EXECUTIVE SUMMARY
Recommendation to approve the submittal of a revised 2018 Federal Transit Administration (FTA)
Section 5324 Emergency Relief Grant application in the amount of $ 196,978 to repair damages to
Collier Area Transit (CAT) vehicles and facilities as a result of Hurricane Irma, approve the
acceptance of the award through the Transit Award Management System (TrAMS), and authorize
the necessary Budget Amendment.
OBJECTIVE: To obtain grant funding to cover costs of damages to CAT vehicles and facilities caused
by Hurricane Irma.
CONSIDERATIONS: On September 11, 2018, the Board of County Commissioners (Board) approved
the submittal of a 2018 FTA Section 5324 Emergency Relief grant application in the amount of
$226,326.76 to repair damages to CAT vehicles and facilities as a result of Hurricane Irma. During the
FTA review process, revised application guidance was issued in December 2018 and the application was
revised to meet those requirements.
The application now requires a ten percent (10%) match for capital expenditures that were paid after June
4, 2018. The grant will pay one-hundred percent (100%) of capital expenditures paid before June 4, 2018
as well as all hurricane related operating costs. The new guidance also required CAT staff to submit cost
estimates and all paid invoices to FTA in order to determine the funding amount to be awarded to Collier
County. Based on the invoices and estimates provided January 2, 2019, the FTA approved an award
amount of $196,978.
A revised grant application has been entered into TrAMS to utilize these funds. The application was
prepared and attached for Board approval. After review and approval by FTA, the grant award is
electronically executed in TrAMS by the Public Services Department Head who serves as the Board-
appointed designee. Public Transit & Neighborhood Enhancement (PTNE) and the Office of Management
and Budget grants compliance staff will also use this electronic system to manage the project and submit
all required reports. A breakdown of the revised funding allocation to Collier County is in the table
below:

FISCAL IMPACT: A Budget Amendment is required in the amount of ($41,968.76) to reduce the grant
funding within CAT Grant Fund (424) Project 33590 to the final award amount of $184,358. A Budget
Amendment is required in the amount of $12,620 to appropriate local match in CAT Grant Match Fund
(425) Project 33590. The ten percent (10%) local match is available from CAT Operating Fund (426)
Project 6101. The Disaster Recovery funding requires a 10% match on Capital activities. Operations is
recovered at 100%.
GROWTH MANAGEMENT IMPACT: Transit capital and operations support goals and objectives of
the Transportation Element of the Growth Management Plan.

Application Executive Summary
This is an FY 2018 Section 5324 D2018–EMER–004 application in the amount of $196,978. The
application is for the repair of damages to Collier Area Transit facilities and vehicles caused by
Hurricane Irma in September 2017. The damages for repair include structural steel repair, Gutter/leader
replacement, interior fencing, garage door replacement, and bus wrap replacement. Funding will also
be used for operating expenses such as labor costs and equipment costs that were incurred by our
vendor. A breakdown of these costs is included in this application (Attachment # 23). Operating
expenses total $57,823 and capital expenses total $139,155. Collier County will provide a local share in
the amount of $12,620 for a portion of the capital expenditures. Collier County did submit an insurance
claim for these projects and the adjuster responded with an estimate of $170,450.01 to cover capital
damages. Collier County also submitted a claim to FEMA for reimbursement for capital damages, but
no FEMA reimbursements have been received to date. This project only includes emergency
operations, emergency protective measures, and emergency repairs/permanent repairs with no
functional, location, or capacity change. Therefore, no TIP/STIP documentation is needed per
Emergency Relief Program requirements. Indirect costs will not be applied to this application and its
scope of work. The grant is for $184,358, Collier County received an ER allocation of $226,000, Collier
County will create a second grant or an amendment to come in for the excess funds once/if a second
allocation of the additional requested $82,000 is available.

