Agenda 04/09/2019 Item #11B04/09/2019 EXECUTIVE SUMMARY Recommendation to approve a resolution that conceptually approves the issuance of a transfer of development rights (TDR) credit to private property owners located within the primary/secondary flowway of Collier County Comprehensive Watershed Improvement Project who will voluntarily encumber their land with a flowway easement/agreement to allow the flow of this re -hydration water across their property and to direct staff to include changes to the Growth Management Plan with the Rural Fringe Mixed Use restudy amendments to the Growth Management Plan. OBJECTIVE: To develop TDR incentives that will entice private property owners to execute a flowway easement/agreement to flow water across their property if within the primary/secondary fl owway of the Collier County Comprehensive Watershed Improvement Project CONSIDERATIONS: On July 10, 2018 (Item 11H), the Board of County Commissioners approved the Project definition and permitting activities for the Collier County’s Comprehensive Watershed Improvement Plan (CWIP) project. This project utilizes the ten (10) major studies and reports developed by various local, state and regulatory agencies over the past 15 years to reduce freshwater flows into Naples Bay, restore fresh water flows into Rookery Bay, improve water quality and re-hydrate approximately 10,000 acres of the Picayune Strand State Forest (PSSF) commonly referred to as the South Belle Meade area. This is accomplished by linking hydrologic and ecological restoration projects that will function on a regional basis and allow the County to manage its natural resources in a more holistic, comprehensive manner. Additionally, this project will complement the bordering Federal CERP- Picayune Strand Restoration Project currently being executed by the US Army Corp of Engineers and South Florida Water Management District. Critical to the success of this project will be the rehydration and flow of water within the PSSF which was purchased by the State of Florida for rehydration in the 1970’s. The majority of the 10,000 to 15,000 acres that makeup the forest is publicly owned. However, approximately 100 privately owned parcels are located within the primary and secondary flowway and of these parcels not more that 50 would be considered critical where a flowway easement or agreement would need to be executed. These parcels are located in a Future Land Use subdistrict designated as Rural Fringe Mixed Use District (RFMUD)/Sending. The following stipulations would apply to the additional TDR credit for the flowway: • The owner will be eligible to apply for the TDR credit for a period of 2 years only. • The additional TDR credit for the flowway easement or agreement does not require that property ownership be transferred to the State. FISCAL IMPACT: Funding is available in Project 33554 and funded through RESTORE, a US Department of Treasury Direct Component (Pot1) Grant, along with a Gulf Consortium (Pot 3) Grant to potentially provide exotic vegetation removal and maintenance as an incentive to property owners to work to rehydrate the PSSF and save money by avoiding the condemnation process. GROWTH MANAGEMENT IMPACT: Implementation of this program will be consistent with environmental goals in the CCME and will support the RFMUD TDR program goals of governmental ownership and adequate supply of credits to buyers.
