WHEREAS, on the 1ih day of March 2002, the Board of County Commissioners adopted Resol ution No. 2002-141 ; and WHEREAS, Resolution No. 2002-141 describes the entire geographic area this is to be benefited by this potable water line project ("the benefited area") by listing each lot number and each lot number's corresponding folio number for each lot that exists within the benefited area; and WHEREAS, the Property Appraiser requires that the outside boundary line of the benefited area be described by means of a metes and bound description; and WHEREAS, this Resolution adds the description of the benefited area by means of a metes and bounds description and deletes the listing of benefited properties by lot number and folio numbers; and WHEREAS, Resolution No. 2002-141 is not affected except by adding this description of the benefited area by means of a metes and bounds description and deleting the listing of benefited properties by lot number and folio numbers; and WHEREAS, on the 29th day of July, 2003, the Board of County Commissioners adopted Resolution No. 2003-240; and WHEREAS, Resolution No. 2003-240 provided a metes and bounds description of the benefited area which was in error. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that: 1. THE BENEFITED AREA AS DESCRIBED IN RESOLUTION 2002-14115: SECTION 3.01. DESCRIPTION OF PROPOSED PROJECT AND BENEFIT AREA. The Board proposes to create the Price Street-Barefoot Williams Road Benefit Area within the Price Street-Barefoot Williams Municipal Service Taxing and Benefit Unit to encompass the property located in the unincorporated area of Collier County, in Section 4 , Township 51 South, Range 26 East, and is not platted in the Public Record of Collier County, Florida. The Benefit Area is proposed for the purpose of improving the use and enjoyment of property located therein. The description of the proposed potable water improvements is the construction of an 8-inch potable water main, with appropriate fire hydrant(s) and appurtenances that will be installed along Price Street from the rear of the Shops at Eagle Creek (about 400 feet south of US 41) to Barefoot Williams Road and then north about 1,200 feet along Barefoot Williams Road to an existing 8-inch water main for an entire length of approximately 3,800 linear feet. 2. METES AND BOUNDS DESCRIPTION OF THE BENEFITED AREA. The outer boundary of the above described benefited area is described by the following metes and bounds description: Lots 2 through 11 and 29 through 35 and a portion of Lot 36 together with Lot 26 less and except the South 75 feet thereof, of the Unrecorded Plat of Marland as depicted on the Survey thereof by P. A. RESOLUTION NO. 2002-141 IS NOT OTHERWISE AFFECTED. This Resolution does not affect Resolution No. 2002-141 except by describing the outer boundary line of the benefited area by this metes and bounds description and deleting the listing of benefited properties by lot number and folio numbers. 5. EFFECTIVE DATE. This Resolution shall take effect immediately upon its adoption. WHEREAS, the Board of County Commissioners, as the Governing Body of Collier County and as Ex-officio the Governing Board of the Collier County Water-Sewer District (hereafter referred to as "Board") determined on March 12,2002 at a public hearing to create, by Resolution No. 2002-141, the Price Street - Barefoot Williams Road Water Facilities Municipal Services Taxing/Benefit District, and approved the construction of said water facilities; and WHEREAS, an agreement to reimburse the Property Appraiser and Tax Collector for services rendered authorizing the use of the uniform method of collecting non ad-valorem special assessments was approved by the Board of County Commissioners on January 14, 2003. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA, AS THE GOVERNING BODY OF COLLIER COUNTY AND AS EX-OFFICIO THE GOVERNING BOARD OF THE COLLIER COUNTY WATER-SEWER DISTRICT. that: 1. The Board, having met to receive and consider the written objections of the property owners and other interested persons appearing before the Board as to the propriety and advisability of confirming and adopting the Price Street - Barefoot Williams Road Water Special Assessment District preliminary assessment roll, as to the amounts shown thereon to be assessed against the lots and parcels of property to be benefited and as to the equalization of such assessments on a basis of justice and right, does hereby confirm such preliminary assessment roll to make it final and to adopt same as the Final Assessment Roll. 2. The subject potable water improvements consist of construction of a 8- inch potable water main along Price Street from the rear of the Shops at Eagle Creek (approximately four hundred (400) feet south of US Highway 41) to Barefoot Williams Road, and then north approximately one thousand two hundred (1,200) feet along Barefoot Williams Road to an existing 8-inch water main. This potable water main project consists of approximately three thousand eight hundred (3,800) linear feet of 8- inch water line, fire hydrant assemblies, gate valves, air release valves, and meter boxes. These improvements have been constructed for a total assessable project cost of $226,209.06, which for this project equates to $7,069.03 per lot for the properties receiving a benefit within the Price Street - Barefoot Williams Road Water Special Assessment District, which, in reference to Section 3.06 of Ordinance No. 98-45, is the maximum amount of the assessment for each respective lot ("assessment unit"). Included in the assessable project costs are construction costs, engineering fees for design, construction and inspection; legal costs and fees, financing costs; and other assessable costs as permitted by law associated with the potable water improvements. The total assessable project costs are shown in Exhibit "A" attached hereto and incorporated herein, represent the assessment that benefits the subject assessed lots in the geographical area of this assessment district. The Board hereby confirms the special assessments attached as Exhibit "B" as the Final Assessment Roll. 3. Each such assessment is hereby found and determined to be levied in appropriate proportion to the special and positive benefits to be received by the respective properties that are listed in the Final Assessment Roll, which is attached hereto as Exhibit "B" and is incorporated herein. 1 OR: 3398 PG: 0932 17 J 4. Upon anticipation of the adoption of this Resolution, the Collier County Utility Billing and Customer Service Department has prepared and mailed by first class mail to the property owners at the address listed on the Final Assessment Roll an assessment bill for the full amount of the respective special assessment. Any special assessment may be paid in full, without interest, at the office of the Collier County Utility Billing and Customer Service provided such payment is made in full within thirty (30) days from date of notification. As specified in Section 3.07 of Collier County Ordinance No. 98-45, this Resolution shall constitute the Annual Assessment Resolution for the initial and subsequent fiscal years. 5. Thereafter, all special assessments shall be billed and collected over a period of ten (10) years. The first annual capital assessment will be included on the ad- valorem tax bill and when imposed, shall constitute a lien upon the tax parcels located in the benefit area pursuant to this Resolution. The first and each subsequent annual capital assessment shall be computed for each tax parcel and shall include: (a) principal portion of debt service amount, (b) interest, (c) cost of collection (Tax Collector at two percent, Property Appraiser at one and one half percent, and roll administration at one percent), and (d) tax discount. 6. The assessment shall be final and conclusive as to each lot or parcel assessed and any objections against the making of any assessable improvements not so made shall be deemed to have been waived, and if any objection shall be made and overruled or shall not be sustained, the adoption of this Resolution approving the Final Assessment Roll shall be the final adjudication of the issues presented unless proper steps shall be taken in a court of competent jurisdiction to secure relief within, and not later then, thirty (30) days from the date of adoption of this Resolution. 7. The Clerk is hereby directed to record this Resolution and both Exhibits attached hereto in the Official Records of Collier County, Florida.