Project Description
Collier County is requesting a total of $139,155 in FTA Hurricane relief capital repairs funding as a
result of Hurricane Irma hitting Collier County on September 10, 2017. The funding will allow for repair
to vehicles and facilities that were damaged during the storm. Insurance claim #5109101706584 was
submitted and an adjuster estimated that $170,450.01 would be covered by insurance for the capital
damages. Collier County also submitted a claim to FEMA for reimbursement of capital costs but no
FEMA reimbursements have been received to date. A breakdown of the capital costs is on attachment
#23 and a breakdown is as follows:
Bus stop damages $6,750
Station and facility repairs $132,405
Total $139,155
This project includes both 100% federal share for emergency repair costs incurred for up to 270 days
from the date of the major disaster declaration and 90% federal share for permanent repair costs
incurred after 270 days from the date of the major disaster declaration. Collier County will provide 10%
local match from the Collier Area Transit operating fund to meet the 10% match requirement. Indirect
cost rates will not be applied to this project and its scope of work.
The facility located at 8300 radio rd is not in a floodplain and the flood insurance policy is uploaded as
attachment #24.
This project only includes emergency operations, emergency protective measures, and emergency
repairs/permanent repairs with no functional, location, or capacity change. Therefore, no TIP/STIP

as a result of Hurricane Irma. The light pole located at the bus stop was damaged as a result of the
storm. The bus shelters has a useful life of 15 years. No insurance claims have been paid or

amount is $6,750. and 90% ($6,075) is eligible for federal participation . Therefore, $6,075 has been

along with a cost/price analysis for the scope of work for the project. Cost estimates are attached in

Collier County is requesting $57,823 FY 2018 Section 5324 in emergency relief operating assistance as
a result of Hurricane Irma. operating assistance includes transit labor, equipment, and vendor related
costs. This project includes 100% Federal share for emergency operations incurred for up to 270 days
from the date of the disaster declaration. A detailed breakdown of the damages, and invoices are
attached to this application. An operational cost breakdown is in attachment 2 of the application
documents. All items for this project are insured and were previously insured. Operating expenses
incurred at the start of Collier's declared emergency on September 7, 2017. An insurance claim was
submitted (Claim #510910706584) but the insurance only covers capital expenditures. Capital
expenditures are not associated with this project. Operational costs are broken down as follows:

Extended Budget Description
Collier County is requesting $57,823 in emergency relief operating assistance as a result of Hurricane
Irma. This project includes 100% Federal share for emergency operations costs incurred up to 270 days
from the date of major disaster declaration. Operating expenses incurred at the start of Collier's
declared emergency on September 7, 2017. operating assistance includes transit labor, equipment, and
vendor related costs. A detailed breakdown of the damages, and invoices are attached to this
application. Attachment # 23 includes a full cost breakdown. Attachment # 2 includes a breakdown of
salary costs, and vehicles used during the emergency operations period. Operation costs are broken
down as follows:
Labor: $30,789.98
Equipment: $1,183.01 (this cost is based on the number of hours and miles driven in County cars by
staff to deliver food and supplies to workers during the emergency operation period. The miles and
hours are calculated on the spreadsheet in Attachment #2)
Vendor $25,850.77
No insurance claims have been paid or anticipated for this project. Insurance claim has been filed and
received for capital projects only.
Emergency operations Response activities included providing evacuation trips to shelters, life sustaining
trips, (medical appointments) Approximately 376 trips were made to transport passengers during the
emergency operations period . Evacuations ended by September 17, 2017. Vehicles were also used to
provide cooling at various locations throughout the county.
Emergency operations were in force between September 7-September 29, 2017. All transportation
during that time period was free for passengers.

FTA’s Emergency Relief Program. Depending on the purpose of the grant, include
either the language shown under “Emergency Response, Recovery, and Rebuilding” or

