ADVISORY BOARD MINUTES OF THE APRIL 2, 2019 MEETING
The meeting of the Bayshore/Gateway Triangle Community Redevelopment Advisory
Board was called to order by Chairman, Maurice Gutierrez at 6:03 p.m.
I. Roll Call: Advisory Board Members Present: Maurice Gutierrez, Camille Kielty,
Dwight Oakley, Steve Main, Karen Beatty, Michael Sherman, Al Schantzen and
Larry Ingram.
CRA Staff Present: Sean Callahan, Executive Director of Corporate Business
Operations; Tami Scott, Senior Project Manager; Shirley Garcia, Operations
Coordinator.
II. Pledge of Allegiance: The Pledge of Allegiance was led by Chairman Gutierrez.
III. Adoption of Agenda: Maurice Gutierrez added to the agenda under community
/business presentations under 5a. Bill Drackett, CAPA Cultural. Steve Main
made a motion to adopt the agenda as amended. Camille Kielty seconded the
motion, passed unanimously.
IV. Approval of Minutes: Karen Beatty made a motion to approve the minutes as
written. Seconded by Steve Main, passed unanimously.
V. Community / Business - Presentations
A. Bill Drackett, CAPA Cultural- Maurice Gutierrez wanted to recap the
Joint BCC workshop for the CRA Board Members and Community about
the suggestion to turn the 17acre site into green space and a cultural center.
He said the 4 Commissioners were very receptive to the idea and he invited
Mr. Drackett if anyone had any questions for him. Mr. Drackett explained
they do have world renowned designers of Cultural Centers on board,
embracing all aspects of the arts. He had been working with Laura Burns
from the United Arts Council to team up. Ms. Kielty asked about the next
steps on the timeline. Mr. Drackett responded the number of seats in the
center and about what the current trend would be would have a major factor
in that. Right now, a multi-purpose space would be one of the aspects and
a lot of vibrant things going on is another aspect for the long-range success.
Ensuring that there is a variety of arts programs that would bring folks in
and keep their interests up enough to keep them coming back. He stated
the timeline would all be dependent upon a business plan being able to
keep it thriving and alive. Mr. Drackett wanted to point out how they could
be good stewards on the property keeping the green space, creating a
parking lot that could be used on other days of the week. Ms. Kielty
inquired if CAPA received a stamp of approval today for instance, to move
forward what would be the time frame from start to finish to be completed.
Mr. Drackett stated it would be very difficult to answer but assuming all
the funding was there, and the County approved all the site plans about a
year and a half. Steve Main wanted to remind everyone that there must be
an RFP that has to go out and all offers have to be reviewed and brought
forward understanding the Community does not want residential built on
that site. Sean Callahan stated that they would not have to go out as a
competitive bid but that they would have to bring back all offers to the
BCC after it was open for a period of time for a final decision. Mike
Sherman wanted to bring up that he is not comfortable making a motion to
move forward at this point until they have studied this a bit more and
evaluate all of the options to include Parks and Recs Department for a
partnership of some sort. Karen Beatty brought up what the Community
wanted in the survey that was sent out and the Cultural Center and green
space was the 2 most important items on the responses. Ms. Beatty thinks
the Cultural Center should abut the water side of the site and not give all
the water to FGCU. Al Schantzen brought up some concerns that if the
land was donated that the CRA not have reoccurring costs for maintenance.
Ms. Kielty wanted to consider FGCU request to have the land donated to
them, or at least have them come back to speak on the matter. Ms. Kielty
wants to explore the FGCU request and hear more about how they could
still use the site.
VI. Other Agency’s:
A. Collier County Sheriff’s Department: Cpl. Gibson shared some details
about their upcoming bike light event. She will send us some information
as it gets closer. Karen Beatty asked about the homeless on the 10acre site
and Cpl Gibson said she did trespass someone who came back after the
owner said he did not give permission for them to be there. Karen Beatty
asked about the CRA requesting a property owner to clear the entire site.
Cpl Gibson said many people are afraid to call in issues and they really
need the paper trail to have documentation to continue trespassing people.
Cpl Gibson brought up some concerns at the corner of Shadowlawn and
US41, there are unsecured buildings with homeless breaking in again. She
