COMMISSIONERS UPON A PETITION BY THE ST ATE OF FLORIDA, BY

PROTECTION, TO DISCLAIM, RENOUNCE AND VACATE THE

PAGE 394, LYING NORTHERLY OF THE SOUTH LINE OF THE NORTH
150 FEET OF THE SOUTH 660 OF THE SOUTHEAST QUARTER OF
SECTION 12, TOWNSHIP 52 SOUTH, RANGE 29 EAST.
WHEREAS, pursuant to Sections 336.09 and 336.10, Florida Statutes, the State of
Florida, by and through the Florida Department of Environmental Protection, does hereby request
the vacation of those road rights of way located within the southern Golden Gate Estates and
dedicated by numerous plats of Golden Gate Estates which are more particularly described in
Composite Exhibit "A," attached hereto; and
WHEREAS, pursuant to Sections 336.09 and 336.10, Florida Statutes, the State of
Florida, by and through the Florida Department of Environmental Protection, does hereby request
that the Board renounce, disclaim and vacate those road rights of way known as Miller Boulevard
Extension and Janes Scenic Drive, which are more particularly described in Composite Exhibit
"A," attached hereto; and
WHEREAS, the petitioner has requested that the petition filing fee of $1000 be waived;
and
WHEREAS, the State has requested the vacation of these road rights of way as part of its
efforts to restore natural surface water flow and as part of the Everglades Restoration Project; and

WHEREAS, the Board has this day held a public hearing to consider disclaiming,
renouncing and vacating those Road Rights of Way described in Composite Exhibit "A," and
notice of said public hearing to vacate was given as required by law; and
WHEREAS, the vacation of these road rights of way will not invade or violate the
individual property rights of other property owners and will further the restoration and
preservation of surrounding wetlands, thereby benefiting the public as a whole.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that the County's Right of Way
interests over and across the platted road rights of way within the southern Golden Gate Estates,
Miller Boulevard Extension and Jane's Scenic Drive, as more particularly described in the
attached Composite Exhibit "A" are hereby vacated, extinguished, renounced and disclaimed,
and this action is declared to be in the Public's interest and for the Public's benefit.
BE IT FURTHER RESOLVED, that the application fee of $1000 is hereby waived.
BE IT FURTHER RESOLVED, that the Clerk to the Board is hereby directed to record
a certified copy of this Resolution, the proof of publication of the notice of public hearing and the
proof of publication of the notice of adoption of this Resolution in the Official Records of Collier
County, Florida.
This Resolution is adopted this 2~day of ~ 2003, after motion, second
and majority vote favoring same.
