Please be advised that the above-named project is complete and a Certificate of Public
Facility Adequacy (COA) has been approved. As required by Section 10.02.07 of the
Land Development Code and Section 74-302 (h) of the Collier County Code of Laws
and Ordinances, a COA must be issued concurrently with the approval of this
development order. The estimated Road Impact Fees for the project total $324,312.09.
A COA will be issued upon payment of 33% of the estimated road impact fees,
less the prior payment for PL20150001929, in the amount of $25,858.11 calculated

Once the above -referenced impact fees are paid, a COA will be issued in perpetuity and
a project approval letter will be issued.
If the applicable estimated transportation impact fees are not paid prior to the expiration
of the temporary 1 -year capacity reservation secured upon the County's acceptance of
the TIS, the COA application will be deemed denied and a new COA application will be
required to be submitted. The COA application will be reviewed to determine if capacity
is available at that time, and if so, a COA will be issued.
Final calculation of impact fees due will be based on the intensity of the development
actually permitted for construction and the impact fee schedule in effect at the time the
building permit application is submitted. In addition, any required impact fees for Parks,
Libraries, School, Government Building, Law Enforcement, Water, Sewer, Fire, EMS, or
Correctional Facilities will be due prior to the issuance of a Certificate of Occupancy.

This project is subject to LDC Section 10.02.03 B.4.b which states: Approved site
development plans (SDPs) shall remain in force for three (3) years from the date of
approval, as determined by the date of the SDP approval letter. If construction has not
commenced within 3 years, the site development plan approval term will expire and the
SDP approval is of no force or effect. One amendment to the SDP may be applied for
and may be granted prior to the original expiration date, so long as the proposed
amendment complies with the LDC requirements in force at the time of the SDP
amendment submittal. The SDP amendment shall remain in effect for 3 years from the
date of approval, as determined by the date of the SDP amendment approval letter. The

Insubstantial Change No. PL20180002049 approval letter and plans dated August 01, 2018 was
issued in error and hereby is rescinded by way of this letter. The application has been set back to
a resubmittal status and the following comments are provided to you regarding the project. If

6/25/18 Comment: The updated TIS should be provided to FDOT for reevaluation of access
requirements from State highways (Davis Blvd. and US 41). Coordinate with FDOT contact:
Mark Clark at (239) 225 -1984, Mark.Clark@dot, state. fl. us. 7/23/18 Update: Access driveways
will need to be coordinated with the adjacent parcel to be developed as Gateway Mini Triangle.

8/30/18 - comment remains as informational. It is the understanding of staff that this project,
Trio, and the project immediately to the east, Mini -Triangle, have submitted ROW permit
applications to FDOT.
Correction Comment 4:
TIS Guidelines (Resolution 06-299)
7/23/18 Comment: The Traffic Impact Statement for Gateway dated 7/12/18 confirms the finding
of concurrency for a slight reduction in trips from the prior site development plan proposal and
will be used for trip banking when the project amendment is approved.
8/30/18 -Previous comment from staff dated 7/23/18 above was in error. The TIS needs to
evaluate the trip generation associated with the restaurant and retail components of the project as
it is staffs understanding that this is a mixed-use project that will be open to the public for these
uses. The TIS requires revisions to add in these associated trips. Please schedule a meeting with
staff to confirm the methodology for trip capture associated with these uses.
The following comments are informational and/or may include stipulations:
Applicants who are converting a paper submittal to E -Permitting must resubmit
complete sets of all plans, signed and sealed, even if they were previously approved
on an earlier review. As a reminder, all documents that are required to be signed
and sealed must be digitally signed and sealed when submitting through our
E -Permitting process. On the cover letter please identify that previous submittals
were done through paper and that this submittal is by E -Permitting. Also,
identification of the changes in cover letter (ex. See note #23 Civil Plan Sheet 4)
improves the efficiency of the resubmittal review.
When addressing review comments, please provide a cover letter outlining your
response to each comment. Include a response to completed reviews with
stipulations.
Please be advised that Sections 10.02.03.H.1, and 10.02.04.13.3.c require that a
re -submittal must be made within 270 days of this letter.
Informational Comments:
• When the sign permit is applied for the project name can only be called Gateway not
Gateway of Naples.
Informational Comments:
• 7/26/18 Informational Comment: No County ROW permit is required since no work is
shown within a County roadway ROW. An FDOT permit is required for median
improvements on Davis Blvd. and for construction of site access driveways on Davis
Blvd. and US 41 and must be provided prior to the pre -construction meeting.
Stipulations:
• 7/26/18 Stipulation: Prior to preconstruction meeting, the applicant needs to complete
the payment reimbursement for removal of County landscaping within the Davis Blvd.

Stipulations:
