EXECUTIVE SUMMARY
SV-2006-AR-I0482 Seasonal Investments, Inc, d/b/a Fairways Resort, represented by Tim
Hancock, AICP of Davidson Engineering, Inc" is requesting five variances for an off-
premises sign. The first variance is from Subsection 5,06,04,C.16,b.i, of the LDC which
allows a maximum sign area of 12 square feet for a double-sided off-premise directional
sign to permit an 80 square-foot off-premise sign. The second variance is from Subsection
5.06,04,C.16,b,ii, of the LDC which allows a maximum sign height of 8 feet in height above
the lowest center grade of the arterial roadway for an off-premise directionat sign to allow
a maximum sign height of 20 feet, The third variance is from Subsection 5,06,04,C.16,b,iii.
of the LDC which requires that a sign is located no closer than ten feet to any property line
to allow a sign within zero feet of a property line, The fourth variance is from Subsection
5,06.06,Z, of the LDC which prohibits any sign which publicizes an activity not conducted
on the premises upon which the sign is maintained to allow an off-premises sign. The fifth
variance is from Subsection 5,06,06,AA, of the LDC which requires that no sign shall be
placed or permitted as a principal use on any property, in any zoning district, The subject
property is located at the southwest corner of Piper Boulevard and Palm River Boulevard,
in Section 23, Township 48 South, Range 25 East, Collier County, Florida,
OBJECTIVE:
To have the Board of Zoning Appcals (BZA) consider the above-referenced Sign Variance
petition and render a decision pursuant to Section 5,06,00 of the Land Development Code (LDC)
in order to ensure that the projcct is in hannony with all applicable codes and regulations and
that the community's interests are maintained,
CONSIDERATIONS:
The requested Sign Variances are for a proposed pole sign that is to replace an existing pole sign
that was damaged during Hurricane Wilma in October of 2005, The existing sign is located on a
parcel ofland that has an off-site parking easemcnt for the hote/. The sign has becn in its prcsent
location for approximately 40 years. (Please see attachment "I" Easement Agreement.")
Research indicates that a pennit was never issued for the existing sign. As a result of a citizen
complaint, the sign is now the subject of a Code Enforcement Case that was opened on August 8,
2005, (Please see Attachment "2" Code Case Detail Number 20050590022.) The case currently
remains open, It is the applicant's desire to replace the existing sign with a similar sign in the
same location. The existing sign has a height of 25 feet and a sign copy m'ea of 108 squm-e feet.
The proposed sign is smaller than the existing sign, It has a height of 20 feet and a sign copy
area of 80 square feet.

The Fairways Resort is located in the Rcsidential Tourist (RT) Zoning District while the subject
sign is located off-site within the RSF-3 zoning district. As depickd in the aerial included in the
Staff Report, the existing sign and proposed sign are located in tbe ,,,,ne location as the off-site

parking. This location IS across the street (Piper Boulevard/Palm View Drive) from the
Fairway's Resort
On October 30,2008, the BCC approved amendments to the Sign Code. One of the amendments
allows a commercial sign such as this to be located within a residential district LDC Subsection
5.06.02 A.8, states:
"Signs for non-residential uses within residential zoning districts and as applicable to residential
designated portions of PUD zoned properties.
a, Such signs shall follow the requirements for signs within non-
residential districts, exccpt as follows:
i. llIuminated signs shall not be allowed facing residential
uses unless the non-residential use is separated from the
residential use by em arterial or collector road,
ii. Commercial signage for conditional uses within residential
and agricultural districts."
The applicant proposes a new sign to replace the existing damaged sign and is requesting a total
of five (5) Sign Variances, The requested Variances from the cun'ent Sign Code are as follows:
I, A proposed Variance from LDC Subsection 5.06.04 C.16.b.i, which allows a maximum sign
area of 12 square feet for a double-sided off-premise directional sign to pemlit an 80c!o square-
foot double-sided off-premise sign as shown on page 4 of 9 of the Staff Report.
2. A proposed Variance from LDC Subscction 5.06,04 C.16.b.ii. which allows a maximum sign
height of 8 feet for an off-premise directional sign to allow a maximum sign height of 20 feet as
shown on page 4 of 9 of the Statl Rcport,
3. A proposed Variance frOln LDC Subsection 5,06,04 C.16,b.iii, which requires that a sign is
locatcd no closer than ten feet to any property line to allow a sign within zero feet of a property
line.
4, A proposed Variance is from LDC Subsection 5,06.06 Z. which prohibits any sign which
publicizes an activity not conducted on thc prcmiscs upon which the sign is maintained to allow
an off-premises sign as shown on the aerial on page 3 of9 ufthe Staff Report.
5, A proposcd Variancc is from LDC Subsection 5JJ6,06 AA. which rcquircs that no sign shall
be placed as a pel111itted principal use on any property, in any zoning district to allow for an ofl~
premise sign as shown on the acrial on pagc 3 of 9 of the Statf Report.
FISCAL IMPACT:
Approval ofthis Sign Variance petition would have no fiscal impact on Collier Cowlty.

