During that time I have watched the gradual decay of the Rural Estates quality of life. The residents of GGE-Unit 4 have located for the same reasons as those of other GGE residents; affordability, tranquility, avoidance of urban traffic, and an appreciation for wildlife. Unfortunately, it seems the residents of GGE-Unit 4 are paying a much higher price than any other unit within GGE as it is bordered by major roadways to the north, south and west; not to mention that Weber Boulevard South has become a high-speed bypass for Collier Boulevard. To that end, Weber Boulevard South already served, via 1st Avenue SW, as access to two Jehovah's Witness Kingdom Halls operating on the same property, Max Hasse Community Park, and what was a failed Presbyterian Church located at 3380 Golden Gate Boulevard West (approximately 3,200 feet east of the subject property) which was purchased in September, 2018, by the petitioner. The residents in this area are frustrated with the amount of traffic, the lack of traffic 1 control, and the loss of the rural estates character and quality of life. The residents I have spoken with all believe that a traffic generating use at the subject location is an accident waiting to happen. Interestingly, you have heard this petition before and a vote was taken which resulted in the project's defeat: unfortunately, as a result of comments made by the petitioner's counsel after the close of public comment, Commissioner McDaniel motioned for the vote to be withdrawn and the item be sent back to the Planning Commission (CCPC). The comment made by the petitioner's counsel was that you, the BCC, have rejected the last three churches that were proposed at major intersections and that he no longer knows where to tell clients they can have a church. Commissioner McDaniel also noted that he would have liked to have seen better notification to the residents of GGE and desired to see if anything could be done to ameliorate the impacts of a church on the community. To that end, the petition was re-heard by the CCPC however only minimal changes resulted. More concerning is the fact there was no greater effort to notify the estates residents of this project and based upon the location of this project it will impact upon many GGE residents. As such, please note that your staff just held extensive outreach efforts with respect to the new Golden Gate Area Master Plan (GGAMP) that was recently approved by you for transmittal to the State. The subject location is located within the Rural Estates. GGAMP outreach efforts performed by your staff examined uses and recommended areas for change as based upon their findings; no changes were proposed for the subject properties and the general consensus of the study was that Rural GGE residents ultimately desired no changes that would impact upon the rural estates quality of life. The Rural GGE residents have spoken and you are urged to respect their desires. As to the question posed by the petitioner's counsel, there should have never been an expectation that a church could be permitted at the subject location as it is not allowable by either the existing GGAMP nor that just transmitted to the State. The criteria for applying for a small scale amendment to the GGAMP are very few and nearly everyone eligible to apply will satisfy said criteria, as such your staff should be much more critical in evaluating and analyzing such petitions; your constituents are counting on you to make things right. There is no question that property located within the GGE is less expensive than that in the urban area. Does that mean every GGE intersection is destined to be approved for a conditional use? How much sense does that make? Please, the subject project is not necessarily a bad one; unfortunately, the location is horrible. Any applicant for a conditional use should expect push-back; alternatively, they'd likely be welcomed at an appropriately zoned commercial location. I'd further suggest that the County define the term "community church" as perhaps at a lesser scale the project wouldn't be quite as problematic at the subject location. GGE is home to much of the areas working class, weekends are when these residents are outside trying to enjoy their peace and tranquility, weekends are when they walk the narrow sidewalks that offer little protection from the speeding traffic; the residents of GGE-Unit 4 should expect no less quality of life than any other GGE residents. Please note that the Grace Romanian Baptist Church is not without a home. As per the petitioner's website, tl.y„V,e,Y.. ,"w zw the church presently has services at and is housed at the 3380 Golden Gate Boulevard West. This location is far better suited for a traffic generating use of this type as there is a traffic light at this location; additionally, as per the site's most current Site Development Plan, only Phase 1 has been completed and there is plenty of space for expansion. To my knowledge, absolutely nobody has opposed or said anything negative about this location. Be it noted the petitioner also owns a third location at 6645 Willow Park Drive which is within a Commercial Planned Unit Development. 