EXECUTIVE SUMMARY
Recommendation to authorize the conveyance of an Easement to Florida Power
and Light Company (FPL) for the installation of electric facilities to provide electric
service for the Collier County Fleet Facility which is located at 2897 County Barn
Road, at a cost not to exceed $27.00, Project 52009.
OBJECTIVE: To gain authorization from the Board of County Commissioners to convey
an Easement to FPL to install electric facilities for the purpose of providing electric
service to the Collier County Fleet Facility which is located at 2897 County Barr Road.
CONSIDERATIONS: The Board of County Commissioners at their February 25, 2003
meeting approved Agenda item 16E2, Project 52009, authorizing Disney and Associates
to design a new Board of County Commissioner's Fleet Facility and a new Sheriffs Fleet
Facility (hereinafter collectively referred to as Facility) at 2897 County Barn Road. Phase
III Construction is underway and the attached Easement to Florida Power & Light
Company (FP &L) is for the installation of electric facilities to service the facility.
The proposed Easement area measures 13 feet by 18 feet, more or less, and is
described on Exhibit "A" to the attached Easement and depicted on the attached location
map. The County, who is the landowner, will not be compensated because the
Easement is a requirement of FPL to provide service to the property.
FISCAL IMPACT: The total cost will not exceed $27.00 for the recording of the
Easement. Funds in the amount of $27.00 are available in the FY 09 budget under
Project 52009.
GROWTH MANAGEMENT IMPACT: There is no impact to the Collier County Growth
Management Plan.
LEGAL CONSIDERATIONS: The easement has been approved for form and legal
sufficiency. This item is not quasi - judicial, and as such ex parte disclosure is not
required. This item requires majority vote only. This item is legally sufficient for Board
action. -JAB
RECOMMENDATION: That the Board of County Commissioners authorizes the
conveyance of the attached Easement, authorizes the Chairman to execute the
Easement, and directs the County Manager or his designee to proceed to follow all
appropriate closing procedures and to record the Easement in the Public Records of
Collier County, Florida.

The undersigned, in consideration of the payment of $1.00 and other good and valuable consideration, the adequacy and receipt of
which is hereby acknowledged, grant and give to Florida Power & Light Company, its licensees, agents, successors, and assigns, an
easement forever for the construction, operation and maintenance of overhead and underground electric utility facilities (including
wires, poles, guys, cables, conduits and appurtenant equipment) to be installed from time to time; with the right m reconstruct, improve,
add to, enlarge, change the voltage, as well as, the size of and remove such facilities or are of them within an easement 10 feet in width,
described as follows'
An FP &L Company easement more particularly descrbed on Exhibit "A" attached hereto and made a part hereof. Said
easement prepared by RWA Consulting Inc.
Together with the right to permit any other person, firm or corporation to attach wires to any facilities hereunder and lay cable and
conduit within the easement and to operate the same for communications purposes; the right of ingress and egress to said premises at all
times; the right to clear the land and keep it cleared of all trees, undergrowth and other obstructions within the easement area; to trim
and cut and keep trimmed and cut all dead, weak, cooing or dangerous trees or limbs outside of the casement area which might
interfere with or fall upon the lines or wsems of communications or power tmnsmiesion or distribution; and further gran¢, to the fuller'[
extent the undersigned has the power to grant, if at all, the rights hercinabove granted on the land heretofore described, over, along,
under and across the roads, streets or highways adjoining or through said property.