GROWTH MANAGEMENT PLAN (GMP) IMPACT:
Approval of this Sign Variance would not affect or change the requirements of the Growth
Management Plan.
AFFORDABLE HOUSING IMPACT:
Approval of this Sign Variance would have no affordable housing impact
ENVIRONMENTAL ISSUES:
There are no environmental issues associated with this Sign Variance,
ENVIRONMENTAL ADVISORY COUNCIL lEA C) RECOMMENDATION:
The EAC did not review this petition as they do not normally hear Sign Variance petitions,
COLLIER COUNTY PLANNING COMMISSION (CCPC) RECOMMENDATION:
The cepc heard petition SV-2006-AR-l 0482 on December 4,2008, and by a unanimous vote of
8-0 forwarded this pctition to the Board of Zoning Appeals (BZA) with a recommendation of
approval subject to the following conditions:
], A Sign Permit is required within 30 days of BCC approval of subject sign variance and
the sign shall be installed within 60 days of issuance of the sign pennit; and
2, This sign shall be exempt from the pole cover required by LDC subsection 5.06,04 C I.e.
for health, safety and welfare purposes, This means that the sign may have pole supports
instead of a pole cover (as shown in the application submittal and shown on page 4 of 9
in the Staff Report),
Because the CCPC approval recommendation was unanimous and no letters of objection have
been received, this petition has been placed on the Summary Agenda,
LEGAL CONSIDERATIONS:
The Petitioner is requesting live sign variances, Thc granting of such variances are permitted
under LDC S9.04.02.
The attached statI report and rccommcndations of the Planning Commission are advisory only
and are not binding on you. Decisions regarding variances are quasi-judicial, and all testimony
given must be under oath. The PetitIoner has the burden to prove that the proposed variances are
consistent with all the criteria sct fOlih below, and you may question Petitioner, or staff, to
satisfy yourself that thc nccessary critcria have bcen satisfied. LDC Section 9.04.02.A requires
that "based upon the evidence givcn in public hearing; and the Endings of the Planning
Commission" you "should detcnlline to thc maximum extent possible if the granting of the

variances will diminish or otherwise have a detrimental effect on the public interest, safety or
welfare." Should you consider denying the variances, to assure that your decision is not latcr
found to be arbitrary, discriminatory or unreasonable, the denial must be based upon competent,
substantial evidence that the proposal does not meet one or more of the listed criteria below.
Approval of this request requires three affinnative votes of the Board.
In granting sign variances, the Board of Zoning Appeals may prescribe the following:
1. Appropriate conditions and safeguards in confonnity with the zoning code or other
applicable county ordinances. Violation of such conditions and safeguards, when made a part of
the tenns under which the variance is granted, shall he deemed a violation of the mning code,
2, A reasonable time limit within which the action for which the variance required shall be
begun or completed or both.
Criteria for Sill" Varianees
1. There are special conditions and circumstances existing which are peculiar to the location,
size, and characteristics of the land, structure, or building involved.
2. There are special conditions and circumstances which do not result from the action of the
applicant, such as pre-existing conditions relative to the property which is the subject of the
variance request.
3. A literal interpretation of the provisions "fthe LDC work an unnecessary and undue hardship
on the applicant or create practical difficulties on the applicant.
4. The Variancc, if granted, will be the minimum variance that will make possible the
reasonable use of the land, building, or structure and which promote standards of health, safety,
or welfare.
5, Granting the Variance requested will not confer on the petitioner any special privilege that is
denied by these zoning regulations to other lands, huildings, or structures in the same zoning
district.
6. Granting the Variance will be in hannony with the intent and purpose of the LDC, and not be
injurious to the neighborhood, or otherwise detrimental to the public welfare,
7. There are natural conditions or physically induced conditions that ameliorate the goals and
objectives of the regulation, such as natural preserves, lakes, golf course, etc.
8. Granting the Variance will be consistcnt with the GMP,
The proposed Resolution was prepared by the County Attorney's Office and is legally sufficient

