EXECUTIVE SUMMARY
Recommendation to grant final approval of the roadway and drainage
improvements for the final plat of Preserve Commons (Olde Cypress PUD),
roadway and drainage improvements will be privately maintained
OBJECTIVE:
To grant final approval of the infrastructure improvements associated with that
subdivision known as Preserve Commons.
CONSIDERATIONS:
1. On February 4, 2002, Engineering and Environmental Services
Department granted preliminary acceptance of the roadway and drainage
improvements in Preserve Commons.
2. The roadway and drainage improvements will be maintained by the
project's Master Property Owners Association.
3. The required improvements have been constructed in accordance with the
Land Development Code. The Engineering and Environmental Services
Department has inspected the improvements and is recommending final
acceptance of the improvements.
4. A resolution for final acceptance has been prepared and approved by the
County Attorney's Office. A copy of the document is attached.
5. On June 27, 2000 the Board entered into a Construction and Maintenance
Agreement for Subdivision Improvements with the developer. The
developer has fulfilled his obligations with respect to the Agreement.
6. According to PUD Monitoring, the outstanding PUD commitments are as
follows: park site, nature trails, fair share contribution for traffic signal.
The developer is in the process of closing out this PUD and addressing
these issues. The Transportation Services Department has requested
that the developer prepare a full DRI Monitoring Report that would include
the preparation of a full traffic study, in order to establish the developer's
fair share as it relates to the Development Order commitments. The
developer has provided a proposal to fulfill park and walking trails
requirement; however, staff has advised the developer that the proposal
must include at a minimum an amendment to the PUD Master Plan to
reflect the location of the park site or a site development plan to accurately
reflect the proposed improvements. The developer has acknowledged the

outstanding PUD commitments and intends to fulfill these obligations in a
timely manner.
Pursuant to Board direction initiated at the PUD monitoring Workshop of
October 11, 2007, staff is providing the status of PUD obligations
associated with this PUD.
FISCAL IMPACT:
The roadway and drainage improvements within the subdivision will be
maintained by the project's Master Property Owner's Association.
GROWTH MANAGEMENT IMPACT:
There is no growth management impact.
LEGAL CONSIDERATIONS:
The County Attorney's Office has reviewed and approved the Resolution for
legal sufficiency. This matter is quasi - judicial and does not require a super -
majority. STW
RECOMMENDATION:
That the Board of County Commissioners grant final acceptance of the roadway
and drainage improvements in Preserve Commons and release the maintenance
security.
1. Authorize the Chairman to execute the attached resolution authorizing
final acceptance.
2. Authorize the release of the maintenance security.

Please see the following responses to the PUD compliance items per your November 12, 2008 letter:
Comment #1
Zoning and Land Development Review: There is a 3.9 acre park site commitment within the PUD
that has not been resolved according to records in the PUD files. An Official Interpretation (Ol) was
to have been filed. There is no indication in PUD files that this OI was submitted.
Response #1
We are currently working with South Florida Water Management District on possible options to
meet 3.9 acre park commitment, including creating passive walking trails in the preserve areas.
Based on a review of the PUD Master Plan from the original 1985 Woodlands ADA, the 3.9 acre
park was planned to be located along a north -south roadway on the eastern boundary of the PUD.
However, that road alignment was subsequently eliminated and the park area was not identified on
the Master Plan once the PUD was amended. Based on the Land Use Table (Table I) of Ordinance
2000 -37, the park acreage appears to be included in the 176.2 acres of preserves.

Environmental: A buffer issue was reported which PUD Monitoring believes has been resolved by
the enhanced buffer plantings in Vita Tuscans

Engineering: Report dated Jan 3rd 2008 reports the conversion of the SFWMD permit needs to
occur.

We are working with Karen Adams at the South Florida Water Management District on all
environmental resource permits that require transfer to the operating entity. Each of the permits
requires a recorded amendment to the declaration in order to complete the permit transfer. We will
continue to coordinate with our legal counsel, the Olde Cypress Master Property Owners Association
(POA), and SFWMD to finalize the conversions.

Transportation: Records indicate that the Transportation Department was waiting to review a DRI
Annual Report submittal requested by SWFRPC and FDOT before making certain determinations of
compliance. Our PUD records do not have any final determination filed. Issue remains outstanding.

Attached is a copy of the Olde Cypress Annual Traffic Monitoring report dated September 15, 2008.
As stated in the conclusions on page 10 of the report, all roadways are shown to be operating
acceptably under existing conditions per Robert Price from TR Transportation.

SWFMD: Correspondence from SFWMD of July 2008 indicated that The Woodlands permit needed
to be converted to the operating entity. In October 2008 SFWMD notified Olde Cypress
Development that the permit needed to be converted. Both of these notifications were for Permit 11-
0123105 Application No 991105 -71 which appears to be the permit for the area held by Preserve
Commons as well. If so the SWWMD permit must be converted to the operating entity before
compliance is found.

A RESOLUTION OF THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY,
FLORIDA AUTHORIZING FINAL
ACCEPTANCE OF CERTAIN ROADWAY AND
DRAINAGE IMPROVEMENTS IN PRESERVE
COMMONS, ACCORDING TO THE PLAT
THEREOF RECORDED IN PLAT BOOK 34,
PAGES 98 THROUGH 99; RELEASE OF THE
MAINTENANCE SECURITY; AND
ACCEPTANCE OF THE MAINTENANCE
RESPONSIBILITY FOR THE ROADWAY AND
DRAINAGE IMPROVEMENTS THAT ARE NOT
REQUIRED TO BE MAINTAINED BY THE
PRESERVE COMMONS COMMERCIAL
ASSOCIATION, INC.
WHEREAS, the Board of County Commissioners of Collier County, Florida, on
June 27, 2000, approved the plat of Preserve Commons for recording; and
WHEREAS, the Developer has constructed and maintained the roadway and
drainage improvements in accordance with the approved plans and specifications as
required by the Land Development Code (Collier County Ordinance No. 04 -41, as
amended); and
WHEREAS, the Developer is requesting final acceptance of the roadway and
drainage improvements and release of his maintenance security; and
WHEREAS, the Engineering and Environmental Services Section of the
Community Development Department has inspected the roadway and drainage
improvements, and is recommending acceptance of said facilities.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that final acceptance is hereby
granted for those roadway and drainage improvements in Preserve Commons , pursuant
to the plat thereof recorded in Plat Book 34, pages 98 through 99, and the Clerk is hereby
authorized to release the maintenance security.

BE IT FURTHER RESOLVED AND ORDERED that the County accept the
future maintenance and other attendant costs for those roadway and drainage
improvements that are not required to be maintained by the Preserve Commons
Commercial Association, Inc.
This Resolution adopted after motion, second and majority vote favoring same,
this day of 2009.