2 In closing, GGE-Unit 4 has already been disadvantaged and we seek to prevent even further decay to the rural quality of life enjoyed by other GGE residents. The traffic impact caused by the already approved non-estates uses are considerable and any increase to traffic will likely be detrimental. Lastly, please be reminded that the southern side of GGE-Unit 4 could be just as problematic and the actions taken on this petition could set precedent for that side. As the residents of GGE have spoken during the GGAMP re-study, you are asked to bide by their desires to maintain the Rural GGE as rural. The estates is more than a zoning classification, it's a quality way of life. I attended the last meeting even though I only found out about it less than 24 hours prior. I witnessed the deceptive measures one lawyer would take to represent his client. What a turn off. He did not inform all property owners of their intentions,as he claimed. I was not informed. The fact remains the impact that Weber Blvd South will suffer due to heavy traffic in a residential street is monumental and is contrary to what he claimed. Obviously, no vehicles are going to exit on to Weber Blvd, turn right onto GG Blvd to make a U-turn and go back to Collier Boulevard. They will all drive south right down Weber and right past my home. I did not buy this home 19 years ago because I wanted to live near a freeway. I bought in a residential area. I have been a resident of Naples for 40 years and have watched the destruction done to many areas in the name of growth! To frame it bluntly, a church/drug rehab center has no place here. We have very high property values and want it kept that way! I do not appreciate the fact that they are so misrepresenting their intentions and once they sell, the restrictions will not have to be followed by the next buyer. The biggest complaint I have is,economically commercial properties should not be allowed in residential neighborhoods. I do not want to send a message that it is ok to spot zone commercial. This is clearly a black and white matter. I appreciate your time considering what I and so many other residents are saying and I trust that you will rule as if you were in our shoes and your money, and your privacy was in jeopardy. We walk our dog on 1st Ave and Weber and have almost been hit several times by speeding school parents or church members. We have complained about the speeders to the sheriff's department, but they have done nothing to alleviate the problem. We already have to deal with parent lining up on 1St between 2 and 3 pm to pick up their kids, making it a virtual parking lot. We also have to deal with cut through traffic on Weber, almost always above the 35 mph speed limit. We do not need another 300 parishioners traveling on Weber or 1St almost every day of the week. I cannot personally attend.Thank you. -Lauren Osborne 1 I was asked to contact you in reference to this possible amendment located at the property at the corner of Collier Blvd and Golden Gate Blvd. The public hearing request is in reference to the building of a church there, Grace Romanian. Project Number:PL20160002577 and PL20160002584 I'd like to submit this letter, as I cannot personally attend the hearing that is set for Tuesday, February 26th at 9am, as a petition against the building of a church. My family and I live on Weber Blvd South just about a block away from this property. Modifying the amendment to allow the building of a church at this property, which would cause a lot more vehicular traffic, is definitely not what Weber Blvd South needs. Weber Blvd S is already used as a thru street for rush hour traffic Monday through Friday from Collier Blvd morning and evening, as well as for Big Cypress Elementary School Monday through Friday when school is in session, morning and afternoon. During the peak of these times, I refuse to walk on the sidewalk with my children along Weber Blvd S because of the consistent traffic speeding highly above the posted 30mph speed limit. I'm even very nervous about checking my mailbox. The Collier County Sheriffs Office has been requested numerous times to conduct speed enforcement along the road. There is no raised curb along the road and the sidewalk is only just 1 foot away from the main road. In addition, recently new traffic patterns at the intersection of Golden Gate Blvd and Weber Blvd S, as well as the intersection of Weber Blvd S and White Blvd, have denied traffic from making left turns. I want to bring your attention to two concerns Audubon Western Everglades has with the Conservation Collier ordinance revisions on your Summary agenda tomorrow (both were raised in the first reading last month): 1. Section 14, Policy 7:Audubon Western Everglades recommends keeping the language that is stricken in order to allow for lot trading to help complete multi-parcel acquisition projects like Red Maple Swamp and Winchester Head (both in Golden Gate Estates). The idea is that if the Conservation Collier had bought an upland lot in the Estates or elsewhere and it no longer met the needs of the program, it could be traded with the owner of a lot within the multi-parcel project area being acquired. So far, that apparently hasn't occurred but it is just a strategy that seems possibly useful. 