EXECUTIVE SUMMARY
Recommendation to approve Petition A VPLA T -2008-AR-13888, to disclaim, renounce and
vacate the County's and the Public's interest in that portion of a 20-foot wide drainage
access easement for drainage maintenance over Lot 9, Block B, as shown on the record
map known as "Palm River Estates Unit No. 7n and filed in Plat Book 12, pages 28
through 30 of the Public records of Collier County Florida and situated in Section 23,
Township 48 South, Range 25 East, Collier County, Florida, and being more specifically
depicted and described in Exhibit "An,
OBJECTIVE:
To adopt a resolution vacating that portion of a 20-foot wide access easement for drainage
maintenance over Lot 9, Block B, according to the plat of "Palm River Estates Unit No. 7" as
filed in Plat Book 12, pages 28 through 30 of the Public records of Collier County, Florida and
more specifically depicted and described in Exhibit "A".
CONSIDERATIONS:
Petition AVPLAT-2008-AR-13888, has been received by the Collier County Engineering &
Environmental SelVices Department from Karie Turrel of Nassau Pools Construction, Inc. as
agent for Dan & Dorothy G. Summers, requesting the vacation of that portion of the access
easement as depicted and described in Exhibit A. Staff has determined that even after the
vacation of the portion of the easement as described, there remains sufficient access to allow
required drainage maintenance as required by the original record plat.
Letters of no objection have been received from applicable divisions/entities.
FISCAL IMPACT:
Engineering and Environmental SelVices Department staff has collected a $2,000 "Petition to
Vacate" fee from the petitioner which covers the County's cost of recording and processing the
Petition.
GROWTH MANAGEMENT IMPACT:
There is no growth management impact associated with this Executive Summary.
ENVIRONMENTAL ISSUES:
There are no outstanding environmental issues.
HISTORICAL/ARCHAEOLOGICAL IMPACT:
There are no historical or archaeological impacts vacating this portion of easement.

This item has been reviewed for legal sufficiency and is legally sufficient for Board action. This
matter is quasi-judicial and such requires ex parte disclosure. This matter does not require a
super-majority vote. STW
RECOMMENDATIONS:
To adopt the Resolution for Petition AVPLAT-2008-AR-13888, and authorize the Chairman to
execute the Resolution and direct the Clerk to the Board to record a certified copy of the
Resolution in the Public Records and to make proper notation to the record plat as referenced
above as required by law.

A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS
OF COLLIER COUNTY, FLORIDA, RELATING TO PETITION
AVPLAT-2008-AR-13888, DISCLAIMING, RENOUNCING AND
VACATING THE COUNTY'S AND THE PUBLIC'S INTEREST IN
THAT PORTION OF A 20' WIDE ACCESS EASEMENT OVER
LOT, BLOCK B, AS SHOWN ON THE RECORD PLAT KNOWN AS
"PALM RIVER ESTATES UNIT NO. 7n AND FILED IN PLAT BOOK
12, PAGES 28 THROUGH 30 OF THE PUBLIC RECORDS OF
COLLIER COUNTY, LOCATED IN SECTION 23, TOWNSHIP 48
SOUTH, RANGE 25 EAST COLLIER COUNTY, FLORIDA, AND
BEING MORE PARTICULARLY DESCRIBED IN EXHIBIT "An.
WHEREAS, pursuant to Sections 177.101, Florida Statutes, Petitioner, Dan E. &
Dorothy G. Summers., by and through their agent, Karie Turrel of Nassau Pools
Construction, Inc., has requested the vacation of that portion of the 20 foot wide access
easement for drainage maintenance over Lot 9, Block B, Palm River Estates Unit No.7,
according to the plat thereof recorded in Plat Book 12, Pages 28 through 30 of the
Public Records of Collier County, Florida, situated in Section 12, Township 48 South,
Range 25 East, Collier County, Florida, and specifically depicted and described in
Exhibit "A";
WHEREAS, the Board has this day held a public hearing to consider Petitioner's
request, and notice of said public hearing was given as required by law; and
WHEREAS, the granting of the Petitioner's request will not adversely affect the
ownership or right of convenient access of other property owners; and
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that the County's interest in the
portion of the access easement, specifically described in Exhibit 'A' is hereby vacated,
extinguished, renounced and disclaimed and this action is declared to be in the Public's
interest and for the Public's benefit.
BE IT FURTHER RESOLVED AND ORDERED that the Clerk to the Board is
hereby directed to record a certified copy of this Resolution in the Official Records of
Collier County, Florida, and to make proper notation of this vacation on the recorded
plat as referenced above.
This Resolution adopted after motion, second and majority vote favoring same,
this day of , 2009.