updated the speeding on Danford St. that are going to Bayview Park. The
patrol vehicles said there were a few warnings but no real bad speeding on
the street.
B. Collier County Code Enforcement: John Johnson, Code Enforcement
Investigator was available to answer questions about cases that were on the
report. Jaime French spoke on how long a demo permit can take once
issued before it expires, when there is a complaint no exotics can be within
200ft. from a residential home. He wanted to let the Board know that he
did walk the 10acre lot where the homeless was, the department will be
issuing a notice of violation to clear out all exotics which the majority of
the vegetation on the site is. He wanted to update the community on the
site plan for the parking lot of Celebration Food Park, they will ensure the
entrance and exit will be in the benefit of the Community and stay within
Code. Celebration Food Park has parking agreements but there is no way
to make the owner use those agreements. Karen Beatty brought up the
issue of parking at San Julians Taqueria, the customers are parking on the
sidewalk, on Bayshore Dr blocking one lane. Jaime French wanted to
discuss this with Fire since the business has been open, and the Building
Department has no further jurisdiction on the parking issue. Camille Kielty
wanted to bring up the house on the corner of Shoreview and Bayshore it
is only partially demo’d and Mr. French stated that they have 6 months on
the permit before it expires. Code Enforcement will wait until it expires
and if it expires take them to a hearing to force compliance.
VII. Old Business:
A. 3221 Bayshore Dr. surface parking lot- Schematic Design - Tami
Scott, Senior Project Mgr updated the CRA Advisory Board on the
parking lot project with Norm Trebilcock who is in attendance to go over
the plan. They met with Growth Management Department and had a
survey done. Ms. Scott presented some design features of the parking lot,
did an overview of the 37 parking spaces, a cut in off of Bayshore Dr
which will be for Uber or Nickel Ride drop off and pick up. There will be
2 stalls dedicated to electric cars to hook up. A lot of the design features
are what the community discussed during the Redevelopment Plan
Update that they wanted to incorporate in the parking lot. There will be a
6ft. wall on the residential side, they will try and save 2 existing trees on
the property. Larry Ingram asked about stormwater retention on the lot.
Ms. Scott showed on the design where there will be a stormwater
retention area in between the spots. Karen Beatty asked how will the
CRA staff prevent just a couple of Businesses utilizing this lot rather than
more for public use for the entire corridor. Ms. Scott went over some
ideas, but staff will still be working out a plan to be in the best interest of
the entire community and not just serve 2 businesses. There was a lot of
discussion on whether to lease the spots or sell the spots or just use it for
new businesses that does not meet parking requirements to open. Staff
will work out all the details as we get closer to the site plan approval.
Steve Main asked if there will be a charge for using the electric car
charger and Karen Beatty agrees, there should be a cost to the public and
not charged to the CRA. Ms. Scott will be asking a partnership between
CRA and MSTU to maintain the landscaping, lighting and irrigation in
the parking lot. Steve Main made a motion to look at the leasing option
and approve moving forward with the design, Dwight Oakley Second the
motion. Approved unanimously.
B. Sabal Shores Neighborhood Traffic Mgmt. Program- Tami Scott gave
a quick summary that Dan Burden will talk about traffic calming devices
in the Sabal Shore Neighborhood Focus meeting at the CRA Office April
25, 2019 5:30-6:30.
C. CBIG- Davis Community Dental Clinic- Grant extension request –
Shirley Garcia attached a one-year extension agreement for approval by
the CRA Board. Dr. Makaela Kunstler attended if anyone had any
questions. Maurice Gutierrez made a motion to approve the extension,
Karen Beatty second the motion. Approved Unanimously.
D. Office Space: Office Space – Lease termination approved March 12,
2019 BCC meeting. Steve Main stated that no one wants the CRA Office
to be in the Government Center, he made a motion to stay somewhere in
Bayshore district but not the Government Center, not conducive to what
we do. Second by Camille Kielty. Passed Unanimously. Larry Ingram
suggested to move into the plaza on the corner of Weeks and Bayshore
Dr. 2740 Bayshore Dr. There was also discussion about building an
office off of the 17acre site on the corner of Jeepers Dr and Bayshore.

