A RESOLUTION OF THE COLLIER COUNTY BOARD OF COUNTY
COMMISSIONERS FOR PETITION AVPLAT2004-AR6852 TO DISCLAIM,
RENOUNCE AND VACATE THE COUNTY'S AND THE PUBLIC'S
INTEREST IN A 15 FOOT WIDE DRAINAGE EASEMENT LOCATED ON
TRACT "J", ACCORDING TO THE PLAT OF "STRATFORD PLACE", AS
RECORDED IN PLAT BOOK 40, PAGES 15 THROUGH 21, PUBLIC
RECORDS OF COLLIER COUNTY, FLORIDA, AND TO ACCEPT A 15
FOOT WIDE RELOCATION DRAINAGE EASEMENT ON A PORTION OF
SAID TRACT "J", LOCATED IN SECTION 18, TOWNSHIP 49 SOUTH,
RANGE 26 EAST.
WHEREAS, pursuant to Section 177.101, Florida Statutes, Norm Trebilcock, AICP,
P.E., as agent for the petitioner, Pulte Home Corporation, does hereby request the vacation of a
IS foot wide drainage easement located on Tract "J", according to the plat of "Stratford Place" as
recorded in Plat Book 40, Pages IS through 21, Public Records of Collier County, Florida, and to
accept a 15 foot wide relocation drainage easement on a portion of said Tract "J"; and
WHEREAS, the Board has this day held a public hearing to consider vacating the IS
foot wide drainage easement located on Tract "J", according to the plat of "Stratford Place" as
recorded in Plat Book 40, Pages IS through 21, Public Records of Collier County, Florida, and to
accept a 15 foot wide relocation drainage easement on a portion of said Tract "J" of said
"Stratford Place", as more fully described below, and notice of said public hearing to vacate was
given as required by law; and
WHEREAS, the granting of the vacation will not adversely affect the ownership or fight
of convenient access of other property owners.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that the County's easement interests
over and across the following 15 foot wide drainage easement are hereby vacated, extinguished,
renounced and disclaimed, and this action is declared to be. in the Public's interest and for the
Public's benefit:
See Exhibit "A" attached hereto and incorporated herein.

BE IT FURTHER RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS
OF COLLIER COUNTY, FLORIDA, that the 15 foot wide drainage easement, more particularly
described in Exhibit "B" attached hereto and incorporated herein, is hereby accepted as a
relocation drainage easement for the drainage easement vacated herein.
BE IT FURTHER RESOLVED, that the Clerk to the Board is hereby directed to record
a certified copy of this Resolution in the Official Records of Collier County, Florida, and to make
proper notation of this vacation on the recorded plat as referenced above.

TillS DRAINAGE EASEMENT (this "Easement") is made and entered into by and between
PULTE HOME CORPORATION, a Michigan corporation authorized to conduct business in the State of
Florida ("Pulte"), having an address of9148 Bonita Beach Road, Suite 102, Bonita Springs, FL 34135 and
STRATFORD PLACE MASTER ASSOCIATION, INC., a Florida not-for-profit corporation ("Master
Association"), having an address of c/o Pulte Home Corporation, 9148 Bonita Beach Road, Suite 102,
Bonita Springs, FL 34135 and the BOARD OF COMMISSIONERS OF COLLIER COUNTY,
FLORIDA, AS THE GOVERNING BODY OF COLLIER COUNTY AND AS EX-OFFICIO THE
GOVERNING BOARD OF THE COLLIER COUNTY WATER-SEWER DISTRICT, its successors
and assigns ("Collier County"),
WITNESSETH:
WHEREAS, Pulte is the owner of that certain real property in Collier County, Florida that is
legally described in Exhibit "A" attached hereto.
WHEREAS, Master Association is the homeowners' association that operates and maintains
"Stratford Place", a subdivision located in Section 18, Township 49 South, Range 26 East recorded in Plat
Book 40, Pages 15 thru 21, of the Public Records of Collier County, Florida and as more particularly
described in the Declaration of Covenants, Conditions and Restrictions for Stratford Place recorded in Q,R.
Book 3359 Pages 813 !<! ~., Public Records of Collier County, Florida.
WHEREAS, Pulte wishes to vacate an existing platted easement and replace it with the easement
described below and in Exhibit "A" attached hereto, in order to eliminate the encroachment of a building
into the platted easement.
NOW THEREFORE, in consideration of the promises, covenants and agreements hereinafter set
forth and in furtherance of the understanding ofthe parties, it is hereby agreed as follows:
I, Recitals. The above recitals are true and correct and incorporated herein by this reference,
2, Easement Grant to Master Association. Pulte hereby grants, gives, and conveys to
Master Association, a perpetual, nonexclusive drainage easement in gross ("Drainage Easement") through,
beneath, and under that land that is legally described in Exhibit "A". This grant of drainage easemeIlt shall
include the Master Association's right and responsibility to install, access, maintain and ,repair all necessary
lines, pipes, swales, and other facilities in the Drainage Easement.
3. Easement Grant to CoUler County. Pulte hereby grants, gives, and conveys to Collier
County, a perpetual, nonexclusive drainage easement in gross ("Drainage Easement") through, beneath, and
under that land that is legally described in Exhibit "A", This grant of drainage easement for drainage
management purposes is without responsibility for maintenance.
4 Bindin!! Effect. All the covenants and easements set forth herein are intended to be and
shall be construed as covenants and servitudes running with the land legally described in Exhibit "A" and
shall be binding upon and inure to the benefit of each party hereto, its respective successors in interest,
grantees, and assigns.

"Corporation"), a corporation organized and existing under the laws of the State of Michigan,
authorized to do business in the State of Florida, having its principal office at Bloomfield Hills,
Michigan, does hereby effective immediately, constitute and appoint the following employee(s),
of the Ft. Myers division, Richard H. McCormick and Nicole Palkowski as its tme and lawful
agents and additional attorneys-in-fact in [Broward, Charlotte, Collier, Dade, Indian River, Lee,

and boundary line adjustment; owner's consents; declarations of covenants,

property owned or under option by the Corporation; re-zoning applications,
proffer applications and amendments and proffer agreements and other similar
documents related to the development of real property owned or under option by
the Corporation; and

questionnaires, statements, and other necessary and required documents pertaining
to the filing with those states of any real estate questionnaires, applications or
similar documents or exhibits relating to the advertisement of real property

(5) Enter into and execute dc;velopment, supplier, subcontract and/or construction
agreements for the develop'inent and/or construction of and on any property owned
or under option by the Corporation,
This Power of Attorney shall expire at midnight on January 31, 2009, unless extended or
revoked by the Corporation prior to such expiration date.
