A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF
COLLIER COUNTY, FLORIDA, AMENDING COLLIER COUNTY RESOLUTION
NO. 2002-141, ADOPTED BY THIS BOARD ON MARCH 12, 2002, RELATING
TO CONSTRUCTION OF A WATER LINE AND RELATED WATER FACILITIES
TO SERVICE THIRTY-THREE LOTS ALONG PRICE STREET - BAREFOOT
WILLIAMS ROAD, BY ALSO DESCRIBING THE BOUNDARIES OF THE
BENEFITED AREA BY MEANS OF A METES AND BOUNDS DESCRIPTION;
PROVIDING AN EFFECTIVE DATE.
WHEREAS, on the 12TH day of March 2002, the Board of County Commissioners adopted
Resolution No. 2002-141; and
WHEREAS, Resolution No. 2002-141 describes the entire geographic area that is to be
benefited by this potable water line project ("the benefited area") by listing each lot number and each
lot number's corresponding folio number for each lot that exists within the benefited area; and
WHEREAS, the Tax Collector requires that the outside boundary line of the benefited area
be described by means of a metes and bounds description; and
WHEREAS, this Resolution adds the description of the benefited area by means of a metes
and bounds description; and
WHEREAS, Resolution No. 2002-141 is not affected except by adding this description of the
benefited area by means of a metes and bounds description.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS
OF COLLIER COUNTY, FLORIDA, that:
1. THE BENEFITED AREA AS DESCRIBED IN RESOLUTION 2002-141 IS:
SECTION 3.01. DESCRIPTION OF PROPOSED PROJECT AND BENEFIT AREA. The
Board proposes to create the Price Street-Barefoot Williams Road Benefit Area within the
Price Street-Barefoot Williams Municipal Service Taxing and Benefit Unit to encompass the
property located in the unincorporated area of Collier County, in Section 4 North, Township
51 South, Range 26 East, and is not platted in the Public Records of Collier County, Florida.
The Benefit Area is proposed for the purpose of improving the use and enjoyment of
property by funding the construction of Water Facilities to allow for construction on the
property located therein. The description of the proposed potable water improvements is the
construction of an 8-inch potable water main, with appropriate fire hydrant(s) and
appurtenances that will be installed along Price Street from the rear of the Shops at Eagle
Creek (about 400 feet south of US 41) to Barefoot Williams Road and then north about
1,200 feet along Barefoot Williams Road to an existing 8-inch water main for an entire length
of approximately 3,800 linear feet.

2. METES AND BOUNDS DESCRIPTION OF THE BENEFITED AREA. The outer
boundary of the above-described benefited area is described by the following metes
and bounds description: Lots 2 through 11 and 29 through 35 together with Lot 26 less
and except the South 75 feet thereof, of the Unrecorded plat of Marland as depicted on
the Survey thereof by P.A. Irminger Sr. dated March 14, 1964, Being a portion of
Section 4, Township 51 South, Range 26 East, Collier County. Florida, being more
particularly described as follows:

Commence at the Northeast corner of Section 4, Township 51 South, Range 26
East, thence run N.89054'10"W. along the North line of said Section 4, to the
northeasterly corner of Lot 2 of said point being the POINT OF BEGINNING;
thence S.00057'50''W., a distance of 1,306.06 feet to a the southeasterly corner
of Lot 35 of said Unrecorded plat of Marland; thence S. 89018'20"W., a distance
of 1 ,964.61 feet to the southwesterly corner of Lot 30 of said Unrecorded Plat of
Marland; thence N.00043'08''E., a distance of 333.27 feet to the southeasterly
corner of Lot 29 of said Unrecorded Plat of Marland; thence S.89030'10"W., a
distance of 250.41 feet to the southwesterly corner of Lot 29 of said Unrecorded
Plat of Marland; thence N.44017'33"W., a distance of 104.01 feet to the
intersection of the westerly Right-of-Way line of Barefoot Williams Road and a
line 75.00 feet northerly of, when measured at a right angle to, the south line of

said Section 4; thence S.89030'1 O'W., a distance of 3.64 feet to its intersection
with the west line of the Northwest Yo of said Section 4; thence S.89026'20"W., a
distance of 329.60 feet of the northwesterly corner of the south 75.00 feet of Lot
26 of said Unrecorded Plat of Marland; thence N.Ooo44'50"E., a distance of
931.40 feet to the northwesterly corner of Lot 1 0 of said Unrecorded Plat of
Marland; thence East. a distance of 328.37 feet to the North Yo of said Section 4;
thence S.89054'10"E., a distance of 2,298.00 feet to the POINT OF BEGINNING.
Containing 3,226,467.59 square feet or 74.0695 acres, more or less.
3. RESOLUTION NO. 2002-141 IS NOT OTHERWISE AFFECTED. This Resolution does
not affect Resolution No. 2002-141 except by describing the outer boundary line of the
benefited area by this metes and bounds description.
4. EFFECTIVE DATE. This Resolution shall take effect immediately upon its adoption.