IX. Staff Report:
A. Project Manager Report: Tami Scott, Senior Project Manager gave
brief highlights of the current district projects. Ms. Scott advised of the
Fire Suppression Grant Phase III, which staff received a conditional
approval, Al Schantzen asked if the community could get some designs
for the fire suppression project. Ms. Scott advised at this time it is not yet
approved so there are no designs yet, but staff will update the community
as we get approval to proceed. A couple of items that the MSTU working
on is the pagoda, going to refurbish and will highlight it at the MSTU
meeting tomorrow night. The Haldeman Creek MSTU is having a
bathymetric survey being done so we can judge how much silt there is
and if there is a need to dredge. The Courthouse Shadows is having a
neighborhood informational meeting about their new revisions to their
site plan to include residential on May 7th @ 5:30pm before the CRA
public meeting so our CRA meeting will begin promptly after at 6:30pm.

X. Communications and Correspondence:
a. Q. Grady Minor will be holding a Neighborhood Information Meeting to
discuss the redevelopment of Courthouse Shadows at 3290 Tamiami Trail
East, Folio 28750000028, PL 201880003659. Meeting is May 7, 2019 5:30
pm – 6:30 pm at the Naples Botanical Garden Buehler Auditorium.

e. Public Comments: Bob Erickson off of Bayview Dr attended to give a brief
introduction for Greg Orickson, the new owner of the Naples Boat yard off of
Bayview Drive. Ed Deeson a local artist introduced himself and gave a brief
history for his passion for the arts and very excited about the visual arts center
coming to Bayshore. Tish Dawson wanted to share some opportunities like
Community Solutions to find a solution to our homeless. Her concerns are
shuffling the homeless from one vacant lot to another, she wanted to discuss how
we can get involved with this organization like many other states are doing.

g. Advisory Board General Communications: Steve Main asked about a status on
the infill residential lots the CRA was going to revert for noncompliance of the
deed restrictions, Sean Callahan said the negotiations has stopped because they are
unwilling to continue talks on settlement amounts.

THE COPPER PROBLEM
In large quantities, copper is toxic to
plants and wildlife. Use of copper based
algaecides and anti-fouling treatments
is currently degrading water quality
locally.
COPPER IN OUR WATERWAYS
Five Collier County watersheds are
impaired for copper.
• Clam Bay
• Gordon River (Marine Segment)
• Haldeman Creek (Lower)
• Naples Bay (Coastal Segment)
• Rock Creek
A copper impairment means that the
amount of copper in the aquatic system
is causing negative impacts for fish and
other wildlife.

SOURCES OF COPPER
Aquatic biocides, such as anti-fouling
treatments on boats and pilings, fungicides,
or algaecides are the main causes of local
copper pollution.
Algaecides are used for treating algae blooms,
algal mats, and aquatic plants in community
lakes and ponds. Copper sulfate is often found
within these algaecides, thus introducing the
problem of copper into a community’s pond.
The stormwater pond in your community is part
of the larger stormwater system and is designed
to allow excess stormwater to flow from your
pond to the next connected waterway. Any
use of copper in your community impacts your
pond as well as downstream waterbodies.

