EXECUTIVE SUMMARY
Recommendation that the Board of County Commissioners, acting as the Community
Redevelopment Agency Board (CRAB), approve and authorize the Chairman to sign the First
Amendment to the approved Grant Agreement between the CRA and Residential Options of
Florida (ROOF) to extend the construction start date, after the fact, for renovations to a single -
family home to establish Independence Place, located in the Immokalee Community
Redevelopment Area.
OBJECTIVE: To receive approval of an extension to the previously approved grant agreement between
the CRA and Residential Options of Florida (ROOF) for the reimbursement of $30,000 for renovations to
a single-family home to establish Independence Place, located in the Immokalee Community
Redevelopment Area.
CONSIDERATIONS: On February 27, 2018, Agenda Item 16B1, the BCC approved a grant agreement
between the CRA and Residential Options of Florida (ROOF) for the reimbursement of $30,000 for
renovations to a single-family home to establish Independence Place, located in the CRA.
Paragraph 10 of the approved grant agreement stipulates that “…if GRANTEE fails to make the
improvements pursuant to the terms of this Agreement, the Community Redevelopment Plan or Chapter
163, Florida Statutes, including construction start within 90 days of execution of this Agreement and
completion within 12 months of execution of this agreement, the award shall be deemed revoked and
GRANTEE shall be entitled no funding”.
Per the agreement, construction was to begin on May 28, 2018. However, due to requirements from other
funders, the contractor did not begin work at the site until September 28, 2018. The building permit was
issued on August 8, 2018 and the contractor proceeded with the renovations as outlined in the permit. The
improvements outlined in the Agreement have been completed and a Certificate of Occupancy has been
issued and the contractor has been paid in full.
Residential Options of Florida (ROOF) requested the grant funds and during review for payment, the
CRA was made aware of the conflict with the construction start date during review by the Finance
Department. This amendment would extend the grant construction start date by 123 days giving them 213
days to start the construction of this project and allow funds to be reimbursed.
FISCAL IMPACT: Local funds in the amount of $30,000 are available in Immokalee CRA Fund (186)
Grants and Debts Services.
GROWTH MANAGEMENT IMPACT: This project is consistent with the Immokalee Area Master
Plan.
ADVISORY COMMITTEE RECOMMENDATIONS: At the October 25, 2017 joint meeting of the
Immokalee CRA Advisory Board and Immokalee Lighting and Beautification MSTU Advisory Board
meeting, the CRA Advisory Board voted unanimously (5-0) with Dr. Frank Nappo recusing himself from
the vote, to allocate $30,000 to ROOF for the development of Independence Place.
LEGAL CONSIDERATIONS: This item is approved as to form and legality, and requires majority
vote for approval. - JB
