RESOLUTION NO. 05-~
A RESOLUTION OF THE BOARD OF ZONING APPEALS
OF COLLIER COUNTY, FLORIDA, APPROVING
PETITION NUMBER SV-2004-AR-6501, FOR A SIGN
VARIANCE ON PROPERTY HEREINAFTER
DESCRIBED, AND LOCATED IN COLLIER COUNTY,
FLORIDA.
WHEREAS, the Legislature of the State of Florida in Chapter 125, Florida
Statutes, has conferred on all counties in Florida the power to establish, coordinate and
enforce zoning and such business regulations as are necessary for the protection of the
public; and
WHEREAS, the County pursuant thereto has adopted a Land Development Code
(Ordinance No. 2004-41, as amended), which establishes regulations for the zoning of
particular geographic divisions of the County; and
WHEREAS, Land Development Code (LDC) Section)9.04.02 authorizes sign
variances where it can be demonstrated that a sign has significant historic or community
significance; and meets the criteria and procedures set forth in LDC Section 9.04.00; and
WHEREAS, the Board of Zoning Appeals (BZA) being duly constituted, has
held a properly noticed public hearing and all interested parties have been given
opportunity to be heard by this Board and the Board having considered all matters
presented, considered the advisability of allowing Fidelity Investments to reface and
retain its one existing non-conforming ground sign located on the northeast comer of its
property; and
WHEREAS, LDC Section 5.06.06.C only allows one ground or pole sign and
Fidelity has two, the second of which is non-conforming such that Fidelity is therefore
requesting a variance to allow it to have two 6-foot by 2-foot ground signs, rather than
one sign allowed by the LDC, all shown on the attached plot plan, Exhibit "A", in a C-4
zoning district for the property hereinafter described; and
WHEREAS, the BZA has found as a matter of fact that satisfactory provision and
arrangement has been made concerning all applicable matters required by LDC Section
5.06.06C of the Zoning Regulations of said Land Development Code for the
unincorporated area of Collier County.

NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF ZONING
APPEALS OF COLLIER COUNTY, FLORIDA, that:
The Petition SV-2004-AR-6501 filed by Kyle Bach of Site Enhancement
Services, representing Fidelity Building, LTD, with respect to the property hereinafter
described as:
Lots 13 and 14, Tract A, recorded in Plat Book 12, Pages 57 -58 and
Plat Book 10, Page 86 of the Public Records of Collier County,
Florida
be and the same hereby is approved, subject to the following conditions:
Exhibit "B".
BE IT RESOLVED that this Resolution approving Petition Number SV-2004-
AR-6501 be recorded in the minutes of this Board.
This Resolution adopted after motion, second and majority vote.

1. The applicant is limited to the square footage and number of signs requested
in this application:
(1) 3'-1" x 14'- 3 7/8" Wall Sign
(1) 2'-3" x 10'- 5" Wall Sign
(1) 2' x 6' Monument sign face panel
(3) 2'-6" x 2' Directional monument
(1) 2' x 6' Monument sign face panel
2. Existing landscaping must be retained.
3. All signs on the property will be properly permitted by Collier County.