GROWTH MANAGEMENT PLAN (GMPl CONSISTENCY:
Future Land Use Element (FLUE): The subject properties are located within the Urban
Residential Sub-district of the Future Land Use Map (FLUM) ofthc GMP. The GMP does not
address sib'11S, it focuses on the greater issue of actual land use.
ANAL YSIS:
Section 9,04.00 of the LDe gives the Board of Zoning Appeats (BZA) the authority to grant
Variances. The Collier County Planning Commission (CCPC) is advisory to the BZA and
utilizes the provisions of Section 9.04.03.:'\ through 9.04,03.11 as general guidelines to assist in
making a recommendation, Staff has analyzed this petition relative to the evaluative criteria and
offers the following responses:
a, Are there special conditions and circumstances existing which are peculiar to the
location, size and characteristics of the land, structure or building involved?
Yes. The resort is located approximately 215 feet north ofImmokalee Road (CR 846), the
principal artcriat road serving the property. The resort is separated from Immokalee Road
by the 100-foot wide Immokalce Road canal, then a 55-foot strip of land and then the 60-
foot ",>ide Piper Boutevard/Palm View Olive, The resort is low scale and is not readily
visible from Immokalee Road.
In addition, the actual site where the sign is to be located, while not owned by the resOlt,
has an casement for parking, The si te has been in use by the resort for approximateiy 40
years for parking and a directional sign. The sign is located approximately 100 feet north
ofImmokalee Road.
b,
Are there special conditions and circumstances which do not result from the action of
the applicant, such as pre-existing conditions relative to the property, which is the
subject of the varianee rl"luest?

Yes, 1be applicant purchased the resort property in 1998, At that time, the property
located across Piper Boulevard/Palm View Drive had off-site parking and the pole sign for
the Fairway's Resort which still exists today.
c,
Will a literal interpretation of the provisions of the LDC work unnecessary and
undue hardship on the applicant or create practical difficulties for the applicant?
Yes. The applicant would be unable to replace the sign in the location that has been used
for sign age for over 40 years.
d. "'ill the variance, if granted, be the minimum variance that will make possible the
reasonable use of the land, building or structure and which promote standards of
health, safety and welfare?
The purpose of the requested Sign Variances is to allow for a larger sign than what is
pennissible by code. Howevcr, if the Conditions of Approval recommended by Staff are
followed, the reasonable use ofland is possible.
e,
Will granting the variance confer on the applicant any special privilege that is denied
by these zoning regulations to other lands, buildings, or structures in the same zoning
district?
Yes. A Variance by definition confers some dimensional relief from the zoning regulations
specific to a site. The granting of this Variance request would allow the proposed sign to
have an additional 12 feet of height and 68 square feet of sign area then what is currently
allowed by the LOC. It would also allow the proposed sign to be located 3 feet closer to
the property line than what is prescribed by the LDC, thereby conferring on the appticant a
special privilege.
f.
Will granting the variance be in harmony with the general intent and purpose of this
Land Development Code, and not be injurious to the neighborhood, or otherwise
detrimental to the public welfare?
Section 5.06,OI.A of the LDC states that the purpose and intent of the LDC relative to
signage is to ensure that all signs are:
1. Compatible v.ith their surroundings;
2, Designed, constructed, installed and maintained in a manner that does not
endanger public safety or lll1duly distract motorists;
3, Appmpriate to the type of activity to which they pertain;
4, Large enough to convey sufficient infonnation about the owner or occupants
of a particular property, the products or services available on the property, or
the activities conducted on the property, and small enough to satisfy the needs
for regulation;
5. Reflective of the identity and creativity of the individual occupants.
It is important to note that the proposed sign is smaller than the sign that currently exists
on-site. The proposed sign area is 28 square feet Jess than the existing sign. The proposed

