adjustment plans utilizing the design/construction
drawings for the Northbrooke Drive Widening/ Valewood Drive Extension
roadway improvement project.

. The CONSULTANT will attend a maximum of Two (2) meetings with the
COUNTY to obtain design information.
. Submit the preliminary design for review and approval of proposed design
concepts. CONSULTANT shall not proceed until the COUNTY has approved the
preliminary design.
. Incorporate written comments for the preliminary and final design phases
provided by the COUNTY.
. Prepare technical specifications based upon the COUNTY standards and technical
specifications.
. De]ineation for the removal of facilities will be illustrated on the plans.
. Prepare a cost estimate for the proposed utility relocation and removal.
. The CONSULTANT will prepare Traffic control plans to facilitate the
construction of utilities or ensure that the design and phasing is consistent with
the roadway TCP plans.
. Submit the final Utility Relocation plans, technical specifications, and cost
estimate to the COUNTY.
. A maximum of three (3) meetings with the COUNTY to review the preliminary
and final utility adjustment plans.
. The CONSULTANT will design the maximum spacmg for any fire hydrants
along this project per the COUNTY's code.
2. Regulatorv Permitting
This task consists of the preparation and submittal of the forms and documents that
are required for obtaining construction permits/approvals from the F]orida department
of Environmental Protection (FDEP).
. Preparation and submittal of a "Request for Approva] to Place a Water
Transmission System of Operation (DEP form 62-555 (7)) to the FDEP. It is
assumed that the utility improvements will be tested and placed in service.
. Respond to questions/comments raised by each agency as a result of their review
of the permit applications. The scope of this effort is limited to responding to one
set ofreview questions/comments from each agency for each permit.

The CONSULTANT shall provide a complete Phase I Environmenta] Site Assessment
for the potential contamination along the Northbrooke Drive Widening as described in
the attached "Phase] Environmental Site Assessment for Northbrooke Drive" scope of
services upon the COUNTY's authorization and request.