2. Most importantly, there is a Whereas clause portion in the existing ordinance that dedicates use of Conservation Collier funds to the purposes of the program which Audubon and our conservation colleagues want retained. Despite staff's assertion that it remains part of the legislative history, it's deletion appears to anyone not a lawyer to mean such a dedication or restriction on the use of Conservation Collier funds no longer exists. The Whereas Clause is the 5th one in the proposed revised ordinance. Here is the deletion of that dedication reference in strikethrough form (a deletion not shown in the proposed revised ordinance): WHEREAS,it is the intent of the Board of County Commissioners of Collier County to establish Conservation Collier to implement this mandate and to support its purposes to the fullest, '•-' '• . - : , .- '• - ••-• -. . :-, - - - '- _ - - =- =_ - ;and I've asked another commissioner to pull this off the Summary agenda, but it would be great if you supported that and the brief discussion needed to sort these two issues out. Unfortunately, it seems the residents of GGE-Unit 4 are paying a much higher price than any other unit within GGE as it is bordered by major roadways to the north, south and west; not to mention that Weber Boulevard South has become a high-speed bypass for Collier Boulevard. To that end, Weber Boulevard South already served, via 1st Avenue SW, as access to two Jehovah's Witness Kingdom Halls operating on the same property, Max Hasse Community Park, and what was a failed Presbyterian Church located at 3380 Golden Gate Boulevard West(approximately 3,200 feet east of the subject property)which was purchased in September, 2018, by the petitioner. The residents in this area are frustrated with the amount of traffic, the lack of traffic control, and the loss of the rural estates character and quality of life. The residents I have spoken with all believe that a traffic generating use at the subject location is an accident waiting to happen. Interestingly, you have heard this petition before and a vote was taken which resulted in the project's defeat; unfortunately, as a result of comments made by the petitioner's counsel after the close of public comment, Commissioner McDaniel motioned for the vote to be withdrawn and the item be sent back to the Planning Commission (CCPC).The comment made by the petitioner's counsel was that you,the BCC, have rejected the last three churches that were proposed at major intersections and that he no longer knows where to tell clients they can have a church. Commissioner McDaniel also noted that he would have liked to have seen better notification to the residents of GGE and desired to see if anything could be done to ameliorate the impacts of a church on the community. To that end,the petition was re-heard by the CCPC however only minimal changes resulted. More concerning is the fact there was no greater effort to notify the estates residents of this project and based upon the location of this project it will impact upon many GGE residents. As such, please note that your staff just held extensive outreach efforts with respect to the new Golden Gate Area Master Plan (GGAMP)that was recently approved by you for transmittal to the State. The criteria for applying for a small scale amendment to the GGAMP are very few and nearly everyone eligible to apply will satisfy said criteria, as such your staff should be much more critical in evaluating and analyzing such petitions;your constituents are counting on you to make things right. There is no question that property located within the GGE is less expensive than that in the urban area. Does that mean every GGE intersection is destined to be approved for a conditional use? How much sense does that make? Please, the subject project is not necessarily a bad one; unfortunately, the location is horrible.Any applicant for a conditional use should expect push-back; alternatively, they'd likely be welcomed at an appropriately zoned commercial location. I'd further suggest that the County define the term"community church"as perhaps at a lesser scale the project wouldn't be quite as problematic at the subject location. As per the petitioner's website, [www.grbcn.org,](http://www.grbcn.org,)the church presently has services at and is housed at the 3380 Golden Gate Boulevard West. This location is far better suited for a traffic generating use of this type as there is a traffic light at this location;additionally,as per the site's most current Site 2 Development Plan, only Phase 1 has been completed and there is plenty of space for expansion. To my knowledge, absolutely nobody has opposed or said anything negative about this location. Be it noted the petitioner also owns a third location at 6645 Willow Park Drive which is within a Commercial Planned Unit Development. In closing, GGE-Unit 4 has already been disadvantaged and we seek to prevent even further decay to the rural quality of life enjoyed by other GGE residents. The traffic impact caused by the already approved non-estates uses are considerable and any increase to traffic will likely be detrimental. Lastly, please be reminded that the southern side of GGE-Unit 4 could be just as problematic and the actions taken on this petition could set precedent for that side. As the residents of GGE have spoken during the GGAMP re-study,you are asked to bide by their desires to maintain the Rural GGE as rural. The estates is more than a zoning classification, it's a quality way of life. They are proposing a church at the corner of Collier Blvd, and Golden Gate Blvd. There is only one entrance/exit proposed off of Golden Gate Blvd. This is a