EXECUTIVE SUMMARY
Present to the Board of County Commissioners a summary of the Impact Fee Deferral
Agreements recommended for approval in FY09, including the total number of Agreements
approved, the total dollar amount deferred and the balance remaining for additional deferrals in
FY09.
OBJECTIVE: Present to the Board of County Commissioners a summary of the Impact Fee Deferral
Agreements recommended for approval in FY09, including the total number of Agreements approved,
the total dollar amount deferred and the balance remaining for additional deferrals in FY09.
CONSIDERATIONS: Article IV of Chapter 74 of the Code of Laws and Ordinances established a
program to defer impact fees for qualified affordable housing. For FY09, Collier County has
committed $1,206,524 for the deferment of Impact Fees for eligible owner occupied affordable
housing. This number represents 3% of the total Impact Fees collected in the prior Fiscal Year.
Additionally, Collier County has committed $307,500 for the deferment of Water System Impact Fees
and Sewer System Impact Fees. The Ordinance also allows for the deferral of Impact Fees on a total
of 225 rental apartment units per fiscal year.
A Summary of Impact Fee Deferral Agreements on the December 16, 2008 Agenda:

• Number of Owner Occupied Units Transferring from Developer to Owner: C
• Number of Rental Units Requesting Deferral: 0
• Dollar Amount of Owner Occupied Impact Fee Deferrals on today's agenda:
• $27,503.36 (excluding Water and Sewer)
• $7,070.00 Water and Sewer
• Dollar Amount of Rental Unit Impact Fee Deferrals on today's agenda:
o $0 (excluding Water and Sewer)
o $0 Water and Sewer
FISCAL IMPACT: Although it is expected that the County will ultimately collect these deferred fees
(generally upon the sale of the residence), there is no guarantee as to if, or when, this would occur.
GROWTH MANAGEMENT IMPACT: None.
LEGAL CONSIDERATIONS: This item has been reviewed and approved by the County Attorney's
Office, and it does not present any legal issues. - CMG
STAFF RECOMMENDATION: That the Board accept this summary of the Impact Fee Deferral
Agreements recommended for approval in FY09, including the total number of Agreements approved,
the total dollar amount deferred and the balance remaining for additional deferrals in FY09.
