Agenda 01/27/2009 Item #10F Agenda Item No.1 OF January 27, 2009 Page 1 of6 EXECUTIVE SUMMARY Recommendation that the Board of County Commissioners provide the County Manager, or designee, guidance as to how to enforce the approved sign code amendment and regulations as codified in the Collier County Land Development Code for the geographical area of Immokalee. OBJECTIVE: To provide additional information to the Board of County Commissioners (BCC), related to the open Code Enforcement Sign Cases in the lmmokalee Community, and to seek the guidance of the Board as to how to proceed with the enforcement of the provisions as defined in the Collier County Land Development Code. CONSIDERA nONS: During the regular meeting of the Board of Counly Commissioners on January 13, 2009 under Item 15, Staff and Commission General Communications, County Manager Jim Mudd informed the Board of the approximately 80 sign code cases in the Immokalee community and in doing so asked the Board for general guidance as to how to proceed related to the enforcement and prosecution of these cases. The Board, after discussing the issue, directed that the County Manager provide the background and details of these cases to include pictures of the alleged infractions. .-~ As a matter of background, in the 1999-2000 timeframe a Streetscape Committee was fonned at the direction of the Board to review and evaluate the existing sign provisions in the LDC and in doing so conduct a comprehensive review of such provisions and to make recommendations on the development and implementation of amendments to the sign code. The committee held several public Hearings in 1999 and 2000, rcsulting in thc sign code being amended. Major regulatory changes relating to such areas as hcight, setbacks, size, logos, use of wall signs, use of window area, unified sign plans, neon lights, and interior illuminated signs along with an amortization schedule for non-conforming signs were developed and subsequently approved by the Board in 2001 as part of the LDC amendment cycle. Pursuant to Subsection 9.03.03.0. the Collier County Land Development Code, existing signs not expressly prohibited by this Code and nonconforming to its provisions shall be regarded as nonconforming signs. The Subsection further states that all non-confomling on premises signs and sign structures having an original cost or value of $100 or more and originally built prior to January 1st, 1991, which do not conform to the requirements of the 1991 Code were able to be maintained until February 1st, 2003, at which date all such signs were to be made to comply with the requirements of this Code or were to he removed. Nonconforming off premises and sign structures having an original cost or value of $100 or more were able to be maintained for the longer of the following periods-- two years from the date upon which the sign became nonconforming under this ordinance and a period of threc to seven years from the effectivc date of this ordinance according to the amortization table below: -- Agenda Item NO.1 OF January 27.2009 Page 2 of 6 Sign CostlValue Permitted Years from Effective Date of this Amendment $100.00 to $1,000.00 3 $1001.00 to $3,000.00 4 $3001.00 to $10,000.00 5 More than $10,000.00 7 Further in this Section, it states that a nonconforming sign may be continued and shall be maintained in good condition for the duration of amortization period as required by this code bul shall not be structurally or mechanically extended or altered to further the nonconformity, except when determined that imminent danger to the public exists. It shall not be repaired or rebuilt when destroyed or damaged to the extent of 50 percent or more of its replacement value except in conformity with the sign code. A nonconfonning permanent on or off premises sign shall not be replaced by another nonconforming sign. The code also states that all nonconforming signs shall be brought into compliance as part of any future change requiring a building permit. A change in copy or size would require a building permit. A letter was sent to property owners advising them of Ihis information. The amortization and time period for all signs, on and off premises, has expired. The Land Development Code amendment approved by the Board of County Commissioners on October 24, 2001 is in effect. Attached is a detailed report of the open citations along with an explanation of the alleged violation and what is needed to abate the alleged violation. Of the eighty (80) alleged sign violations in the lmmokalee Community, forty (40) cases have been abated through voluntary compliance, six (6) cases are working towards compliance by obtaining the required permits, thirty-four (34) cases are on hold: of these cases, the property owners have not been notified of the alleged violation or properties that have alleged violations.
