RESOLUTION NO. 2003-335-A
A RESOLUTION OF THE BOARD OF COUNTRY COMMISSIONERS
OF COLLIER COUNTY ESTABLISHING A FEE SCHEDULE OF
DEVELOPMENT RELATED REVIEW AND PROCESSING FEES
INCLUDING: PROVIDING FOR NEW AND REVISED BUILDING
PERMIT, INSPECTION, AND LAND USE PETITION FEES; AS
PROVIDED FOR IN DIVISION 1.10 OF THE COLLIER COUNTY
LAND DEVELOPMENT CODE; SUPERSEDING RESOLUTION NO.
2003-117, AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the Collier County Land Development Code, Section 1.10.1 provides that
the Board of County Commissioners shall establish and adopt by resolution a schedule of fees
and charges for application and document processing, public meetings, public hearings, other
meetings and hearings, transcripts, approvals, denials, development permits. development orders,
development. construction, interpretations, enforcement inspection services, sales of documents
review, resubmission, and any other zoning or development related services and any other
services provided or costs incurred by or on behalf of the County; and
WHEREAS, the Board of County Commissioners approved Resolution No. 2003-117,
establishing a fee schedule of development related review and processing fees on March 11,
2003; and
WHEREAS, many operations within the Community Development and Environmental
Services Division are supported by user fee revenues; and
WHEREAS, it is staffs intent to continue to conduct annual cost/fee studies in an
attempt to balance Fund 113 and Fund 131 operating costs with revenues; and
WHEREAS, the new or increased fees for certain development or building review related
activities or petition types, including but not limited to, site development plans, rezones,
conditional uses, building permit applications and related inspections are reflective of the actual
cost of processing and reviewing such petitions.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA that:
The Board of County Commissioners hereby declares that the revised fees set forth as
attached hereto and incorporated by reference herein as "Exhibit A," are all fair and reasonable
sums to be assessed to those who receive the benefits of the services, reviews, and inspections

required pursuant to the Land Development Code and the County's corresponding development
review and permitting processes.
BE IT FURTHER RESOLVED that this Resolution relating to fees in the Land
Development Code be recorded in the minutes of this Board and that Resolution numbered 2003-
117 is hereby superseded by the adoption of this Resolution which will become effective
November 3, 2003.

FEE SCHEDULE OF DEVELOPMENT RELATED REVIEW AND PROCESSING FEES
AS PROVIDED FOR IN DIVISION 1.10 OF THE COLLIER COUNTY LAND'
DEVELOPl\tlENT CODE.
OBJECTIVE: To have the Board of County Commissioners approve an amendment to the
current fee schedule for Building Permit and Review fees and Development Services fees within
the Community Development and Environment Services Division (CDES).
CONSIDERA TIONS: The majority of operations within Collier County's CDES Division are
funded by fee revenue, fees paid by those people engaging in the associated services of CDES', .
As directed by current interpretations of Florida Statues, Building Review and Permitting fees
collected as part of the building construction process are segregated into their own fund, fund
113, and can only be used to fund expenses incurred in carrying out Collier County's
responsibility in enforcing the Florida Building Code. Beginning with fiscal year 2004, fees
collected as part of the land development process, Development Services fees, will be deposited
in their own newly created fund, fund 131, AU activities associated whh the implementation and
enforcement of the Collier County Land Development Code, such as land use petitions,
rezonings, and engineering and environmental rev;"ws will fall into fund 131. .
All of CDES's departments and associated operations, whether in fund 113 or fund 131, are fully
or in large part funded by fees collected at the time of service, and deposited into fund 1 13 or
fund 131. CDES must ensure that such services are fully supported by those requesting and
receiving them. and that the fees charged reflect CDES's fully burdened cost of providing those
services and not more.
These fee changes are the second part of a two-part process. The first phase being fee increases'
approved by the Board on March II, 2003, which were required to insure COES had suft1cient
operating income to fund the division through the balance of fiscal year 2003. This. the second
phase that is now before the Board, is an overall re-allocation of fee revenue between funds 113
and 131 to insure each fund is receiving such fee revenue equal to it's own individual expenses.
These fee changes represent no net increase in total fees charged, for the total scope of CpES
resources engaged by the entire course of the development process, from initial submission of
plans until the final insurance of the Certificate of Occupancy. For every additional dollar being'
charged land use activities in fund 131, building permit fees are being reduced by the, same
amount in fund 113. The specific fee changes proposed are based on staff time-tracking data
accumulated over the past fiscal year, and reflects the current fully burdened actual CO!;ts of the
fee related CDES staff and operating resources.