Conditions of Award for FTA’s Public Transportation Emergency Relief Program Grants.
The Recipient agrees that the following Conditions of Award apply to grants for projects
funded under the Response, Recovery, and Rebuilding Allocation and Resilience
Allocation of the Public Transportation Emergency Relief Program as described in the
Federal Register notice “Allocation of Public Transportation Emergency Relief Funds in
Response to Hurricanes Harvey, Irma, and Maria.” These Conditions of Award
supersede any conflicting provisions of this Grant Agreement and applicable Master
Agreement, unless FTA determines otherwise in writing:
1. This award is authorized by 49 U.S.C. § 5324, which established FTA’s Emergency
Relief Program and funded by an appropriation under the Bipartisan Budget Act of
2018, Public Law 115-123, February 9, 2018, which provides funding for transit systems
affected by Hurricanes Harvey, Irma, and Maria. This grant supports projects described
in FTA’s Federal Register notice “Allocation of Public Transportation Emergency Relief
Funds in Response to Hurricanes Harvey, Irma, and Maria” 83 FR 25104, May 31,
2018,
2. FTA Notice. The Recipient agrees to follow FTA’s Federal Register notice “Allocation
of Public Transportation Emergency Relief Funds in Response to Hurricanes Harvey,
Irma, and Maria” 83 FR 25104, May 31, 2018, pertaining to the Emergency Relief
Program Grants, and any later revision of the FTA notice; any future FTA notices of
Emergency Relief Program funding availability; and FTA’s Emergency Relief Program
Final Rule, except as FTA determines otherwise in writing,
3. Eligible Projects – Limitations. Funding under this Grant Agreement may be used only
for projects determined eligible for funding under FTA’s Emergency Relief Program, and
may not be used for projects determined ineligible,
4. Federal Share. The specific Federal share for this Project is identified on this Grant
Agreement. As the Recipient may request, the Federal share may be up to One
Hundred (100) percent of the net project cost for emergency operations, emergency
protective measures, and emergency repair projects for costs incurred for up to 270
days from the date of the applicable major disaster declaration and up to Ninety (90)
percent of the net project cost for other projects. For resilience projects or components
of projects, the Federal share may be up to Eighty (80) percent of the net project cost.
5. Federal Emergency Management Agency Funding Assistance. If the Recipient
receives Federal funding from the Federal Emergency Management Agency (FEMA) or
through a pass-through entity through the Robert T. Stafford Disaster Relief and
Emergency Assistance Act, or any other Federal agency for any portion of a project
activity approved for FTA funding under this Grant Agreement, the Recipient agrees to:
a. Provide written notification to FTA, and
b. Reimburse FTA for any Federal share that duplicates funding provided by FEMA or
another Federal agency,
6. Flood Insurance.
a. The Recipient understands and agrees as follows:

(1) It will obtain and maintain flood insurance as required by the Flood Disaster
Protection Act of 1973, 42 U.S.C. § 4012a(a), for any building located in a special flood
hazard area (100-year flood zone), if applicable, before drawing down Federal funds to
acquire, construct, reconstruct, repair, or improve that building, and
(2) Each such building and its contents will be covered by flood insurance in an amount
at least equal to the Federal investment or to the maximum limit of coverage made
available with respect to the particular type of property under the National Flood
Insurance Act of 1968, 42 U.S.C. § 4001 et seq., whichever is less, if applicable, and
b. The Recipient will comply with the insurance requirements normally imposed by its
State and local laws, regulations, and ordinances, if applicable, except as FTA
determines otherwise in writing.
7. Insurance.
a. If a Recipient, a Recipient’s third party contractor, or a Recipient’s third party
subcontractor receives insurance proceeds for any portion of a project activity prior to
the receipt of FTA Emergency Relief funds, then the Recipient shall provide written
notification to the FTA and reduce its request for FTA Emergency Relief funds by the
amount of insurance proceeds allocated for the project activity,
b. If the Recipient, a Recipient’s contractor, or a Recipient’s subcontractor receives
insurance proceeds for any portion of a project activity after FTA obligates funding
under this Grant Agreement, then the Recipient shall:
(1) Provide written notification to FTA in a timely manner, and
(2) If applicable, reimburse FTA for any Federal share that duplicates funding provided
through insurance proceeds,
c. If the Recipient, a Recipient’s third party contractor, or a Recipient’s third party
subcontractor receives insurance proceeds that are allocated based on damage to
specific assets, the provisions of FTA’s Circular 5010.1E will apply,
d. If the Recipient receives insurance proceeds that are unallocated to any project
activities, FTA and the Recipient will agree to an amount of insurance proceeds to be
allocated to transit recovery and to reduce the Federal share for this project accordingly.
The Recipient agrees to allocate those amounts by one of the following options:
(1) Reduce FTA participation proportionally for all projects (based on the ratio of transit-
allocated insurance to total transit damages),
(2) Apply proceeds to individual projects that are eligible for FTA funds, or
(3) Apply proceeds to projects on a first-come, first served basis after the allocation is
determined,
e. The Recipient agrees to submit quarterly Insurance Proceeds Reports (IPR) to FTA,
no later than thirty (30) calendar days after the end of each calendar quarter, which
include, at a minimum, the following information:
(1) The insurance policies that cover the Recipient for any damage sustained by
Hurricane Harvey, Irma, or Maria,