height is 5 feet less than the existing sign. If the Conditions of Approval recommended by
Staff are followed, then the replacement sign would then be consistent with the purpose and
intent of the LDC, which is to allow a commercial business such as this to have a sign.
g.
Are there natural conditions or physically induced conditions that ameliorate the
goals and objectives of the regulation such as natural preserves, lakes, golf courses,
etc.?
Yes. There is a IOO-foot wide canal that separates the sign from lmmokalee Road (CR
846), the arterial road that services the resort site. However, the resort is not located on
lmmokalee Road. It is located at the northwest con1er of Piper Boulevard/Palm View
Drive and Palm River Boulevard.
h, Will granting the variance be consistent with the Growth Management Plan?
Yes. Approval of this Variance petition woutd be consistent with the OMp since it would
not affect or change any of the OMP's requirements.
EAC RECOMMENDATION:
The Enviromnental Advisory Council does not nonnally hear Variance petitions and did not hear
this one,
RECOMMENDATION:
Staff recommends that the Collier County Planning Commission (CCPe) forward Petition SV-
2006-AR-10482 to the Board of Zoning Appeals (BZA) with a recommendation of approval
subject to the conditions below:
1. The sign size area shall be limited to 80 square feet.
~ The sign height shall be limited to 20 teet.
3. The leading edge ofthe sign shall be located no closer than 3 feet to the Imrnokalee Road
canal property line.

REQUESTED ACTION:
The applicant is requesting a total of thrce (3) Sign Variances from Section 5,06,00 of the Land
Development Code (LDe) to permit one (1) pole sign in a Residential Zoned District.
GEOGRAPHIC LOCATION:
The subject property is located at the southwest quadrant of the intersection of Piper
Boulevard/Palm View Drive and Palm River Boulevard and is approximately 100 feet north of
Immokalee Road (CR 846) in Section 23, Township 48 South, Range 25 East, Collier County,
Florida- (See the location map on rhe following page.)
PlIRPOSEIDESCRIPTION OF PROJECT:
The rcquested Sign Variances are for a proposed pole sign that is to replace an existing pole sign
that was damagcd during Hurricane Wilma in Octobcr of2005, Thc existing sign is located on a
parcel of bnd that has J.J.~ off-site parking cascnH:nt fOi the hotel. The sign has been in its present
location for approximately 40 ycars. (Please see attachment "1" Easement Agreement.")
Research indicates tbat a permit was never issued for the existing sign. As a result of a citizen
complaint, the sign is now the subject of a Code Enforcemcnt Case tbat was opened on August 8,
2005. (Please see Attachment "T Code Case Detail Number 20050590022.) The case currently
remains open. It is the applicant's desire to replace the existing sign yv!th a sinll1ar sign in the
same location.

Jt is the applicant's desire to replace the existing damaged sign with a proposed smaller sign in
the same location, The existing sign has a height of 25 feet and a sign copy area of 108 square
feet Thc proposed sign is smaller than the existing sign, It has a height of 20 feet and a sign
copy area of 80 square feet.
The Fairways Resort is located in the Residential Tourist (RT) Zoning District while the subject
sign is located within the RSF-3 zoning district As depicted on the preceding aerial, the existing
sign and proposed sign are located in the same location as the off-site parking, This location is
across the street (Piper BoulevardlPalm View Drive) from the Fairway's Resort.
On October 30, 2008, the BCC approved amendments to the Sign Code, One of the amendments
allows a commercial sign such as this to be located within a residential district LDC Subsection
5,06,02 A.8, states:
"Signs for non-residential uses within residential zoning districts and as applicable to residential
designated portions of PUD zoned properties,
a, Such signs shall follow the requircments for signs within non-
residential districts, except a, follows:
i. Illuminated signs shall not be allowed facing residential
uses unless the non-rcsidcntial use is separated from the
residential use by an arterial or collector road,
ii, Commercial signage for conditional uses within residential
and agricultural districts"
The applicant proposes a new sign to replace the existing damaged sign and is requesting a total
of three (3) Sign Variances, The requested Variances from thc currcnt Sign Code are as follows:
L A proposed Variance from LDC Subsection 5,06,04 CLa, which allows a maximum height
of 12 feet when located along a roadway 10 allow a maximum sign hcight of 20 feet as shO\m on
the elevation on the previous page,
2, A proposed Variance from LDC Subsection 5,06,04 C I.b, which requires that a sibm is
located no closer than ten feet to any property line to allow a sign within three feet of a property
line,
3, A proposed Variance from LDC Subsection 5,06,04 CLc, which allows a maximum sign
area of 60 square feet to allow a maximum sign arca of 80 square feet as shown on the elevation
on the previous page,