The need to increase certain fees to insure that those costs are borne by those who receive such
services was first recognized during the FY 2003 budget process. The exact nature of the needed
fee changes has been extensively discussed in meetings with the Development Services Advisory
Committee, the Productivity Committee, the Collier Building Industry Association, and in public
information meetings open to the public.
CDES management believes that at this point in time, these major changes to both Buildin'g
Review and Permitting fees and Development Services fees are necessary to provide clear and
defined cost and revenue relationships between and within these two funds. These fee changes
provide the requisite revenue for each fund to adequately provide its own services to our external
customer base while maintaining an acceptable level of service to those same customers. The
attached resolution and fee schedule, attachment "A", outlines the complete fee structure
proposed for CDES. Attachment "B" summarizes the specific fee increases requested, showing
both the old fee and the proposed new fee.
In summary, staff is recommending new or increased fees in certain areas and lowing of fees in
other areas and that the Board approves a variety of fee changes as outlined in both Attachments
"A" and "B". Staff assesses that these fees represent the County's costs incurred in providing
these services to the community.
FISCAL IMPACT: This Executive Summary requires no budget changes and/or reallocation of
funds, such changes having been mack in the FY04 budget previously presented to the Board'.
_ These fee changes represent no net ine.ease in total CDES revenue. It is currently antieipated
that any potential shortfall of revenue within CDES during FY04 will be dealt with by the use of
reserve accounts and I or adjustments in operating expenses.
GROWTH MANAGEMENT IMPACT: There are no growth management impacts fro1)1 this
Executive Summary.

M) BUILDING PERMIT APPLlCATIOf;'l FEE
I) A permit application fee shall be collected at time of applying for a
building permit. The permit application fee shall be collected when the
plans are submitted for review. The fee shall be applied toward the total
permit fee. The applicant shall forfeit the application fee if the
application is denied or if the application is approved and the permit is
not issued within the time limitation as stated in Section 103.6.1.1 of the
Collier County Ordinance No. 91-56, as amended.
2) Application fee will be computed as follows:
a. Single family and duplex ~ per sq ft wilh minimum of SlQQJl:Q
b. Multi-Family & Commercial ~ per sq ft up to 10,000 sq ft, ~ for over 10,000 sq. ft.

0) ELECTRICAL PERMIT FEES
I) The fees for electrical permits for new structures or placement or relocation
of structures shall be computed as follows:
a. s.MQ per ampere rating of all single-phase panel boards.
b. ~ per ampere rating for SWilCh or circuit whichever is greater, if item
#1 above does not apply.
c. When not a complete installation, all switch and circuit breakers ahead of

permit fee for sign shall be $75.00.
2) Multiple signs of the same type (Le., wall signs) and for a single project may be allowed per one permit.
however an appropriate fee shall be charged for each sign in accordance with the schedule set fonh in the
above subsection I of Sign pcrmit Fees.
X) CONVENIENCE PERMIT FEES
I) Convenience permits are issued in blocks of 10 each. Only licensed contractors are eligible to purchase'
convenience permits. Convenience permits are limited to the use specified on the permit. The fee for a book
of 10 convenience permits is HQQ,QQ.
Y)'REVISION AND AS BUILT PLAN REVIEW FEES; CORRECTIONS TO PLANS
I) PERMIT AND PLAN REVISIONS The fee for each permit revision submitted after pcrmit issuance shall be
calculated using fee schedules outlined in Sections N through R above. The minimum permit fee for revisions
to permitted projects shall be S50.00.
2) AS BUILT PLANS The fee for "As Built" plan review shall be ten C1Q5!:) percent of the original building
permit fee or~, whichever is greater, but shall not exceed~. The fee is intended to cover lhe cost
of reviewing amended building plans in the office to determine that change orders and various field changes
are in compliance with the minimum construction and lire codes of Collier County. The following are required
for as-built drawings review:
a. An itemized list of all changes made after permit plan approval.
b. As-built plans that have all changes made after permit plan approval
"clouded" .
c. As-built plans and changes shall be signed and sealed by the engineer
and/or architect of record.