(2) Each insurance claim that the Recipient submitted in connection with damage

(3) The status of each insurance claim that the Recipient submitted in connection with
damage sustained by Hurricanes Harvey, Irma, or Maria from the commencement of
storm preparation through the date of the IPR,
(4) The total amount of insurance proceeds that the Recipient received in connection
with damage sustained by Hurricanes Harvey, Irma, or Maria from the commencement
of storm preparation through the date of the IPR,
(5) The status of the Recipient’s allocation of any insurance proceeds from the
commencement of storm preparation through the date of the IPR ,
(6) If the Recipient allocated insurance proceeds, then the Recipient shall identify
whether it allocated insurance proceeds towards an FTA funded project activity or a
non-FTA funded project activity, and
(7) If the Recipient allocated insurance proceeds towards an FTA funded project activity,
then the Recipient shall identify that project activity by Project Number and Activity Line
Item, and the Recipient shall identify the status of any grant action taken to adjust the
Federal share, accordingly,
8. Useful Life.
a. As authorized by 49 U.S.C. § 5324(d)(1) and FTA Circular 5010.1E, FTA’s useful life
requirements do not apply to any assets that were destroyed as a result of Hurricanes
Harvey, Irma, or Maria and were taken out of service prior to the end of their useful
lives, and
b. If the Recipient receives insurance proceeds for an asset and does not replace that
asset, then FTA’s useful life requirements apply, and the recipient must reimburse FTA
the remaining Federal interest in that asset in accordance with FTA Circular 5010.1E,
c. If the Recipient disposes of a previously FTA funded asset that was damaged during
Hurricanes Harvey, Irma, or Maria and receives more than $5,000 for the asset, the
Recipient will promptly notify FTA and reimburse FTA for its proportionate share in
accordance with FTA Circular 5010.1E,
9. Expenditure Authority.
a. Office of Management and Budget Memorandum (OMB) M-18-14 “Implementation of

10. Oversight Requirements.
a. The Recipient agrees to maximize the transparency and accountability of funds
authorized under the Bipartisan Budget Act of 2018, and in accordance with all
applicable Federal regulations, the Recipient agrees to maintain records that identify
adequately the source and application of these funds,
b. The Recipient understands and agrees that OMB Memorandum M-18-14, provides
that “[I]n disaster situation, fraud risks are higher than under the normal circumstances
because the need to provide services quickly can hinder the effectiveness of existing
controls and crate additional opportunities for individuals to engage in fraud” and “[A]ll
programs and activities expending more than $10,000,000, as provide in division B of
Public Law 115-123…in any one fiscal year shall be deemed to be ‘susceptible to
significant improper payments’ for purposes of the Improper Payments Information Act
of 2002 (31 U.S.C. § 3321 note), notwithstanding section 2(a) of such Act,” and
c. The Recipient agrees:
(1) To comply with any oversight requirements, and any periodic changes to those
requirements, that FTA establishes,
(2) To submit quarterly Federal Financial Reports to FTA, no later than thirty (30)
calendar days after the end of each calendar quarter, through FTA’s Transit Award
Management System (TrAMS),
(3) To submit quarterly Milestone Progress Reports to FTA, no later than thirty (30)
calendar days after the end of each calendar quarter, through FTA’s TrAMS system,
and
(4) That information contained in these reports may be made available to the public,
11. Floodplain Management.
a. The Recipient agrees to follow Executive Order 11988, as amended, Floodplain
Management, and any other guidance that FTA develops or amends regarding
floodplain management, except as FTA determines otherwise in writing,
b. The Recipient agrees that it will not use FTA funds for any construction activity or any
permanent repairs in an area delineated as a “special flood hazard area,” or equivalent,
as labeled in FEMA’s most recent and current data source, unless, prior to seeking FTA
funds for such action, the Recipient designs or modifies its actions in manner that
minimizes potential harm to or within the floodplain,
c. The Recipient agrees that it will use the “best available information” as identified by
FEMA, which includes advisory data such as Advisory Base Flood Elevations (ABFE),
preliminary and final Flood Insurance Rate Maps (FIRM), and Flood Insurance Studies,
d. If FTA and the Recipient determine that FEMA data is unavailable or insufficiently
detailed, then other Federal, State, or local data may be used as the “best available
information,” and
e. If an FTA funded project activity is located in a floodplain, then the “best available
information” requires a minimum baseline standard for elevation of no less than that
found in FEMA’s ABFEs, where available, or if that is not available, then a minimum
baseline standard for elevation of no less than FIRM,