terrible idea. My wife and I live on Weber Blvd and we already have too much traffic bypassing Collier going to Golden Gate Blvd. We purchased in the estates to have extra land for our three grandsons. By adding this commercial building it will make this street less safe for children and wildlife. The Golden Gate Master plan was just approved by the board last month, and it did not include changing the church property. The people of this area, like the rural lifestyle and do not want commercialization. We are asking that this change in the master plan is not approved. At a minimum, there should be an entrance and exit only accessible on Collier Blvd. Please keep any additional traffic off of Weber Blvd. It is barely wide enough for the traffic that is currently on it now. 1 Thanks, David and Vickie Stonitsch 840 Weber Blvd S Naples, FL 34117 2 Filso:1Sue From: McDanielBill Sent: Monday, February 25, 2019 7:13 AM To: 'James Schortemeyer' Subject: RE: Ordinance petition PL20160002584/CPSS-2017-1, as resubmitted February 2019 Mr. Schortemeyer, Thank you for sharing your additional comments and suggestions. The proposed church on the corner of GGB and 951 should not be approved. Strictly from a traffic aspect, the property will greatly affect the residential neighborhood around it with increased traffic. The application calls for a 24/7 operation, and the size of the property is a sure indication of future expansion plans. The application also acknowledges that if they are successful in rezoning this property, the one on the North side of the intersection will follow suit. Also, the vagueness of the answers provided to the residents of GGE at the neighborhood meeting are disconcerting to put it mildly: "Approximately 23 citizens, 4 members of the applicant's team, and the 2 planners from the County attended the NIM. Questions and concerns from the attendees included: • • Number of acres for project site? 6.25 acres • '• Number of square feet of storage shed? 1,800 sq. feet • • Types of special events? Not defined yet • •Where will special events be held on the site? in the pastor's residence? Outdoors? If outside, could be in parking area, or in open area, if pastor residence not built. • •Traffic is already a nightmare. Applicant will continue to work with County staff. • •Traffic access to site locations. Applicant will continue to work with County staff. • •Could a bridge entrance be constructed over the Collier Blvd. canal? Not possible, since land that would be needed does not belong to church and safe distance from Golden Gate Blvd could not be accommodated. • • If an event is held in parking area, where will people park?As part of a special event permit a parking plan is required. • • Do not want carnival or revival type events. Agent asked if citizen wanted any other types of events eliminated. • • Speeding on Weber Blvd. Citizens need to work with Sherriff's office. • • Have an off-duty officer for traffic control. • • Churches do not pay property taxes. • •What will be cleared in the preserve area? Only native vegetation would remain. • • Dates of Public Hearings. No dates were set yet. " • Before the permit should even be considered, the applicant at the least should come back to the residents and address the concerns listed above. Otherwise, the approval of this rezoning is essentially an open book to do what they want with no consideration of the impact to the neighbors in a residential neighborhoods peace, privacy and home values. Did this church shrink in size they bought and rezoned then sold land in 2011 on Learning Lane and Livingston Road because they were asking for 500 seats and 150 preschool students on 14.3 acres. They acquired property on Golden gate Blvd and 1st Ave SW looking to rezone as conditional use purchased on 11/28/16 Then purchased another property at 6645 Willow Park Drive less than a year ago purchased on 12/11/17 I believe there attorney said they have outgrown this property as well. But failed to mention the new church they recently purchased. I will ask all commissioners these questions, when you purchase property in a residential neighborhood did you plan on changing the zoning? Do you want a church and traffic associated with it next to your home? Would you want somebody to change zoning in your in your residential neighbor hood? Would you like drug rehabilitation center next to your home? Do you think its in your neighborhoods best interests to have drug rehabilitation and traffic associated with a church? We have seen no plans of the actual building, just plotted land and parking, septic drain field. There was an environmental study completed? How did they forget the land purchased for a supply well by Collier County off 1st Ave SW less than 100 feet away from proposed church drain field. 2 A seating capacity of 300 on septic system is not acceptable for anyone in the vacinity using well water for drinking supply that would be everyone. Is there room for a sewer water treatment plant on the subject property? No sewer available, should not be allowed. Grace Romanian Baptist Church had another piece of land rezoned conditional use, they sold it. I appose anything other than residential estates, keep it residential estates. This is the gateway to the Golden Gate Estates. Thanks For Your time Gary VanDeWerken Under Florida Law, e-mail addresses are public records.
