RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF COLLIER
COUNTY, FLORIDA, AS THE GOVERNING BODY OF COLLIER COUNTY AND
AS EX-OFFICIO THE GOVERNING BOARD OF THE COLLIER COUNTY W A TER-
SEWER DISTRICT, TO EXPAND THE GEOGRAPHIC BOUNDARIES OF THE
COLLIER COUNTY WATER-SEWER DISTRICT BOUNDARIES TO
INCORPORA TE THE RURAL FRINGE RECEIVING AREAS AND RURAL FRINGE
NEUTRAL AREAS, AND TO EXCLUDE FROM THE DISTRICT'S BOUNDARIES
AN AREA THAT SHOULD NEVER HAVE BEEN DESCRIBED AS BEING WITHIN
THE DISTRICT'S BOUNDARIES.
WHEREAS, by prior adoption of the Rural Fringe Growth Management Plan
Amendments and by prior adoption of the 2001 Water and Wastewater Master Plans, and by
this Resolution of the Board of County Commissioners, it is resolved that it is in the best
interests of the residents of Collier County and within the Collier County Water-Sewer
District to expand the boundaries of the District to include therein the Rural Fringe Recei ving
Areas, Rural Fringe Neutral Areas and very limited Rural Fringe Sending Area; and
WHEREAS, these added geographic areas are contiguous to the existing boundaries
and District water and sewer service to these new areas will be consistent with engineering
principles; and
WHEREAS, it is hereby resolved to amend the geographic boundaries of the Water-
Sewer District as specified herein, pursuant Paragraph 3 of Section 3 of Chapter 2003-353,
Laws of Florida, a Special Act.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA, AS THE GOVERNING
BODY OF COLLIER COUNTY AND AS EX-OFFICIO THE GOVERNING BOARD
OF THE COLLIER COUNTY WATER-SEWER DISTRICT, that:
1. The geographic boundaries of the Water-Sewer District as described in Section
3 of Chapter 2003-353, Laws of Florida (described in Exhibit "A" attached hereto) are
acknowledged. Those boundaries are being corrected by deleting from within the District an
area that is incorrectly described in the text of Chapter 2003-252, Laws of Florida, as being
within the District's boundaries. The area being deleted by this Resolution should not have
been included within the District's boundaries as described in Chapter 2003-353.
2. The Boundaries of the District, as described Chapter 2003-353, Laws of Florida
(the District's Special Act) are hereby expanded to add the following into the District's
boundaries: (a) the Rural Fringe Receiving Areas, (b) Rural Fringe Neutral Areas, and (c)
limited Rural Fringe Sending Area. These boundaries, as amended by this Resolution, are
described in Exhibit "C" incorporated herein, which Exhibit "C" describes the District's now
existing boundaries (after deleting the area described in Section 2, above, and after adding
the three areas described in this Section. The composite revised boundaries of the District as

described in Exhibit "C" attached hereto. These are the corrected and revised boundaries of
the District as of the effective date of this Resolution.
3 The District's boundaries do not include any area within any now existing
boundary of the City of Naples, of Everglades City, of The Immokalee Water and Sewer
District. or The City of Marco Island, or any area in ''The City of Golden Gate," which area,
notwithstanding its name, is unincorporated Collier County (is not a municipal corporation).
The boundaries do not include any area within the certificated area of any utility that has
been certificated by the Florida Public Service Commission or the Collier County Water-
Wastewater Authority, including the certificated area of the Orange Tree Utility, which area
is described in Exhibit "D" attached hereto. Exhibit "E" attached hereto describes the
certificated area of other utilities in unincorporated Collier County (except for the Orange
Tree'Utility).
5. Subject to complying with the County's Comprehensive Land Use Plan (CLUP),
the District's utility pipes, lines and other distribution and transmission facilities may run
through Rural Fringe Sending Areas to facilitate water and/or sewer flow and/or interconnects
with utility facilities outside of the Rural Fringe Sending Areas; and subject to complying with
the CLUP, the County may require, authorize or approve connections to or from such utility
facilities to provide water and/or sewer service within Rural Fringe Sending Areas.

WQEREAS, Orange Tree Utilities, Inc. (UTILITY), is thl~ boldel' of Grandfathel'