12. Record Retention. The Recipient agrees to maintain records, including but not
limited to all invoices, contracts, time sheets, and other evidence of expenses, which
support and validate its funding requests,
13. Integrity. The Recipient agrees that all data that it submits to FTA in connection with
this Grant Award will be accurate, objective, and of the highest integrity,
14. Outside Agreements. The Recipient agrees to expeditiously develop and execute
any outside agreements, including any inter-agency agreements or any other third party
agreements, that are necessary to the completion of any project activities,
15. One-Time Funding. The Recipient acknowledges that receipt of funds through this
Grant Agreement is a one-time disbursement that does not create any future obligation
by FTA to advance similar funding amounts,
16. Failure to Complete the Project. The Recipient agrees to complete the project, if
applicable, as summarized in the resilience POP and described in this Grant
Agreement. Failure to complete the full scope may result in termination of the Grant
Agreement by FTA and FTA may require the Recipient to refund the entire amount or a
lesser amount of Federal funds provided for the Project, as FTA may determine,
17. Violations of Law. The Recipient agrees that it and each of its subrecipients must
report to the United States Department of Transportation Inspector General and any
other appropriate Inspector General any credible evidence that a principal, employee,
agent, contractor, subrecipient, subcontractor, or other person has submitted a false
claim under the False Claims Act, 31 U.S.C. § 3729 et seq., or has committed a criminal
or civil violation of law pertaining to fraud, waste, abuse, conflict of interest, bribery,
gratuity, or similar misconduct involving funds awarded in this Grant Agreement, and
18. Future Requirements. The Recipient agrees to comply with applicable future Federal
requirements that may be imposed on the use of funds disbursed through the Bipartisan
Budget Act of 2018, and FTA’s Public Transportation Emergency Relief Program
regulations and guidance.

Application Executive Summary: This is an FY 2018 Section 5324 D2018–EMER–004 application in the
amount of $196,978. The application is for the repair of damages to Collier Area Transit facilities and
vehicles caused by Hurricane Irma in September 2017. The damages for repair include structural steel
repair, Gutter/leader replacement, interior fencing, garage door replacement, and bus wrap replacement.
Funding will also be used for operating expenses such as labor costs and equipment costs that were
incurred by our vendor. A breakdown of these costs is included in this application (Attachment # 23).
Operating expenses total $57,823 and capital expenses total $139,155. Collier County will provide a local
share in the amount of $12,620 for a portion of the capital expenditures. Collier County did submit an
insurance claim for these projects and the adjuster responded with an estimate of $170,450.01 to cover
capital damages. Collier County also submitted a claim to FEMA for reimbursement for capital damages,
but no FEMA reimbursements have been received to date. This project only includes emergency
operations, emergency protective measures, and emergency repairs/permanent repairs with no
functional, location, or capacity change. Therefore, no TIP/STIP documentation is needed per Emergency
Relief Program requirements. Indirect costs will not be applied to this application and its scope of work.
The grant is for $184,358, Collier County received an ER allocation of $226,000, Collier County will create
a second grant or an amendment to come in for the excess funds once/if a second allocation of the
additional requested $82,000 is available.