I) Where work for which a permit is required is started or proceeded with prior

penalty for failure to obtain a permit when one is required having a cost
greater than WQ..QQ shall be two times the regular amount. The payment of
such fee shall not relieve any person from fully complying with the
requirements of any applicable construction code or ordinance in the execution
of the work, or from any penalty prescribed within any construction code, law

PP) FEE \V ArvER PROCEDURES
I) Requests for fee waivers may only be approved by the Board of County Commissioners. Waiver requests for
development review and building permit fees shall be submillcd in writing directly to the appropriate
Community Development & Environmental Services Division Staff. who will prepare an executive summary
for consideration by the Board. Such requests shall include a statement indicating the reason for the fe;
waiver request and, if applicable, the nature of the organization requesting the fee waiver.
QQ) ADDITIONAL FEE REFUND PROVISIONS
I ) PAYMENT OF FEES: Full payment of fees is required for a complete application. Department
policy requires full payment of fees at the time of application subminal. No work will begin on staff
review of the application until all fees are paid in full. If full payment of fees is not received within
l~ calendar days of application submitlal. the application will be considered void. At this point, a
new application and full payment of fees will be required to proceed with a project.
2) There will be no refund of Planning, Environmental, or Engineering related fees. except thos~
applications which have been deemed not sufficient for staff review and are withdrawn wilhfn 30
days of notification will be entitled to a 50% refund. After 30 days from such notification, lhere will
be no refund of submitted fees.
3) In no cases will there be refunds for pre-application fees, data conversion fees. appeals of
administrative decisions, or appeals to the Board of Zoning Appeals or Building Board of
Adjustment.
4) If staff error causes the inappropriate or unnecessary filing of an application and payment of fees, roo
percent of all inappropriate fees, shall be refunded upon written request and with the concurr~nce of
Department management.
5) In those ca~:es where alternative methods or timing of payments for CDES services and I or fees listed
in this schedule associated with SBR reviews are deemed to best sen'e the public good, the
Community Development and Environmental Services Administrator will have the authority to
approve such alternatives. Such alternative must be in writing and signed by all principals involved.
In no case shall final C.O. or such certifications of project completeness be issued unli\ payments due

of Depanment Directors in cases where applications have not )'et been deemed sufficient for staff
review. or such staff review has yet to begin. In no cases will there be refunds for pre-application fees,
data conversion fees. appeals of administrative decisions. or appeals to the Board of Zoning Appeals or
Building Board of Adjustment.

QQ) Additional and General Fee Provisions
I. PA YMENT OF FEES: Full payment of fees is required for a complete application. Depanment policy
requires full payment of fees at the time of application submittal. No work. will begin on staff review of the
applicalion until all fees are paid in full. If full payment of fees is 1'10[ received within I~ calendar days of
application submittal. lhe application will be considered void. At this point. a new application and full
payment of fees will be required to proceed with a project.
2. There will be no refund of Planning. Environmental. or Engineering related fees. except those applications
which have been deemed not sufficient for staff review and are withdrawn within 30 days of notification will
be entitled to a 50% refund. After 30 days from such notitication. there will be no refund of sub milled fees.
In no cases will there be refunds for pre-application fees. data conversion fees. appeals of adminislrative
decisions. or appeals to lhe Board of Zoning Appeals or Building Board of Adjustment.
3. If staff error causes the inappropriate or unnecessary filing of an applicalion and payment of fees, 100 percent
of all inappropriate fees. shall be refunded upon wriuen request and with lhe concurrence of Departmenl
management.
4. In those cases where alternative melhods or timing of payments for CDES services and I or fe.:s listed in this,
schedule asso<;iated with SBR reviews are deemed to best serve the public good. the Community
Development and Environmental Services Administrator will have the aUlhority to approve such a1tematives.
Such ahernative must be in .....riting and signed by all principals involved. In no case shall final e.O. or such
certifications of project completeness be issued until pa)'ments due CDES are received in full.