GROWTH MANAGEMENT PLAN (GMP) CONSISTENCY:
Future Land. Use Element (FLUE): The subject properties are located within thc Urban
Residential Sub-district of the Future Land Use Map (FLUM) of the GMP, The GMP does not
address signs, it focuses on the greater issue of actual land use,
ANALYSIS:
Section 9,04,00 of the LDC gives the Board of Zoning Appeals (BZA) the authority to grant
Variances, The Collier County Planning Commission (CCPC) is advisory to the BZA and
utilizes the provisions of Section 9,04,03,A through 9,04,03,H as general guidelines to assist in
making a recommendation, Staff has analyzed this petition relative to the evaluative criteria and
.) offers the following responses:
a. Are there special conditions and circumstances existing which are peculiar to the
location, size and characteristics of the land, structure or building involved?
Yes, The resort is located approximately 215 feet north ofImmokalee Road (CR 846), the
principal arterial road serving the property, The resot1 is separated from Immokalee RDad
by the ] DO-fool wide Immokalcc Road canal, then a 55-foot strip of land and then the 60-
foot wide Piper Boulevard/Palm View Drive, The resort is low scale and is not readily
visible from Immokalee Road,
In addition, the actual site where the sign is to be located, while not owned by the resort,
has an easement for parking, The site has been in nse by the resort for approximately 40
years for parking and a directional sign, The sign is located approximately 100 feet north
oflmmokalee Road,
b.
Are there special conditions and circumstances which do not result from the action of
the applicant, such as pre-existing conditions relative to the property, which is the
subject of the variance request?

Yes, The applicant purchased the resort property in 1998, At that time, the property
located across Piper Bonlcvard/Palm View Drive had off-site parking and the pole sign for
the Fairway's Resort which still exists today,

undue hardship on the applieant or create practical difficulties for the applicant?

Yes, The applicant would be unable to replace the sign in the location that has been used
for signage for over 40 years,
d. Will the variance, if granted, be the minimum variance that will make possible the
reasonable use of the land, building or structure and which promote standards of
health, safety and welfare?
The purpose of the requested Sign Variances is to allow for a larger sign tr..a.9} \-"hat is
permissible by code, However, if the Conditions of Approval recommended by Staff are
followed, the reasonable use of land is possible,

Will granting the variance confer on the applicant any special privilege that is denied
by these zoning regulations to other lands, buildings, or structures in the same zoning
district?
.
Yes, A Variance by definition confers some dimensional relief from the zoning regulations
specific to a site, The granting of this Variance request would allow the proposed sign to
have an additional 8 feet of height and 20 square feet of sign area then what is currently
allowed by the LDC. It would also allow the proposed sign to be located 3 feet closer to
the property line than what is prescribed by the LDC, thereby conferring on the applicant a
special privilege,
f.
Will granting the variance be in harmony with the general intent and purpose of this
Land Development Code, and not be injurious to the neighborhood, or otherwise
detrimental to the publie welfare'!
Section 5,06,01.A. of the LDC states that thc purpose and intent of the LDC relative to
signage is to ensure that all signs are:
I, Compatible ",-jth their surroundings;
2, Designed, constructed, installed and maintained in a manncr that docs not
endanger public safety or unduly distmct motorists;
3, Appropriate to the type of activity to which they pertain;
4, Large enough to convey sufficient information about the owncr or occupants
of a particular property, the products or scrvices available on the property, or
the activities conducted on the property, and small enough to satisfy thc needs
for regulation;
5, Reflective ofthe identity and creativity of the individual occupants,

goals and objectives of the regulation such as natural preserves, lakes, golf courses,