Appendix A. Conditions of Award for Emergency Relief Grants
The following Conditions of Award must be included in the grant agreement for any
grants made using Hurricane Harvey, Irma, and Maria supplemental funding through
FTA’s Emergency Relief Program. Depending on the purpose of the grant, include
either the language shown under “Emergency Response, Recovery, and Rebuilding” or
“Resilience Grants”. The language below is subject to change by FTA’s Office of the
Chief Counsel without prior notice, and without subsequent revision in this toolkit.
Consult your Regional Counsel to confirm the correct Conditions of Award when
developing a grant under this program.
Conditions of Award for FTA’s Public Transportation Emergency Relief Program Grants.
The Recipient agrees that the following Conditions of Award apply to grants for projects
funded under the Response, Recovery, and Rebuilding Allocation and Resilience
Allocation of the Public Transportation Emergency Relief Program as described in the
Federal Register notice “Allocation of Public Transportation Emergency Relief Funds in
Response to Hurricanes Harvey, Irma, and Maria.” These Conditions of Award
supersede any conflicting provisions of this Grant Agreement and applicable Master
Agreement, unless FTA determines otherwise in writing:
1. This award is authorized by 49 U.S.C. § 5324, which established FTA’s Emergency
Relief Program and funded by an appropriation under the Bipartisan Budget Act of
2018, Public Law 115-123, February 9, 2018, which provides funding for transit systems
affected by Hurricanes Harvey, Irma, and Maria. This grant supports projects described
in FTA’s Federal Register notice “Allocation of Public Transportation Emergency Relief
Funds in Response to Hurricanes Harvey, Irma, and Maria” 83 FR 25104, May 31,
2018,
2. FTA Notice. The Recipient agrees to follow FTA’s Federal Register notice “Allocation
of Public Transportation Emergency Relief Funds in Response to Hurricanes Harvey,
Irma, and Maria” 83 FR 25104, May 31, 2018, pertaining to the Emergency Relief
Program Grants, and any later revision of the FTA notice; any future FTA notices of
Emergency Relief Program funding availability; and FTA’s Emergency Relief Program
Final Rule, except as FTA determines otherwise in writing,
3. Eligible Projects – Limitations. Funding under this Grant Agreement may be used only
for projects determined eligible for funding under FTA’s Emergency Relief Program, and
may not be used for projects determined ineligible,
4. Federal Share. The specific Federal share for this Project is identified on this Grant
Agreement. As the Recipient may request, the Federal share may be up to One
Hundred (100) percent of the net project cost for emergency operations, emergency
protective measures, and emergency repair projects for costs incurred for up to 270
days from the date of the applicable major disaster declaration and up to Ninety (90)
percent of the net project cost for other projects. For resilience projects or components
of projects, the Federal share may be up to Eighty (80) percent of the net project cost.
5. Federal Emergency Management Agency Funding Assistance. If the Recipient
receives Federal funding from the Federal Emergency Management Agency (FEMA) or
through a pass-through entity through the Robert T. Stafford Disaster Relief and
Emergency Assistance Act, or any other Federal agency for any portion of a project
activity approved for FTA funding under this Grant Agreement, the Recipient agrees to:

a. Provide written notification to FTA, and
b. Reimburse FTA for any Federal share that duplicates funding provided by FEMA or

