EXECUTIVE SUMMARY
Recommendation to approve and execute a First Amendment to Lease Agreement with
Overseas Development Corporation for the continued use of temporary offiec space for the
Guardian Ad Litem office during construction of the new Courthouse Annex building at
an annual cost not to exceed $14,162.63, Project 525331.
OBJEeTlVE: To provide continued temporary office space for the Guardian Ad Litem office
during construction of the new Courthouse Annex.
eONSIDERA TION: Since January 2006, the County has leased temporary office space in
Court Plaza, north of the GovemmenI Center on Airport Road, in order to accommodate the
Guardian Ad Litem office during construction of the Courthouse Annex.
The Lease is scheduled to expire in Fcbruary 2009 and the County will need to continue to lease
this office on a month-to-month basis until the COUlihouse Annex is completed.
The rent during the renewal tem1 shall be $868.22 monthly, with common area maintenance
(CAM) charges of $312.00 monthly, for a total monthly cost of S ] ,180.22.
The County will be allowed to tem1inate the lease by providing the Lessor with thirty days
advance written notice of its intention to terminate.
FISCAL IMPACT: The monthly rcnI and CAM chargcs of $1,180.22 will be paid from
County-wide Capital Projects Fund (30 I l, under the COUlihouse Almex Project number 525331.
GROWTH MANAGEMENT: There is no impact on the County's growth management plan.
LEGAL CONSIDERA nONS: The proposed First Amendment to Lease Agreement is legally
sufficient for Board action. This item is not quasi-judicial, and as such ex parte disclosure is not
required. This item requires majority votc only. - JAK
RECOMMENDA nON: That the Board of County Commissioners approves the First
Amendment to Lease Agreement with Overseas Development Corporation and authorizes the
Board Chainnan to execute same.

FIRST AMENDMENI TO LEASE AGREEMENT
THIS FIRST AMENDMENT TO LEASE AGREEMEJ\T entered into this _ day of
_._. 2009, between Overseas Development Corporation, a Florida Corporation, whose
mailing address is P,O. Box 7714, Naples, Florida 34102, hereinafter referred to as "LESSOR", and
COLLIER COlINTY, a political subdivision orthe State of Florida, whose mailing address is 3301
East Tamiami Trail, Naples, Florida 34112, hereinafter referred as "LESSEE".
WITNESSETH
In consideration of the mutual covenants contained herein, and other valuable consideration,
lhe parties a.gree as follows:
VlHEREAS, LESSOR and LESSEE have previously entered into a Lease Agreement dated December 15,
2005, and
\VHEREAS, the LESSOR and LESSEE are desirous of amending the Lease Agreement. and
NOW THEREFORE, in consideration of the covenants and agrt:ements provided within said Lease
Agreement, and Ten Dollars ($10.00) and other valuable consideration, said Lease Agreement is hereby
amended as follO\vs:
L The following provision shall be added to Article:2 of the Lease Agreement:
Following the expiration date of January ~ 4,2009, the LESSEE shall be allowt:d to remain at the
Demised Premises on a month-Io~month basis until such time that LESSEE provides LESSOR with
thirty (30) day written termination notice.
2. Except as expressly providt:d herein, the Lease Agreement between Overseas Development
Corporation and Collier County. [l political wbdivi:~;jon ufthe State of Florida, for the utilization of the
Demised Premises descrihed in said Lease Agreement dated December 15. 2005 remains in full force