Yes, There is a I DO-foot wide canal that separates the sign from Immokalee Road (CR
846), the arterial road that services the resort site, However, the resort is not located on
Immokalee Road, It is located at the northwest comer of Piper Boulevard/Palm View
Drive and Palm River Boulevard,
h. Will granting the variance be consistent with the Growth Management Plan?
Yes, Approval of (hi~ Variance petition would be consistent with the GMP since it would
not affect or change any of the GMP's requirements,
EAC RECOMMENDATION:
The Environmental Advisory Council docs not normally hear Variance petitions and did not hear
this one,
RECOMMENDATION:
Staff recommends that the Collier County Planning Commission (CCPC) forward Petition SV-
2006-AR-I0482 to the Board of Zoning Appeals (BZA) vlith a recommendation of approval
subject to the conditions below:

A RESOLUTION OF THE BOARD OF ZONING APPEALS OF
COLLIER COUNTY, FLORIDA, RELATING TO PETITION
NUMBER SV-2006-AR-10482, GRANTING FIVE VARIANCES
FROM SECTIONS 5,06,04 AND 5,06,06 OF THE LAND
DEVELOPMENT CODE, CONCERNING THE LOCATION OF AN
OFF-PREMISES DIRECTIONAL SIGN FOR FAIRWAYS RESORT,
WHICH SIGN IS LOCATED AT THE SOUTHWEST CORNER OF
PIPER BOULEVARD AND PALM RIVER BOULEVARD, IN
SECTION 23, TOWNSHIP 48 SOUTH, RANGE 25 EAST, COLLIER
COUNTY, FLORIDA,
WHEREAS, the Legislature of the State of Florida in Chapter 125, Florida Statutes, has
conferred on all counties in Florida the power to establish, coordinate and enforce zoning and such
business regulations as are necessary for the protection of the public; and
WHEREAS, the County pursuant thereto has adopted a Land Development Code (LDC)
(Ordinance No, 04-41, as amended) which establishes regulations for the zoning of particular
geographic divisions of the County, among which is the granting of variances; and
WHEREAS, Seasonal Investments, Inc" d/b/a Fairways Resort (Petitioner) suffered
damages to an off-premises directional sign during Hurricane Wilma in 2005, which sign was
located at the southwest corner of Piper Boulevard and Palm River Boulevard, north of the canal
adjacent to Immokalee Road; and
WHEREAS, Petitioner wishes to replace this damaged sign, which has existed at this
location for at least 41 years, with a replacement sign in the same location as the damaged sign that,
is more conforming to current commercial sign standards, which requested sign is depicted in
Exhibit "A"; and

WHEREAS, Petitioner currently holds a parking easement as recorded at OR Book 208,
Pages 17-18, of the Official Public Records of Collier County, Florida, on the property where the
sign was located, and has pennission from the fee owner of the underlying parcel, Horse Creek
Partners, LId" to erect a sign on the property as described in Exhibit "B", attached hereto and made
a part hereof by reference; and
WHEREAS, the Board of Zoning Appeals has held a puhlic hearing with due notice made,
and all interested parties have been given opportunity to be heard by this Board in public meeting
assembled, and the Board having considered the advisability of granting five sign variances as
follows:
L A variance from Subsection 5,06,04,CI6,b.i, of the LDC which allows a maximum
sign area of 12 square feet for a double-sided off-premises directional sign, to allow a
maximum sign area of 80 square feet, and
2, A variance from Subsection 5,06,04,CI6,b.ii. of the LDC which allows a maximum
sign height of 8 feet above the lowest center grade of an arterial roadway to allow a
maximum sign height of 20 feet, and
3, A variance from Subsection 5,06,04,c'16,b.iii, of the LDC which requires that a sign be
located no closer than ten feet to any property line to allow a sign within zero feet of a
property line, and
4, A variance from Subsection 5,06,06,2, of the LDC which prohibits any sign which
publicizes an activity not conducted on the premises upon which the sign is maintained
to allow an off-premises sign, and
5, A variance from Subsection 5,06,06,AA, of the LDC which requires that no sign shall
be placed or pennitted as a principal use on any property, in any zoning district,

as shown on the sign drawings attached as Exhibit "A" and incorporated herein by
reference, in the Residential (RSF-3) Zoning District for the property described in Exhibit "B"; and
WHEREAS, the Board has found as a matter of fact that satisfactory provision and
arrangement have been made concerning all applicable matters required by the LDC.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF ZONING APPEALS OF
COLLIER COUNTY, FLORIDA, that the Board hereby approves the afore-described variances
from the LDC to allow the construction of an off-premises directional sign as depicted in Exhibit
"A", as requested in Petition SV-2006-AR-10482, filed by Tim Hancock of Davidson Engineering,
lnc" on behalf of the Petitioner, Seasonal Investments, lnc" d/b/a Fairways Resort, concerning the
subject property as described in Exhibit "B", subject to the conditions of approval described in
Exhibit "C",