6. Flood Insurance.
a. The Recipient understands and agrees as follows:
(1) It will obtain and maintain flood insurance as required by the Flood Disaster
Protection Act of 1973, 42 U.S.C. § 4012a(a), for any building located in a special flood
hazard area (100-year flood zone), if applicable, before drawing down Federal funds to
acquire, construct, reconstruct, repair, or improve that building, and
(2) Each such building and its contents will be covered by flood insurance in an amount
at least equal to the Federal investment or to the maximum limit of coverage made
available with respect to the particular type of property under the National Flood
Insurance Act of 1968, 42 U.S.C. § 4001 et seq., whichever is less, if applicable, and
b. The Recipient will comply with the insurance requirements normally imposed by its
State and local laws, regulations, and ordinances, if applicable, except as FTA
determines otherwise in writing.
7. Insurance.
a. If a Recipient, a Recipient’s third party contractor, or a Recipient’s third party
subcontractor receives insurance proceeds for any portion of a project activity prior to
the receipt of FTA Emergency Relief funds, then the Recipient shall provide written
notification to the FTA and reduce its request for FTA Emergency Relief funds by the
amount of insurance proceeds allocated for the project activity,
b. If the Recipient, a Recipient’s contractor, or a Recipient’s subcontractor receives
insurance proceeds for any portion of a project activity after FTA obligates funding
under this Grant Agreement, then the Recipient shall:
(1) Provide written notification to FTA in a timely manner, and
(2) If applicable, reimburse FTA for any Federal share that duplicates funding provided
through insurance proceeds,
c. If the Recipient, a Recipient’s third party contractor, or a Recipient’s third party
subcontractor receives insurance proceeds that are allocated based on damage to
specific assets, the provisions of FTA’s Circular 5010.1E will apply,
d. If the Recipient receives insurance proceeds that are unallocated to any project
activities, FTA and the Recipient will agree to an amount of insurance proceeds to be
allocated to transit recovery and to reduce the Federal share for this project accordingly.
The Recipient agrees to allocate those amounts by one of the following options:
(1) Reduce FTA participation proportionally for all projects (based on the ratio of transit-
allocated insurance to total transit damages),
(2) Apply proceeds to individual projects that are eligible for FTA funds, or

(3) Apply proceeds to projects on a first-come, first served basis after the allocation is

no later than thirty (30) calendar days after the end of each calendar quarter, which
include, at a minimum, the following information:
(1) The insurance policies that cover the Recipient for any damage sustained by
Hurricane Harvey, Irma, or Maria,
(2) Each insurance claim that the Recipient submitted in connection with damage
sustained by Hurricanes Harvey, Irma, or Maria, for capital and operating costs, from
the commencement of storm preparation through the date of the IPR,
(3) The status of each insurance claim that the Recipient submitted in connection with
damage sustained by Hurricanes Harvey, Irma, or Maria from the commencement of
storm preparation through the date of the IPR,
(4) The total amount of insurance proceeds that the Recipient received in connection
with damage sustained by Hurricanes Harvey, Irma, or Maria from the commencement
of storm preparation through the date of the IPR,
(5) The status of the Recipient’s allocation of any insurance proceeds from the
commencement of storm preparation through the date of the IPR ,
(6) If the Recipient allocated insurance proceeds, then the Recipient shall identify
whether it allocated insurance proceeds towards an FTA funded project activity or a
non-FTA funded project activity, and
(7) If the Recipient allocated insurance proceeds towards an FTA funded project activity,
then the Recipient shall identify that project activity by Project Number and Activity Line
Item, and the Recipient shall identify the status of any grant action taken to adjust the
Federal share, accordingly,
8. Useful Life.
a. As authorized by 49 U.S.C. § 5324(d)(1) and FTA Circular 5010.1E, FTA’s useful life
requirements do not apply to any assets that were destroyed as a result of Hurricanes
Harvey, Irma, or Maria and were taken out of service prior to the end of their useful
lives, and
b. If the Recipient receives insurance proceeds for an asset and does not replace that
asset, then FTA’s useful life requirements apply, and the recipient must reimburse FTA
the remaining Federal interest in that asset in accordance with FTA Circular 5010.1E,
c. If the Recipient disposes of a previously FTA funded asset that was damaged during
Hurricanes Harvey, Irma, or Maria and receives more than $5,000 for the asset, the
Recipient will promptly notify FTA and reimburse FTA for its proportionate share in
accordance with FTA Circular 5010.1E,
9. Expenditure Authority.
