EXECUTIVE SUMMARY
Recommendation to approve a Resolution for final acceptance of the roadway and drainage
improvements, and acceptance of the plat dedications, for the final plat of Faith Landing Phase
Three, Application Number PL20140000050, and authorize the release of the maintenance security.
OBJECTIVE: To have the Board of County Commissioners (Board) grant final acceptance of the
infrastructure improvements associated with the subdivision, accept the plat dedications, and release the
maintenance security.
CONSIDERATIONS:
1) On December 3, 2015, the Growth Management Department granted preliminary acceptance of
the roadway and drainage improvements in Faith Landing Phase Three.
2) The improvements within the public right-of-way (Tract R) will be maintained by Collier County.
All other drainage improvements will be maintained by the Faith Landing homeowner’s
association.
3) The required improvements have been constructed in accordance with the Land Development
Code. The Growth Management Department has inspected the improvements and is
recommending final acceptance of the improvements.
4) A resolution for final acceptance has been prepared and approved by the County Attorney's
Office. The resolution is a requirement of Section 10.02.05 C of the Land Development Code. A
copy of the document is attached.
FISCAL IMPACT: The roadway and drainage improvements, with the exception of Tract R, will be
maintained by the project’s homeowner’s association. The existing security in the amount of $75,185.40
will be released upon Board approval, pursuant to the terms of the Construction and Maintenance
Agreement dated October 29, 2015.
GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with this
action.
LEGAL CONSIDERATIONS: This item has been approved as to form and legality, and requires a
majority vote for Board approval. - SAS
RECOMMENDATION: To accept final acceptance of the roadway and drainage improvements in
Faith Landing Phase Three, Application Number PL20140000050, and authorize

improvements, and acceptance of the plat dedications.
2. The Clerk of Courts to release of the maintenance security.

RECITALS:

Developer has. simultancously with the delivery of this Agreement, applied fbr the approval
by the Board of a certain plat of a subdivision to be known as: FAITH I.ANDING PTJASE

Clhapters 4 and l0 of the Collier County [.and Development Code requires the [)ercloper to
post appropriate guarantees lor the construction of the improvements required by said
subdivision regulations, said gLlarantees to be incorporated in a bonded agreement fbr the
construction of the recluired improvements.
NOW. 'fHERIll'ORF.. in consideration of the fbregoing premises and mutual covenants
hereinafier set fbrth. Developer and the Board do hereby covenant and agree as follows:
Developer will cause to be constructed: Roadway, drainage, water & sewer lmprovements
r.vithin l2 months fiom the date of'approval said subdivision plat. said improvenlents
hereinatier ref-erred to as the required irnprovements.
Developer herewith tenders its subdivision perfbrmance security (attached hercto as
Uxhihit "A" and by relerence made a part hercof) in the amount of seventy five
thousand. one hundred and eighty llve clollars and lorty cents.($7S.18-5.40) which
amount represents l0% of the total contract cost to complete construction plus 100%
of the estimated cost to complete the required improvements at the c'late of this
Agreement.
In the evcnt of dclault by the Devclopcr or failure of the Developer to conrplcte such
improvements within the time required by the [-and Developrnent Code. C'ollicr
County. may call upon the subdivision performance security to insure satisfactory
completion of the required improvcmcnts.
.l'he required irnprovements shall not be considered complete until a statement ol-
substantial conrpletion by Developer's engineer along with the final pro.iect records
har,'e been firrnished to be reviewed and approved by' the County Managcr or his
designee firr cornpliance u,ith the (lollier C'ounty I-and l)evelopment Code.

flre Cotrnty Manager or his designee shall, within sixty (60) days ol receipt of the
statement of substantial completion, eithcr: a) notity the Developer in writing of his
preliminary approval of the improvements; or b) notily the Developer in rvriting of his
re firsal to approve improve ments. therewith specilying thosc- conditions which the
l)eveloper must l-ulfill in order to obtain the Cour.rty Manager's approval o[' the
improvements. l{owever, in no event shall the County Manager or his designee refuse
preliminary approval of the improvements if thcy are in t'act constructed and submitred
tilr approval in accordance rvith the requirements of this Agreement.
'I'he Developer shall maintain all required improvements fbr a minimum period of one
year after preliminary approval by the County Manager or his designee. After the orre
year maintenance period by the Developer has terminated, the Developer shall perition
the County Manager or his designee to inspect the required improvements. -fhe County
Manager or his designee shall inspect the improvements and, if tbund to be still in
compliance with the Collier County l-and Development Code as rellectcd by final
approval by the Board. the Board shall release the remaining l0% ol the subdivision
pcrtbrmance security. 'fhe Developer's responsibility lbr maintenance of the required
improvements shall continue unless or until the Board accepts maintenance
responsibility lor and by the County.
Six (6) months after the execution of this Agreement and once within every six (6)
months thereafter the Developer may request the County Manager or his designee to
reduce the dollar amount of the subdivision perlorrnance security on the basis of work
complete, Each request lor a reduction in the dollar amount of the suhdivision
performance security shall be accompanied by a statement ofsubstantiaI completion by
the Developer's engineer together with the project records necessary lbr review by the
County Manager or his designee. The County Manager or his designce may grant the
request fbr a reduction in the amount of the subdivision perfbrmance security for the
improvements completed as ofthe date of the request.

In the event the Developer shall tail or neglc.ct to f'ulfill its obligations under rhis
Agreement, upon certification ofsuch failure, the County Manager or his designee may
call upon the subdivision performance security to secure satisfactory completion,
ropair and maintenance ol the required improventents. The Board shall have the right
to construct and maintain, or cause to be constructed or maintained, pursuant to public
adve(isement and receipt and acceptance ol bids. the improvements required herein.'lhe Developer. as principal under the subdivision performance security. shall be iiableb pay and to indemnily the Iloard, upon conrpletion of such construction, the final
total cost to the Lloard thereof. including, but not limited to, engineering, legal and
contingent costs. tog!.ther with any damages, either dircct or conscquc'ntial, which the
Board may sustain on account of the failure of the Developer to fultlll all of thc
provisions of this Agreement.
