EXECUTIVE SUMMARY
Recommendation to reject the offer received from Reginald Kreilich, Jonathan Jensen and Andrew
Phillips in the amount of $600,000 for the purchase of County-owned parcel known as Randall
Curve.
OBJECTIVE: To reject the offer received for the Randall Curve parcel.
CONSIDERATIONS: At the December 11, 2018 BCC meeting, Agenda Item 11A, the BCC directed
staff to present all offers received for the purchase and/or swap of the Randall Curve parcel. As
background, the County-owned parcel, known as the 47-acre parcel or the Randall Curve property,
originally consisted of 56.69-acres +/- per Plat Book 7, Page 84. However, in 2002 the Transportation
Division purchased 9.1-acres +/- for stormwater retention, resulting in a remainder of 47.57-acres +/-.
The Randall Curve Property was estimated by the County's in-house Senior Real Estate Appraiser at
$3,520,000. Copy attached for reference.
As directed by the Board, Staff’s original plan was to submit a comprehensive agenda item in April th at
included all offers received, comments received from Neighborhood Information Meetings, the
Memorandum of Understanding with the School District and the results of the due diligence performed
for potential uses of the property.
On January 22, 2019, the attached "Naples Area Board of Realtors Sales Contract (Residential Vacant
Land)" was presented to Real Property Management staff for purchase of the Randall Curve Property and
offers the County $600,000. The offer is revoked, if not accepted, on February 15, 2019. Due to the
proposed terms of the Contract, the offer is being submitted to the Board at this time rather than wait to be
included in the Board directed item in April. Since the offer is well below the valuation by the County’s
in-house real estate appraiser and in light of the legal considerations set forth below, staff recommends
that the County reject the offer and not counter-offer at this time.
FISCAL IMPACT: No fiscal impact.
GROWTH MANAGEMENT IMPACT: There is no impact to the Growth Management Plan.
LEGAL CONSIDERATIONS: Section 125.35, Florida Statutes, requires the County to engage in a
competitive procurement process to convey property. The process includes advertisement of a request for
bids and selection based on a Board determination that it is to the best interest of the County to convey
the property, to the highest and best bidder for the particular use the Board deems to be the highest and
best, for such length of term and such conditions as the Board may in its discretion determine. Such
competitive process has not occurred.
None of the limited statutory exceptions from this process apply to the offer that has been presented to
the Board. Accordingly, it is legally appropriate to reject the offer and not counter -offer at this time.
Should the Board desire, it may direct staff to commence the competitive procurement process for all
interested persons to participate.
This item is approved for form and legality and requires a majority vote for Board approval. - JAB
RECOMMENDATION: To reject the offer since it is well below the valuation prepared by the in-house
staff appraiser.
