Resolution 2005-136 RESOLUTION NO. 2005- 136 A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA, AMENDING SCHEDULE NINE OF APPENDIX A OF CHAPn:R 74 OF THE COLLIER COUNTY CODE OF LAWS AND ORDiNANCES, THE SAME BEING THE COLLIER COUNTY CONSOLIDATED IMPACT FEE ORDINANCE, AS AMENDED, THEREBY INCREASING THE GENERAL GOVt:RNMENT BUILDING IMPACT FEE BY AN AVERAGE OF 4.1 PERCENT PER LANIl USE C\TEGORY; TilE I'ROPOSEIl RATES SPECIFIED IN I{E\'ISEIl SCHEI)lILE NINE OF APPENIlIX A; PROVIDIN(; A IlELA n:1l EFFECTIVE DATE OF AI'RIL 1,2005. WHEREAS, on March 13,2001, the Board of County Commissioners adopted Ordinance No. 2001-13, the Collier County Consolidated Impact Fee Ordinance (CIFO), repealing and superceding all of the County's then existing impact fee rcguhlliollS, and consolidating all of the County's impact fee regulations into that one Ordinance, codified in Chapter 74 of the Collier County Code of Laws and Ordinances (Code orLa\vs); and WHEREAS, on March 9, 2004, the Board of County Commissioners adopted Ordinance No. 2004-16 which amended the CIFO and Chapter 74 of the Code of La\vs to establish the General Government Building Impact Fee, providing for the implementation of the impact fee in three phases, subject 10 the following limitations: i. that for one year from the etTective date of the ordinance the rates set forth in the then clIlTcntly adopted General Government Impact Fee Rate Schedule shall be applied at 75'X, (seventy-five percent) of the then applicable rate; ii. that for one year following the one year period in i., above, the fee to be applied will be 85% (eighty five percent) of the then applicable rate; and iii. that at the end of the time period set forth in ii. above, and thereafter, the rate to be applied will be 100%) (one-hundred percent) of the then applicnble rate. WHEREAS, Ordinance No. 2004-16 also set forth indexing methodologies in Code of Laws Section 74-31 O(g) to provide for annnal indexing adjustments to the General Government Building Impact Fees based upon calculations utilizing percentage changes in Just Values of real property as determined annually by the Collier County Property Appraiser's Office and the Building Price Index prepared by the Engineering -News Record, and which shall be calculated utilizing the rates in full set forth in the General Government Impact Fee Rate Schedule; and WHEREAS, Collier County uses impact fees to fund necessary capital improvements required to provide public facilities to serve new population and related development that is necessitated by growth in Collier County; and WHEREAS, this application of indexing adjustments provides for an average of a 4.1 percent increase in the General Government Building impact Fees; and Pagl: ] 01'2 WHEREAS, the above recommended rate increase establishes these rates at the maximum levels allowed in accordance with eqnity tests established and existing pursuant to Florida law; and WHEREAS, staff has thoroughly reviewed the eaIcnlations and findings and staff concurs with the recommended increase to the General Government Building Impact Fce rate schedule, and staff recommends that the Board of County Commissioners adopt this Resolution to implement these reconunended changes; and WHEREAS, the Board of County Commissioners accepts the recommendations from staff. NOW, THEREFORE BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that: The Board of County Commissioners hereby declares, aftcr advertised public hearing, that the General Government Bnilding Impact Fee rates set forth in the revised Schedule Nine of Appendix A of Ordinance No. 2001-13, as amended, the Collier County Consolidated Impact Fee Ordinance, the same being Schedule Nine of Appendix A of Chapter 74 of the Collier County Code of Law and Ordinances, attached hereto, and incorporated by reference herein as Exhibit "A" are fair and reasonable and are to be assessed to those who receive or will receive benefits from related public facilities, which is necessitated by increased popnlation and related growth driven development. BE IT FURTHER RESOLVED that these revised General Government Bnilding Impact Fees will take effect as of 8:00 A.M. on Friday, April I , 2005.
