EXECUTIVE SUMMARY
Recommendation that the Board of County Commissioners accept the withdrawal of
Immokalee Disposal, Inc.'s petition for an extraordinary rate increase associated with fuel
costs.
OBJECTIVE: That the Board of County Commissioners accept the withdrawal of Immokalee
Disposal, Inc.'s petition for an extraordinary rate increase associated with fuel costs.
CONSIDERATIONS: On September 23, 2008, Solid Waste Management staff (Staff) and
Immokalee Disposal, Inc., requested an opportunity to address the Board of County
Commissioners (Board) relative to Immokalee Disposal Inc.'s petition for an increase in rates
charged for District II municipal solid waste collection. According to Immokalee Disposal Inc.
representatives, the rate increase request was due to the high cost of fuel.
As part of the executive summary and presentation, Staff recommended and subsequently
gained, authorization from the Board to (a) determine whether lmmokalee Disposa~ Inc.'s
petition had any merit; (b) prepare written recommendations concerning Immokalee Disposal,
Inc.'s petition; and, (c) present Staffs recommendations to the Board for review and approval at
a future public meeting.
On December 5, 2008, Immokalee Disposal, Inc, Operations Manager, Robert Grassi, officially
withdrew the request to petition the Board for an extraordinary rate adjustment for two reasons:
(I) the cost of fuel has decreased, and (2) Immokalee Disposal, Inc. did not wish to disclose their
financial information in detail as outlined in the Franchise Agreement for District II. Acceptance
of this withdrawal will close this issue and require no further action.
FISCAL IMPACT: There is no fiscal impact.
LEGAL CONSIDERATIONS: This item is legally sufficient for Board action. - JAB
GROWTH MANAGEMENT IMPACT: There is no impact on the County's Growth
Management Plan.
RECOMMENDATION: Recommendation that the Board of County Commissioners accept the
withdrawal of Immokalee Disposal, Inc.'s petition for an extraordinary rate increase associated
with fuel costs.

Thank you for advising me of your decision to rescind your request for a rate increase
associated with our contract with you.
As for considering future amendments to our existing contract, please contact Joe Bellone or
me to discuss your specific requests. We are always available and ready to sit with you and
your team to ensure our contractual arrangements are fully executed and managed to best
value. If you prefer us to come to Immokalee at any time, we are more than happy to do so.
I appreciate your time and commitment to ensure high level solid waste services in District
II. Additionally, thank you and your staff for all your hard work implementing our shared
Single Stream Recycling Pilot Project. I have heard very good things about you and your
team's efforts.

Dan,
I wanted to update you on our request for an Extraordinary Rate Adjustment. Immokalee
Disposal - A CHOICE company will at this time no longer pursue our request for an
Extraordinary Rate Increase. However, we would like the same consideration as District I to
include a provision in the contract to allow adjustments based on future increases in the
cost of fuel. Please keep me informed of any developments in this regard.
I appreciate you and your staffs' hard work and professionalism during these arduous
discussions and negotiations.