IF I STOP USING COPPER, WILL I
HAVE AN ALGAE BLOOM?
Copper algaecides do NOT prevent algae
blooms. Chemical treatment kills algae and
aquatic plants, leaving the plant’s nutrients
available to feed another algae bloom.
TIPS FOR A HEALTHIER POND
• Do NOT use copper-based algaecide for
preventative pond maintenance, ever.
·Require the use of mechanical removal
or copper-free alternatives when treating
algal mats or aquatic plants in general.
• “Slow the flow” with land-based practices
like rain gardens, bioswales, and re-
directing gutters to vegetated areas.
• Use Adaptive Pond Management to reduce
chemicals and nutrients entering the pond.

ADAPTIVE POND MANAGEMENT
Ponds change month to month so treatment
methods and practices should change too;
• Cultural: Practices to reduce the amount
of nutrients entering waterways, such as;
·Use proper fertilization based on yard
size and the fertilizer formula used.
·Sweep fertilizer and grass clippings
off the sidewalk to prevent them from
entering the storm drain.
·No fertilizer within 10’ of a waterbody.
·Leave a 10’ vegetated buffer around the
pond to keep out trash and nutrients.
·Allow plant growth along lake banks
and in water to reduce nutrients, prevent
erosion, and beautify the shoreline.
• Physical: Mechanically remove plants,
and thus their nutrients, from the system.
·Use a rake or machinery to remove
floating and subaquatic vegetation.
·UV and ultrasonic technology are new
methods to control algae growth.
• Biological: The use of other organisms to
improve water quality and habitat.
·Fish stocking or beneficial bacteria
• Chemical: Only as-needed, and with the
proper chemical, dosage and application,
never as a preventative.

• Bayshore Drive Beautification Renovation:
Work order submitted for Landscape Architectural services to review and make
recommendations best practice approach to renovate existing hardscape, landscape,
sidewalks, lighting and irrigation.
• Bayshore Monument Sign Renovation:
Work order submitted for renovations to existing monument structure/ sign at the entrance to
Bayshore Drive. Renovation to include, power washing, painting of structure and roof,

HALDEMAN CREEK MSTU PROJECTS
• Bathymetric Survey and Data Review:
Humiston and Moore Engineers have been retained to provide a Bathymetric Survey of the
Haldeman creek existing conditions. The survey data will be used to compared to the 2006
/2007 post dredge information with the current conditions. The information will be used for
discussions to move forward with permitting if dredging is required.
As of 4-11-2019 All the field work has been completed, they are working on data processing
and quality control. He did indicate he may be able to send me some data this afternoon

Hello
The new development by Mattamy Homes being
built on thomasson and bayshore is the area i
am contacting you about. March 6th there was
a crew digging from the Mattamy development
thru a back gate, across pine street to a land
locked body of water. When they did this they
cut my Centurylink cable. The Centurylink tech
said they(Mattamy) did not contact No Dig( I
believe that is the name) to prevent this from
happening. Centurylink had to run all new cable
because of this. My concern is this and that they
seemed to be laying /burying a large white pipe
under the road that seemed to be connecting to
the land locked canal between the 2 streets.

KRG Courthouse Shadows, LLC has submitted formal applications to Collier County, seeking approval of a
Small-Scale Growth Management Plan (GMP) Amendment and a Commercial Planned Unit Development
(CPUD) Amendment. The GMP amendment proposes to revise language of the Activity Center Subdistrict
in the Future Land Use Element to allow an additional 12.8 units per acre within 10 acres of the
Courthouse Shadows PUD. The CPUD amendment application is a companion application to the GMP
amendment and proposes to amend the 20.35+/- acre Courthouse Shadows PUD to add a development
option to construct a maximum of 300 multi-family dwelling units.
The subject property (Courthouse Shadows MPUD) is comprised of approximately 20.35± acres, located
the southeast corner of the intersection of Tamiami Trail East (U.S. 41) and Airport Road in Sections 11,
12, 13, Township 50 South, Range 25 East, Collier County, Florida.
