EXECUTIVE SUMMARY
Recommendation to approve the acquisition of three Drainage, Access and Maintenance Easements
by Collier County for the maintenance of a portion of the Golden Gate Main Canal. Estimated
fiscal impact: $5,200. (Project # 60194)
OBJECTIVE: To obtain three Drainage, Access and Maintenance Easements for the maintenance of a
portion of the Golden Gate Main Canal beginning at Livingston Road and extending west across three
properties for a total distance of approximately 9,100 feet.
CONSIDERATIONS: On or about September 25, 1962, as set forth in the document recorded in Book
121 at Page 172, et seq., of the Official Records of Collier County, Barron Collier, Jr., joined by his wife,
Marguerite Collier, granted an easement over lands to construct, maintain and use a drainage canal that
would eventually be known as the Golden Gate Main Canal. The easement was granted to Gulf American
Land Corporation. In time, the South Florida Water Management District (SFWMD) began maintaining
the canal under a cooperative agreement with Collier County. However, staff has been unable to find any
recorded documentation assigning the original easement or granting new easements to either Collier
County or SFWMD for the maintenance of that portion of the Golden Gate Main Canal from Livingston
Road extending west for a total distance of approximately 9,100 feet. The easements are necessary for
the continued maintenance of the canal.
Although the easements are being donated by all three of the property owners, Bear’s Paw Country Club,
Inc., NWNG Golf, LLC, and Naples Multifamily II DST (Orchid Run Apartments, LLC), two of the
property owners have incurred document review and/or processing costs. Accordingly, staff is
recommending that the Board of County Commissioners approve the accompanying Drainage, Access
and Maintenance Easements and the payment of the owners’ incurred expenses.
FISCAL IMPACT: Funds in the amount of $5,200, consisting of approximately $200 in recording fees
and $5,000 to reimburse owners’ incurred costs, are available in Project 60194 within the Stormwater
Capital Fund 325. Source of funds is transfer from the General Fund (001) and Unincorporated Area
General Fund (111). The canal will continue to be operated and maintained by SFWMD under an
existing Cooperative Agreement. Therefore, the County will not incur any maintenance costs arising
from this item.
GROWTH MANAGEMENT IMPACT: These acquisitions are in accordance with the goals,
objectives, and policies of all applicable sections of the Stormwater Management and the Conservation
and Coastal Management elements of the Growth Management Plan.
LEGAL CONSIDERATIONS: This item has been approved as to form and legality and requires a
majority vote for Board approval. -JAB
RECOMMENDATION:
1. Approve the acquisition of the accompanying Drainage, Access and Maintenance Easements between
the three property owners and the County and authorize its Chairman to execute same, as may be
necessary, on behalf of the Board; and
2. Authorize the County Manager, or his designee, to record the Drainage, Access and Maintenance
Easements in the public records of Collier County, Florida;
3. Authorize the payment of all costs and expenses as set forth herein; and
4. Authorize the County Manager or his designee to take the necessary measures to ensure the County’s
performance in accordance with the terms and conditions of these Easements.