Fairways Motel Sign
Ms. Gundlach, Thanks for the update yesterday of the Fairways Motel sign.
As we know it has been over three years that the sign has not functioned as originally
intended. I am sympathetic to the owners situation, the sign was destroyed by a hurricane
and is expensive (probably r.o insurance on it) to replace. However the "Community Curb
Appeal" of the Palm River neighborhood has been denigrated long enough. The Collier Cou~ty
code and permit process is being exploited by the owners and rep=esentatives of the
Fairways Motel.
Our county code and permit process is usually used for a pro active business owner to
attract attention to their business. I believe, given the drawn out length of time, our
county code and permit process is being used to stall for time for the permit, purchase
and installation of a code approved replacement sign. I suggest any hearings, variances or
code compliances be cor-eluded with a strict, unwavering, no wiggle room deadline of the
installation and approved county inspection of a ~ew sign.
FYI... The Collier County Code Enforcement office ( Mr. Kitchell Snow) has a
11/30/08 compliance deadline.
A Variance Hearing sign was just posted 10/27/08 at the mo~el and ~as been scheduled
for 12/04/08,
The C.C. Board of Commissioners review is scheduled for 1/27/09.
Is the compliance deadline not enforceable? Here we go agai~ they just stalled for another
60 days. And if all goes well and is approved ~n 1/09 I'm sure the next excuse will be a
variance because the design and materials for the new pole & sign will not be available
for another six months to a year, so... see you in 2010. The Motel folks need to pre order
the new pole & sign now, just as any proactive business pe~son would do for a quick
installation, anticipating the County's approval. Does it take four years to replace a
sig~ because the wind blew it dow~?.. I g~ess only if you wa~t it to. Please stop the
manipulation of our county system and restore "Community Curb Appeal" to the Palm River
neighborhood.

My husband and I have lived in Palm River Estates for ten
years. In our opinion, the Fairways Resort is a definite
asset not only to our co@nunity but to Collier County. It
is a well maintained property and offers visitors to this
area a clean, safe, and reasonable place to stay. We have
had friends and family stay there while visiting and have
received only favorable comments,
We urge the commissioners to work with the resort in
allowing them the greatest flexibility possible for their
signage, This very important especially now that the
Immokalee expansion is completed. Traffic on Immokalee is
not only much heavier but the traffic moves much more
quickly. Without adequate signage, the resort will not be
noticed. The resort has been here for forty years, It
represents what makes Naples unique, It would be a shame to
lose such a gem, We urge you to work with the resort in
finding a equitable solution,

ing Wilma in October 2005, Denied permits
to repair the sign, the owner put a temporary
plastic covering over the sign's face.
"The people in Palm River seem to like us,
,.. We give them discounts for their families to
stay here, We might get a question about why
we haven't fixed the sign since the hurricane,
but they seem to understand the problem
we're having," Fairways manager Judy Bau,
tista said.
Palm River residents interviewed for this
story said they like the motel and don't have
any problem with its sign.
"It's a quain,t hotel. It's nice to have some
pieces of Old Naples left, I just don't know
what the big deal is, It's been there forever,"
said Diane Durante, who has lived in Palm
River for about 20 years,
The owner said surveys from his guests
indicate that 18 percent of his business comes
from people driving by and either seeing the
sign or the motel.
Code Enforcement officials said they believe
the motel could be found without the sign,
Motel managers, owners and guests disagree
and say that the sign is what brings guests into
the one-story motel.
"We want to replace the sign, We're just
concerned about the business if we can't have
a visible sign," Ivferowicz said.
Motel guest Marie Schwartz, a Miami resi-
dent, recently stayed at the motcl for three
days with friends.
"We would have been lost many times, That
_ sign was our landmark to get here on the Iirst
day and we still use it to get back, I think it's
a great place with ....vonderful people. I wish
them luck," Schwartz said,
